Acknowledgment of Risks & Release Notice – Bicycle Use
INTRODUCTION
Please read this entire Acknowledgment, Assumption of Risks, and Release & Indemnity Agreement (hereafter “Agreement”) carefully before signing.
In consideration of the services provided by A&J Home Concierge and the respective owners, officers, directors, employees, agents, and other affiliated persons or entities (collectively “Providers”), and the owner(s) of the property where bicycles are provided, the undersigned renter (“Renter”) acknowledges and agrees to the following terms:
Risks Acknowledgment
I, {riderName} , acknowledge that the use of bicycles comes with inherent and other risks that could result in injury, property damage, or death. These risks include, but are not limited to:
- Falls, collisions with objects or people, or being struck by vehicles
- Loss of control due to terrain, weather, or equipment malfunction
- Use of the bicycle without proper safety gear or at unsafe speeds
- Misjudgment of one’s ability or physical condition
- Exposure to natural elements, insects, or animals
- Remote locations or delayed emergency response
Use & Responsibility Acknowledgment
By signing this agreement, I agree to the following:
Helmet Requirement: I understand and agree that helmets must be worn at all times when using the bicycles provided.
Proper Use: I will not use the bicycle under the influence of alcohol or drugs and will operate the bicycle in a safe and lawful manner.
Condition Check: I will inspect the bicycle upon first use and report any damage. Failure to report damage implies acceptance of the equipment in good condition.
Restricted Use: I will not allow others to use the bicycle unless they have signed this agreement.
Personal Risk: I accept full responsibility for assessing my own physical ability to safely use the bicycle.
Safety Compliance: I agree to follow all local, state, and community laws, including bicycle path rules and traffic regulations.
Release & Indemnity Agreement
I, the undersigned Rider/Renter, agree:
To release and hold harmless A&J Home Concierge and the property owner, and all affiliated parties, from any and all claims, actions, damages, or liabilities related to or arising from the use of the bicycle, including those caused by negligence.
To indemnify (reimburse) the Providers for any claim brought by or on behalf of myself or another person using the equipment due to my invitation or sharing of the bicycle.
That this release includes claims related to personal injury, property damage, or wrongful death, regardless of the cause, including negligence or equipment failure.
That I am using the bicycle “as-is” with no warranties expressed or implied regarding its condition or fitness for a particular use.
Governing Law & Jurisdiction
This Agreement shall be governed by the laws of the State of Florida. Any disputes arising under this agreement shall be resolved in a Florida state court or, if applicable, the United States District Court for the District of Florida. In the event of a dispute, I agree to attempt to resolve it through mediation before initiating any legal proceedings.
Acknowledgment & Signature
I acknowledge that I have read, understood, and voluntarily agree to this Bicycle Use Agreement and that it shall be binding upon me, my heirs, legal representatives, and assigns.
