    Terms of Use

    Eligibility
    I confirm that I am aged 18 or over and competent to ride a bicycle safely.


    Safe Use
    I agree to ride the bicycle responsibly and in accordance with the Highway Code and all applicable road laws.


    Use by Others
    The bicycle must only be used by me unless prior permission has been given by Horningsea Parish Council.


    Children and Passengers
    Children may only be carried in appropriate seats or equipment designed for that purpose and must be properly supervised.


    Care of the Bicycle
    I agree to take reasonable care of the bicycle and any equipment provided.


    Security
    Whenever the bicycle is left unattended, it must be secured with the lock provided to a suitable fixed object.


    Damage, Accidents, or Faults
    I will report any accident, damage, fault, or theft involving the bicycle to Horningsea Parish Council as soon as reasonably practicable.


    Return of the Bicycle
    I agree to return the bicycle and any equipment supplied at the agreed time and in the same condition as when loaned, allowing for normal wear and tear.


    Risk Acknowledgement
    Cycling carries inherent risks. I acknowledge these risks and agree to use the bicycle responsibly.


    Council Responsibilities
    Horningsea Parish Council confirms that the bicycle has been checked and maintained to a reasonable standard prior to loan.


    Liability
    Nothing in this agreement excludes or limits liability for death or personal injury caused by negligence.


    Personal Data
    Personal information provided in this form will only be used for administering the bicycle loan scheme and handled in accordance with the Council’s privacy policy.
     

  • The Lender shall be defined as Horningsea Parish Council for the purpose of this agreement. The User shall be defined as the person who is hiring the bike.

    The User confirms they are a competent cyclist over the age of 18 and recognises that they will be riding a bike that may not be familiar to them and will therefore exercise additional care and attention. The Lender lends cycles on the understanding that the User is capable of using gears and adjusting the saddle height properly. When hiring on behalf of a child, the User accepts full responsibility for the child riding the bike and must accompany them at all times.

    In the case of hiring a cargo or adult bike, only the User may ride the bike unless prior permission has been granted by the Lender.

    In the event of a puncture or any other mechanical problem, the User must notify the Lender, who will arrange for the bike to be repaired as soon as possible. The User is responsible for returning the bike to the designated depot for repair. With prior written permission from the Lender, the User may have the bike repaired at a local bike shop at their own expense.

    It is the User’s decision whether or not to wear a helmet. They assume full responsibility for any accident, injury, or death that may occur as a result of this decision.

    Cycling carries inherent risks. By signing this agreement, the User declares they are in good health and not suffering from any medical condition or disability that might impair their ability to safely control the cycle. They also agree to:

    ● Not undertake any manoeuvres beyond their skill level or the intended design of the cycle provided
    ● Abide by the Highway Code at all times
    ● Use lights when cycling in the dark
    ● Store the bike securely indoors (e.g. in a garage) and locked with the provided lock at night unless agreed otherwise in writing
    ● Lock the bike to an immovable, secure object with the provided lock whenever left unattended during the day

    The User is responsible for all equipment associated with this agreement. Any loss of the bike or equipment is solely the User’s responsibility. All bicycles and equipment remain the property of the Lender.

    The User may be responsible for the cost of repairing damage caused to the bicycle or associated equipment through misuse or negligence to the cycle and associated equipment. The User accepts responsibility for their use of the bicycle and agrees to take reasonable care to avoid injury to themselves or others.

    Before riding, the User agrees to carry out a basic safety check (including brakes, tyres and steering) and must not use the bicycle if it appears unsafe.

    Refunds will NOT be given for punctures or damage to the gears or frame resulting from incorrect use.

    The User must report any accident, damage or theft involving the bicycle to the Council as soon as reasonably practicable.

    The bicycle must not be used for commercial purposes, racing, or any activity beyond normal personal transport.

    A deposit is required when hiring a bike. This will be refunded upon return of the bike on time, clean, and undamaged. The User is responsible for thoroughly checking the bike before use. Charges may apply for:

    ● Late return beyond the agreed hire period stated on the front of this agreement
    ● Excessive dirt or condition requiring more than standard post-hire maintenance

    This Agreement and its Terms and Conditions are governed by English Law. Should any part of the Agreement be deemed unenforceable, the remaining provisions will remain in full effect. The Lender reserves the right to terminate the hire agreement immediately and retain any deposit if the terms of hire are breached.
