Coaching Agreement
A. Consent for Coaching Service
Nature of the Program: I understand that I am voluntarily participating in an online fitness coaching program provided by Michelle Cheng / Movement with Mish. This program includes personalised workout plans, nutritional guidance, and virtual coaching sessions.
Acknowledgement of Risks: I am aware that participating in physical activities involves certain risks, including the risk of injury. I understand that Michelle Cheng will take all reasonable precautions (such as personalised modifications and clear instructions) to ensure my safety during the coaching sessions. However, I acknowledge that unforeseen incidents may occur.
Assumption of Risks: I willingly accept and assume all risks associated with the online fitness coaching program. I understand that it is my responsibility to inform the coach of any pre-existing health conditions, injuries, or concerns that may affect my ability to participate safely. I confirm that I have consulted with my physician and have been cleared to participate in physical activity and nutritional changes.
Release of Liability: In consideration of being allowed to participate in the online fitness coaching program, I release and discharge Michelle Cheng and her affiliates from all claims, liabilities, and damages arising out of or connected with my participation in this program, except in cases of gross negligence or wilful misconduct.
Informed Consent: I have been provided with sufficient information about the nature of the online fitness coaching program. I understand the terms and conditions outlined in this waiver, and I willingly consent to participate in the program.
Media Release Consideration: I am aware that Movement with Mish may use client first names, photographs, before & after photos and coaching feedback for promotional and marketing purposes, including social media platforms, websites, and other marketing channels.
Coaching Inclusions: Your coaching includes: personalised training programs delivered via the Hevy app, weekly Q&A check-ins via the app’s messaging feature, and ongoing program adjustments based on your progress and feedback. Nutrition education and general guidance may be provided, but full meal plans or medical advice are not included.
Payments & Billing: Payments are charged weekly or monthly in advance. There is no minimum commitment. You may continue on a month-to-month basis for as long as coaching supports your goals. To cancel or pause your coaching, please provide at least 14 days’ notice before your next billing cycle. No refunds are provided for payments already processed.
Client Responsibility: You acknowledge that you are responsible for your health, safety, and wellbeing while following the program. You should consult your doctor before beginning any new fitness or nutrition program. All information provided through coaching is for educational purposes only.
Governing Law and Jurisdiction: This agreement is governed by the laws of the State of New South Wales and the Commonwealth of Australia. Any disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of New South Wales.
