RELEASE AND WAIVER OF LIABILITY, AND INDEMNITY REGARDING USE OF WATERCRAFT BY MEMBERS OR GUESTS (“AGREEMENT”)
This waiver applies to all watercraft activities at LBC, including stand-up paddleboarding (SUP), kayaking, sailboats, and any related use of LBC docks, racks, floats, or equipment (Watercraft Activities).
COMPLIANCE WITH RULES: I agree to comply with LBC’s SUP and watercraft rules (e.g., lifejacket use, age restrictions, area boundaries, time limits) and Washington boating and water laws. I understand non-compliance may result in suspension of my privileges.
PARTIAL DESCRIPTION OF RISKS: I understand that Watercraft Activities carries certain significant risks to both me and those with me, including but not limited to personal injury, death, property damage, and other loss, which may result from such events as capsizing or sinking, being struck by sail booms, collisions with other watercraft, persons jumping from the dock or towers onto the watercraft if I get too close to them, and the like. I understand and agree to take all actions necessary and appropriate to minimize or eliminate all risks to the best of my ability, including listening to all instructions from LBC staff prior to the use of watercraft and all Watercraft Activities, staying a safe distance away from the dock and diving towers and platforms, and using proper safety etiquette. I understand that the foregoing is not a complete or exhaustive list of all possible risks.
ASSUMPTION OF LIABILITY, RELEASE AND INDEMNITY: I hereby assume full responsibility for any accident or personal injury (including death) resulting from Watercraft Activities related to the Laurelhurst Beach Club (“LBC”) including but not limited to the use of sailboats, stand up paddleboards, or other equipment. I hereby waive, release, and discharge LBC from any and all liability for injury, death, property damage, or other loss arising from my participation in Watercraft Activities, including claims arising from LBC’s negligence. I agree to release, indemnify, hold harmless, and defend LBC, its trustees, members, employees, agents and volunteers from and against any and all liability, and waive any claim for personal injury or other loss, arising from or in any way relating to such use.
CONTINUING NATURE OF UNDERTAKING: I understand and acknowledge that LBC is relying on the representations, release of liability and indemnity contained in this agreement, that it would not consider granting permission to the undersigned without them, and that such representations, release of liability and indemnity shall remain in full force and effect (during the current LBC season and continuing at all times thereafter) until revoked by delivery of a written revocation, signed by me, to the LBC business office.
REVOCATION: I understand and agree that any decision by LBC to allow me to use the watercraft or participate in Watercraft Activities may be revoked at any time by the LBC manager, any LBC lifeguard, or a decision of the LBC board, at the sole discretion of such person or entity. The representations, release and indemnity contained in this agreement shall continue in full force and effect following such revocation.
LBC KAYAK / SUP (WATERCRAFT) RULES
- All persons 12 years of age and over may take kayaks or SUPs out on the water unaccompanied.
- Minors under the age of 12 must be accompanied by an adult (18+) in a 1:1 ratio of child to adult.
- All persons taking out a watercraft must have an up-to-date waiver signed.
- Watercrafts may be taken out for a maximum time of 30 minutes.
- All persons who have taken out watercrafts must be in view of the club at all times (100 yards).
- All persons must stay on the watercraft & hold onto paddle(s) at all times and there may be no roughhousing on or between crafts.
- All persons must wear a lifejacket at all times while on watercrafts.
ELECTRONIC SIGNATURE: By signing below, I agree that this Release and Waiver of Liability may be executed electronically and that my electronic signature shall be deemed to have the same legal force and effect as a handwritten signature. I understand that a copy of this executed waiver, whether in electronic or paper form, shall be considered valid and enforceable.
