PLEASE READ CAREFULLY. BY SIGNING THIS DOCUMENT, YOU CHOOSE TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE

To: Danica Wilson, Happy Ranch Pool, LLC ("Owner") or ("Releasees")

13015 SE Ridgecrest Road, Happy Valley, OR 97086 ("Property")

POOL USE WAIVER, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT

I, on behalf of myself and any minor children or guests in my care, have reserved and will use the swimming pool and related facilities at the property located at [Property Address] (“the Property”). By using the pool and facilities, I acknowledge, understand, and voluntarily agree as follows:

A. Acknowledgement of Rules and Risks

1. I agree to observe and obey all posted rules and warnings, and to follow any oral instructions given by Danica Wilson, her employees, representatives, or agents.
2. I acknowledge that no lifeguard is on duty at any time. I am solely responsible for the safe operation and supervision of the pool and for the safety of all persons I permit to use the pool during my reservation.
3. I understand that pool use involves inherent risks, including but not limited to:
   • Injuries due to malfunction of pool equipment;
   • Injuries from climbing or playing on the glass tile surround and spa wall;
   • Slips, trips, or falls in the pool area, pool deck, steps, or patio;
   • Collisions between unsupervised divers and swimmers;
   • Risks of drowning, near-drowning, or other water-related injuries;
   • Slipping on the pool house concrete floor;
   • Hazards related to weather changes, high winds, or umbrellas tipping over;
   • Risks associated with the cold plunge, including cold shock or slipping;
   • Risks of animal interactions or bee stings;
   • Risks associated with alcohol or drug use while swimming;
   • Any other risks not specifically listed above.
4. I acknowledge that this list is not exhaustive, and that other risks, known or unknown, may result in serious injury, death, or property damage.

B. Waiver, Release, and Indemnity

In consideration for being allowed to use the pool and facilities at the Property:

1. I WAIVE AND RELEASE Danica Wilson and her employees, agents, representatives, co-owners, or affiliates (“Releasees”) from any and all claims for loss, damage, injury, death, expense, or cost that I, my children, my guests, or my next of kin may suffer, including due to negligence by the Releasees.
2. I AGREE TO INDEMNIFY AND HOLD HARMLESS the Releasees from any liability for damage to property or personal injury (including death) to any third party resulting from my use, or my guests’ or children’s use, of the pool and facilities.
3. I assume full responsibility for the conduct and safety of all minors and guests that I invite onto the Property.

C. Acknowledgement

1. I confirm that I am at least 18 years old, am legally competent to sign this agreement, and have authority to sign for any minor children listed below.
2. I agree that this waiver and release will be binding upon me, my heirs, executors, administrators, assigns, and anyone acting on my behalf.
3. I have read this waiver carefully and fully understand its contents. I sign it voluntarily and acknowledge that by signing, I am waiving certain legal rights.
