Acknowledgment and Assumption of Risk
I, the undersigned participant (or the legal guardian of a minor participant), acknowledge that participation in FPV (First Person View) drone flying and related activities at Run-A-Muck Farms involves inherent risks, including but not limited to:
- Drone malfunctions, loss of control, or collisions
- Slips, trips, or falls on natural or uneven terrain
- Weather-related hazards
- Injuries from other participants or drones
- Encounters with wildlife or farm elements
- I understand that these activities may result in serious personal injury, property damage, or death, and I voluntarily assume all risks, known and unknown, associated with my presence and participation.
Release of Liability and Hold Harmless Agreement
In consideration for being allowed to access and use the FPV drone park facilities on the private property of the Vinsant Family (Run-A-Muck Farms), I hereby:
Release, discharge, and hold harmless the Vinsant Family, their heirs, agents, representatives, and any volunteers assisting with activities on the premises (collectively referred to as the “Released Parties”), from any and all claims, causes of action, or demands for damages, injury, illness, death, or property loss arising out of or in connection with my participation — even if caused by negligence.
Indemnify and hold harmless the Released Parties from any and all liabilities, costs, damages, or expenses (including legal fees) incurred due to my presence or actions on the property.
Property Damage Clause
I understand and agree that I am financially responsible for any damage I cause, whether intentionally or through negligence, to any equipment, structures, fencing, landscaping, or other property owned by the Vinsant Family at Run-A-Muck Farms. This includes but is not limited to drone gates, course obstacles, buildings, signage, vehicles, or farming equipment.
I agree to promptly repair, replace, or reimburse for any such damage at the discretion of the property owner.
Rules and Participant Conduct
I agree to comply with all posted and communicated rules while on the property, including:
- Flying only in designated areas
- Operating drones safely and responsibly
- Maintaining visual line of sight or FPV feed at all times
- Respecting all property and property owners, animals, and fellow participants
- Not engaging in reckless, aggressive, or disruptive behavior
- Violation of any rules or conduct that endangers others or damages property may result in immediate removal and a permanent ban from the premises.
Medical Treatment and Emergency Authorization
In the event of an injury or medical emergency, I authorize the Released Parties to secure necessary medical care on my behalf and agree to be financially responsible for all related expenses.
Ongoing Acknowledgment
This waiver is binding for all current and future visits to Run-A-Muck Farms unless revoked by the property owner or participant in writing. I understand that no additional waiver will be required for return visits.
General Provisions
This agreement shall be governed by the laws of the State of Alabama. If any portion of this agreement is deemed unenforceable, the remaining provisions shall remain in full force and effect. This document constitutes the full and complete agreement between the parties regarding liability and participation.
