By executing this agreement, the undersigned agree(s) for himself, herself, itself and its/their successors, heirs and assigns that participation in the Yarmouth Clam Festival, as described herein, shall be at the risk of the undersigned, and that the undersigned hereby releases and forever discharges and expressly agrees to indemnify and hold harmless the YARMOUTH CHAMBER OF COMMERCE, the YARMOUTH CLAM FESTIVAL, the TOWN of YARMOUTH, CASCO BAY FORD, BATH SAVINGS INSTITUTION, YARMOUTH PAYROLL PLUS and the officers, directors, employees, agents and members of either organization, together with their successors and assigns of and from all debts, demands, actions, causes of action, suits, dues, sum and sums of money, accounts, reckonings, bonds, specialties, covenants, contracts, controversies, agreements, promises, doings, omissions, variances, extents, execution and liabilities whatsoever including, without limiting the generality of the foregoing, claims for contribution, exoneration or indemnity, or any other thing whatsoever which might arise from the undersigned's participation in the Yarmouth Clam Festival.
I understand and agree to comply with the following:
- My vehicle will follow all public safety laws.
- My vehicle will not solicit donations or raise funds.
- My vehicle will not be political, religious or controversial in nature.
- In the event of uncertainty concerning the character of my vehicle, I agree to abide by the Director’s decision.
- I and/or my organization will assume liability for any damages or injury caused by my vehicle during the duration of Main Street Rumble.
