Payment Information
This agreement is between Miss Brooke Photography (Brooke Butterworth) and the client named above.
The client agrees that Miss Brooke Photography will collect payments in accordance with the chosen amount stated in this contract, and will not charge more than the agreed total.
The client understands that no refunds will be issued if they choose to cancel their subscription early for any reason, including a change of mind. There are no early cancellation fees.
If the client overpays the agreed amount, the excess will either be refunded or transferred as credit toward a future photoshoot booked with Miss Brooke Photography.
If the client repeatedly fails to make payments as agreed, Miss Brooke Photography reserves the right to cancel the photoshoot and refuse rebooking, with no refund for any amount already paid.
The full amount + any agreed-upon additional travel fees must be paid at least 7 days prior to the date of the Photoshoot.
Based on payments of $25 per week, the total payment periods are as follows (excluding extra fees):
> Finer Moments: $200.00 Deposit + 6 weeks total
> Classic Photoshoot: $200 Deposit + 16 weeks total
> Timeless Memories: $200 Deposit + 24 weeks total
> Elopment: $800 Deposit + 32 weeks total
> Half Day: $1,600 Deposit + 64 weeks total
> Full Day: $2,400 Deposit + 96 weeks total

Rescheduling
If either the client or Miss Brooke Photography needs to reschedule the photoshoot due to illness, an emergency, or adverse weather conditions, Brooke will make every effort to find the next available date that suits both parties.
Delivery of Photos
Your photos will be delivered within 1–2 weeks of your photoshoot date, and 2–3 weeks for weddings. All images are provided in a private online gallery for easy viewing and downloading. Your gallery will remain available for up to 2 months from the delivery date.
Brooke securely stores copies of her work indefinitely whenever possible. If you lose access to your downloads, please reach out. She will do her best to assist you. However, please note that technology can sometimes fail, and data may become corrupted; therefore, Brooke cannot guarantee a full recovery of your gallery after the original delivery period.
The CLIENT may download images from the online gallery for personal use only. Downloaded images must not be reproduced in any form, including for the purpose of being submitted to contests, reproduced for commercial use or in any other form other than as provided for in this agreement or with the express written license of the PHOTOGRAPHER.
PHOTOGRAPHER retains the right of discretion in selecting the photographic materials released to the client.
The final post-production and editing styles, effects, and overall look of the images are left to the discretion of the PHOTOGRAPHER.
Client Responsibilities
The client agrees to provide Brooke with all the necessary information in a timely manner, arrive on time to their photoshoot and keep payment information up to date to avoid any missed payments.
If the Client arrives late to their session, they will receive the remainder of their session.
Indemnification
PHOTOGRAPHER and CLIENT agree that the PHOTOGRAPHER is under no obligation to capture any specific moment or pose or person(s) during the PHOTOSHOOT. The PHOTOGRAPHER is not responsible for compromised coverage due to causes beyond the control of the PHOTOGRAPHER, including but not limited to obtrusive guests, lateness of the CLIENT or guests, weather conditions, schedule complications, incorrect addresses provided to the PHOTOGRAPHER, or restrictions of the locations.
Unless specifically requested in writing prior to the commencement of the PHOTOSHOOT, the PHOTOGRAPHER is not responsible under this agreement: for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage; for missed coverage of any part of the PHOTOSHOOT; or for failure to deliver images of any specific individuals or any specific objects at the PHOTOSHOOT.
Agreement
CLIENT agrees to indemnify and hold PHOTOGRAPHER harmless for any and all personal injury which may occur during the course of the photography session and the immediately surrounding PHOTOSHOOT (including any personal injury arising from or connected with any negligent act or omission on the part of PHOTOGRAPHER).
CLIENT agrees to indemnify PHOTOGRAPHER and keep it harmless from and against all losses and claims, proceedings, action for damages, compensation, expenses, losses, legal costs (on an indemnity basis), contribution, indemnity or any other legal, equitable or statutory remedy arising from or in connection with this agreement.
PHOTOGRAPHER reserves the right to terminate coverage and leave the location of the PHOTOSHOOT if the photographer experiences inappropriate, threatening, hostile or offensive behaviour from anyone at the photoshoot or in the event that the safety of the photographer is in question. If PHOTOGRAPHER leaves the photoshoot in accordance with this clause, PHOTOGRAPHER will not be liable to refund any amount to CLIENT, but will be obliged to provide CLIENT with photographs taken by PHOTOGRAPHER prior to PHOTOGRAPHER leaving the photoshoot.
