Consent, Release of Liability Disclaimer & Notices (please read carefully)
I, the undersigned, as the parent or legal guardian of the above named participant, hereby agree to the following:
1. I understand that my child is participating in a series of weekly yoga workshops and classes offered by the Blossom Yoga Center, an initiative of the Blossom Foundation (hereby, the “Foundation”). I acknowledge that I am familiar with the nature of activities offered by the Blossom Yoga Center and understand that yoga involves physical movements, postures, breathing and other exercises that may result in injuries. I, the parent or legal guardian of the participant, hereby, certify that my child is in good physical health to participate in the classes.
2. I understand that it is my responsibility to consult with a physician prior to and regarding my child’s participation in any physical fitness program, including yoga. I represent and warrant that my child has no medical condition that would prevent their participation.
3. As the parent or guardian of the participant, I agree that the Foundation can disclose any Confidential Information I may have shared about my child, including but not limited to the Foundation’s teachers, about any pre-existing or current medical condition to an emergency medical provider. In the event of a medical emergency, the Foundation’s teachers reserve the right to contact the parents or legal guardian at the phone number stipulated in this Yoga Class Assumption of Risk, Waiver and Release of Liability Agreement and emergency medical providers.
4. I acknowledge and assume full responsibility for my child’s participation in the class, including but not limited to, any risks, injuries or damages, known or unknown. I knowingly, voluntarily and expressly waive any Claim I may have against the Foundation as a result of my child’s participation in the class. The Foundation is not liable for any acts, omissions or injuries that occur during the duration of the weekly classes.
5. I acknowledge that the Foundation reserves the right to refuse my child’s participation in the yoga class on medical, fitness, health or any other grounds. The Foundation reserves the exclusive right to remove a participant from the yoga class and reserves the right to payment.
6. I agree to indemnify and hold harmless the Foundation from any loss, cost, or liability incurred in defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the negligence of the Foundation or anyone else. I, my heirs, assigns and/or legal representatives hereby release, waive and discharge the right to sue the Foundation for any Claim caused by any negligence or other acts of the released party, including its agents, teachers and board members.
7. I hereby acknowledge and authorise the Foundation to record the in-person classes for quality, training and monitoring purposes, which will be accessible to the Foundation and its agents associated with the Blossom Yoga Center. I acknowledge that the Foundation may take group photographs of the participants for promotional purposes and hereby give permission for my child to be photographed and videographed while participating in the class. I agree that I, the parent or guardian, signing on behalf of my child, will not receive any monetary compensation or other considerations for the permissions granted and hereby release the Foundation from any liability by use of such content. The Foundation has the exclusive right, title, interest and copyrights of such photographs and video recordings.
8. This Yoga Class Assumption of Risk, Waiver and Release of Liability Agreement shall be construed in accordance with, and governed by, the laws of the State of Texas and that all actions, suits, Claims and proceedings relating to this agreement shall be brought in a court of competent jurisdiction located in Texas.
9. In the event that one or more of the provisions of this Agreement shall become invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions contained shall not be affected. The other provisions remain in effect and shall be valid, binding and enforceable.
