Release, Waiver of Liability and Assumption of Risk

In consideration of being allowed to participate in any activity of Bollywood Groove, LLC (hereafter, Bollywood Groove) and/or use of any facility utilized by Bollywood Groove, the undersigned, on his or her behalf, and on the behalf of the participant(s) identified above (the “Participant(s)”, acknowledges, appreciates and agrees to the following conditions and terms:
I represent that I am the Participant or the parent or legal guardian of the Participant(s) named above, or I have obtained permission from the parent/legal guardian of the Participants(s) to execute this agreement on their behalf, and that all information stated above and herein is true. I am aware that dance and exercise are physical activities and that injury or accident may occur, and Participant(s) (and I) assume all risk related to or arising out of participating in Bollywood Groove activities and represent that Participant(s) are in good health and suffer from no physical impairment. I agree to inform Bollywood Groove and its instructors of
any physical limitations that may prevent full participation. I understand that Bollywood Groove has not and will not render any medical services including any medical diagnosis. I agree that the Participant(s) named above and I shall comply with all stated terms, rules, and verbal instructions as conditions for participation or presence in any Bollywood Groove activities.
I am aware that there are inherent risks associated with participation in Bollywood Groove programs, and I, on behalf of myself and the Participant(s) named above, knowingly and freely assume all such risks, both known and unknown, including those that may arise out of the negligence or other misconduct of other participants or Bollywood Groove: and, I, for myself and the Participant(s) named above, and our respective heirs, assigns, administrators, personal representatives, and next of kin, hereby release and hold harmless, Bollywood Groove, its affiliates, managers, officers, directors, shareholders, agents, instructors, employees, other participants, and related agencies (collectively, the “Release Parties”) from and against any and all claims, injuries, liabilities or damages arising out of or related to our presence and/or participation in any and all Bollywood Groove
programs, activities, or facilities. I agree that neither I nor any Participants(s) will sue any Released Parties for any claim, demand, cause of any action of any kind whatsoever for, or on account of any death, personal injuries or any other damages sustained. I understand that Participant(s) may decline to participate in any Bollywood Groove activity and I understand that Bollywood Groove
instructor(s) have varying levels of expertise and have not been certified as “experts” (or anything else) in any professional manner.
I also promise not to use Bollywood Groove content to teach a dance/exercise class/activity without the written permission of Bollywood Groove’s President, Ajanta Chakraborty. I also give permission for Bollywood Groove to take photos or other recordings of me and any other Participant(s) to use for purposes of promoting Bollywood Groove. If any part of the above is determined by any court of competent jurisdiction to be invalid, unlawful, void, voidable or unenforceable at all, the remainder of the foregoing shall continue to be in effect, valid and enforceable to the fullest extent permitted by law. I represent I have read the foregoing in its entirety and fully understand all terms, and I voluntarily agree to all terms and conditions stated above.
