Notice of State Legislature Usurping Township Powers
Notice to Agent is Notice to Principal and Notice to Principal is Notice to Agent
I, ____________________, one of the People as seen in the fifty (50) State Constitutions, (Republican in Form), Sui Juris, do serve this Notice that you provide immediate due care to those with all political power, the People.
Please take Notice the people are aware Public Act 233 of 2023 unlawfully allows for a legislatively created commission to authorize state certification to construct certain wind and solar energy facilities and energy storage facilities, over the authority of a township. However, granting franchise to a public utility is a power the people have reserved to townships, cities, villages, and counties. It is only in the power of the duly constituted authority of the local unit of government to give consent for the operations of a public utility in their jurisdiction. (See evidence below) (Bolded for emphasis)
Maxim of Law: Power can never be delegated which the authority said to delegate never possessed itself.
Maxim of Law: The government is to be subject to the law, for the law makes the government.
Michigan Constitution Article 7 Section 29: Highways, streets, alleys, public places; control, use by public utilities. No person, partnership, association or corporation, public or private, operating a public utility shall have the right to the use of the highways, streets, alleys or other public places of any county, township, city or village for wires, poles, pipes, tracks, conduits or other utility facilities, without the consent of the duly constituted authority of the county, township, city or village; or to transact local business therein without first obtaining a franchise from the township, city or village. Except as otherwise provided in this constitution the right of all counties, townships, cities and villages to the reasonable control of their highways, streets, alleys and public places is hereby reserved to such local units of government.

Please take Final Notice it is my wish, order, and demand that you as the Michigan Legislature, provide remedy by immediately repealing Public Act 233, and thereby Public Act 234 which could not go into effect without the former. If you believe the legislature has been granted authority to delegate these township powers to a commission, please show this constitutional provision within five (5) days, by sworn affidavit, under penalty of perjury, or you agree Public Act 233 is unlawful, and failure to repeal the same is done with full knowledge, malice and intent and shall be evidence in this court of record, heard by an arbitrator of my choice. (Anyone suppressing this Notice agrees to pay $30,000) (Any response from an attorney not directly addressed by this notice will be considered a non-response)
