  • This assessment is designed to help determine whether Divorce Den’s Blueprint is the right fit for you and your family. By completing it, you’re helping us understand where you are in the process and what level of support may be most appropriate for your situation.

    Please note:

    We ask that the topics included in this assessment—such as property division, child-related issues, and financial matters—have been discussed and generally settled between you and your spouse before beginning.

    This assessment does not ask for the specific terms of your agreements. Instead, it is intended to help us gauge your readiness to proceed and ensure that our process will meet your needs.

    If you find that you haven’t yet considered or resolved some of these topics, that’s okay! Simply note which areas you need help with—additional support or resources may be available through Divorce Den and our Trusted Partner Network.

  • Residency Requirements

  • In order to file for divorce in New York State, the court needs to confirm that it has the legal authority—or jurisdiction—to hear your case. That’s where residency requirements come in.

    New York law says that at least one of the spouses must meet certain residency criteria before a divorce case can be filed. These requirements are in place to prevent people from filing for divorce in a state they don’t truly live in, just to take advantage of different laws.

    Please note: If neither of you meet these requirements, the New York courts cannot legally process the divorce—even if both of you agree to everything.

    • You were married in New York State.
    • You lived in New York State as a married couple.
    • The grounds for your divorce occurred in New York State.
  • Settlement Requirements

  • This Blueprint was designed as a helpful resource for individuals and couples who want to divorce amicably and outside of court. To make that possible, we require that all major issues be fully settled before we can move forward with your case.

    While some of the topics listed may not apply to your situation, we ask that you review the below items carefully and confirm that all applicable items have been discussed and agreed upon.

    If any items are not yet resolved or need further explanation or discussion, please note that in the space provided. We may be able to offer additional services or support options through our Trusted Partner Network, to help you reach an agreement.

  • Issues Related to Children

  • If you have children under the age of 21—or children with special needs under 26—it’s important to make key decisions in advance regarding parenting time, expense sharing, and child support.

    If you need help reaching these decisions, please select that option at the end of this section so we can connect you with a professional from our Trusted Partner Network.

  • Additional Items

  • Issues Related to Finances and Asset Division

  • Retirement Assets

  • If you plan to divide any retirement assets as part of your divorce, it’s important to understand that some accounts can be divided easily, while others require a special court order known as a Qualified Domestic Relations Order (QDRO).

    Before enrolling in this program, we strongly recommend that you contact your retirement plan administrator to ask:

    Whether your specific account requires a QDRO to be divided in a divorce
    What the process looks like for dividing your retirement assets
    If your plan requires a QDRO—or if you are unsure of the requirements—this program may not be the right fit for your situation. However, we may still be able to assist, by guiding you to our Trusted Partner Network.

    To proceed through this program, please confirm:

  • Real Estate

  • If you or your spouse own a marital home, vacation property, or other real estate, it’s important to decide what will happen to that property as part of your divorce settlement.

    You’ll need to determine:

    • Who will keep the property (if either of you plans to stay in it),
    • Whether there will be a buyout of the each other’s shares, and
    • Whether a refinance will be necessary to remove one of your names from the mortgage.


    We require that these decisions be made prior to beginning this program. If you have not yet come to an agreement about real estate division, or if you’re unsure how to structure a buyout or refinance, this program may not be the best fit for you at this time. However, our Trusted Partner Network may be able to assist with more complex property division and negotiation.

  • Tech and Logistical Requirements

    At this time, it looks like you do not meet the technical and logistical requirements needed to complete this fully virtual, self-paced program. Our program is designed for clients who are comfortable printing, scanning, uploading PDFs, attending virtual meetings, and filing their documents independently—either online or in person at their local county clerk’s office.

    We know this path isn’t right for everyone—and that’s okay.

    In New York State, divorces involving minor children require additional documents and detailed parenting and support language in your agreement. These requirements are more complex than in divorces without children, and that’s why our higher levels are designed to support you through them.

    We’ll determine which level best fits your situation during your 30-minute intake meeting via Zoom. During that call, we’ll go over what you’ve already decided with your co-parent, clarify what still needs to be addressed, and walk you through what’s included in each level.

    You May Qualify for Level 4: Divorce with Possible Retirement Division

    Based on your responses, it looks like your divorce may involve retirement account division—which often requires specialized drafting and specific legal language.

    Because of this, you may qualify for Level 4 of the Divorce Den Divorce Blueprint. This is our most comprehensive tier and the only option that includes support for dividing retirement assets, including agreements that may require a Qualified Domestic Relations Order (QDRO).

    While we can’t confirm your final Blueprint level just yet—that’s what your intake meeting is for—we’ll walk you through how to determine if one is needed and what steps to take next. If a QDRO is needed, we’ll also connect you with professionals in our Trusted Professionals Network who can assist with preparing and processing it.
