By signing this waiver and release form, you agree to abide by all guidelines as presented by the Sanctuary, and acknowledge and agree to release Franklin Farm Sanctuary, a nonprofit corporation organized and existing under the laws of the State of California, along with its directors, officers, agents, and affiliates, from liability as described below.
Those who are visiting the Sanctuary as a guest to an event or fundraiser acknowledge the risk of animal interaction and other such risks around outdoor activity.
Those who are interested in Volunteering, who desire to provide services to Franklin Farm Sanctuary and engage in activities related to volunteer service, which may include but are not limited to caring for animals, participating in farming tasks, and assisting at events. Volunteers understand that their relationship with Franklin Farm Sanctuary is strictly voluntary and does not constitute employment. As such, Volunteers will not receive any compensation or benefits typically associated with employment. Volunteers are responsible for obtaining and maintaining their own insurance coverage in the event of personal injury, illness, or property damage related to their volunteer activities.
1. Waiver and Release:
I hereby release and forever discharge Franklin Farm Sanctuary from any and all liability, claims, demands, or causes of action, whether in law or in equity, that may arise from my participation in volunteer activities. I acknowledge that this release discharges Franklin Farm Sanctuary from any liability for bodily injury, illness, death, or property damage that may result from services I provide, or while I am present at Franklin Farm Sanctuary facilities.
2. Insurance:
I understand that Franklin Farm Sanctuary does not provide insurance coverage for medical treatment, disability, or other forms of assistance in the event of injury or illness. I assume full responsibility for my own health and safety during the course of my volunteer service.
3. Medical Treatment
I release and hold harmless Franklin Farm Sanctuary from any claim or liability arising from any first aid or emergency medical treatment provided to me in connection with an incident occurring while volunteering.
4. Assumption of Risk
I acknowledge that volunteering or visiting the Sanctuary may include physically demanding and potentially hazardous activities, including but not limited to animal handling, cleaning, bending, lifting, or operating/cleaning farm equipment. I knowingly assume the risk of injury, illness, death, or property damage associated with such activities and release Franklin Farm Sanctuary from all resulting liability.
5. Photographic Release
I grant full permission to Franklin Farm Sanctuary to use photographs, video, and audio recordings taken of me while volunteering for promotional, educational, or any lawful purposes, without compensation.
6. Animal Interaction Guidelines
I understand I will be interacting and working with rescued animals who may have a history of neglect or abuse. I agree to seek guidance from a trained member or volunteer before physically interacting with the animals. I acknowledge that I am not authorized to train, discipline, or correct animal behavior. I agree to treat all animals with patience and compassion, avoiding loud voices or aggressive gestures. I understand that violating these guidelines may result in removal from the premises.
7. General Provisions
This Waiver and Release is intended to be as broad and inclusive as permitted by California law. If any provision of this agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. This agreement shall be governed by the laws of the State of California.
