    1. Acknowledgment and Warranty
    The vendor warrants and represents that:

    • They are at least 18 years of age.
    • They have the legal right to enter into this Agreement.
    • All items displayed within the rented booth comply with all applicable laws and regulations.

    2. Booth Space and Rental Term

    • Booth rental begins on the date this Agreement is signed and continues on a month-to-month basis unless terminated by either party with a 30-day written notice.
    • Booth space must be arranged and decorated at the vendor’s expense and must meet The Hidden Gem's standards.

    3. Rental Fees

    • Monthly booth rental is ____, payable on or before the 1st of each month.
    • The first month's booth rent will be prorated based on the number of days remaining in the month at the time of signing, if not paid on signing it must be paid within 48 hours. 
    • A $25 late fee will be charged for payments received after the 5th.
      If rent is not paid within 15 days of the due date, the Agreement may be subject to termination.
    • Booth rental fees are based on booth size and location and may vary accordingly.
    • The Hidden Gem may offer a temporary waiver or reduction in the rental fee during the off-season or due to other operational factors.

    4. Sales & Inventory

    • The Hidden Gem will retain 15% of each sale made from the booth, with 85% paid to the vendor.
    • Vendors are responsible for tagging their own items and entering inventory and pricing into Ricochet prior to bring in items.
    • Upon drop-off, The Hidden Gem will print barcode labels and apply them to the vendor's pre-tagged items.

    5.Payments

    • Store credit is available by the following day after your item sells and can be used anytime in The Hidden Gem. When you use store credit, you'll get 10% off the amount you apply towards your purchase. This discount comes from The Hidden Gem, it's our way of saying thank you, and does not reduce your consignor/vendor payout
    • If you prefer a check, or an electronic bank transfer payout, you're welcome to request one anytime. Once requested, we'll make sure it's sent out on our end by the morning of the following business day. Please allow time for delivery if applicable. 
    • Cash payouts are available for pickup in the shop. We try to keep cash on hand, but for large amounts, a heads-up is appreciated so we can make sure it's available when you stop in.

    6. Use of Booth

    • Booth space may only be used to display and sell merchandise approved by The Hidden Gem.
    • Items deemed unsellable or inappropriate must be removed immediately upon request.
    • Vendors may not sublease booth space 
    • The sale of illegal, counterfeit, or offensive items is prohibited.

    7. Booth Modifications and Maintenance

    • All modifications (e.g., shelving, painting, fixtures) must be approved before installation.
    • Vendors are responsible for maintaining a clean and professional booth space.
    • Vendors are liable for any damages caused to the booth or surrounding area.

    8. Hours of Operation

    • Vendors must follow The Hidden Gem's operating hours for setting up, stocking, or removing items.
    • Booths must remain visually appealing and adequately stocked.

    9. Liability and Insurance

    The Hidden Gem is not responsible for lost, stolen, or damaged items.
    Vendors are encouraged to carry insurance on their merchandise.

    10. Termination

    • This Agreement may be terminated by either party with a 30-day written notice.
    • All booth contents must be removed within 7 days of termination. Items not removed will be considered abandoned and become the property of The Hidden Gem.

    11. Compliance with Laws

    Vendors must comply with all local, state, and federal laws and ordinances regarding the sale of goods.

    12. Governing Law

    This Agreement is governed by the laws of the State of Michigan.

    13. Indemnification

    Vendors agree to indemnify and hold harmless The Hidden Gem from any claims, damages, or liabilities arising from the use or operation of the booth
