RENTAL CONTRACT TERMS AND CONDITIONS

This contract is executed through electronic payment, text message, or website form. Once payment is received, the contract remains in effect until the equipment is returned to Keepin You Movin, LLC.

 1. Due to NON-PAYMENT of Rental Agreements, The Renter has 24 Hours of payment notification from Keepin You Movin, LLC to pay the amount due, IF PAYMENT IS NOT RECEIVED WITH 24 HOURS on Invoice, or pay link, Keepin You Movin, LLC WILL charge daily rates back to the original date of contract. Also, IF Renter does not submit payment or does not make payment within 24 Hours, The Renter forfeits Rental Agreement, with that being said any material in the Dump Trailer will be, the Renter’s responsibility for disposal fees up to $350.00 / or be dumped at location of trailer. If Renter accrues any traffic violations such as parking, or any other related offenses that involve no parking, or any ticket involving the two dump trailers in this said contract. The renter is responsible for immediately contacting Keepin You Movin LLC of the violation(s) within 24 Hours. Failure to contact Keepin You Movin LLC will result in Legal Fees and Court Cost to recover the cost of fines and violations if not paid. It is the renter’s responsibility to make sure the trailers are in safe and secure place.

2. The rental equipment has been received in operational condition and will be returned in the same condition by the scheduled due date and time. Ordinary wear and tear from regular use of the equipment is acceptable. However, any damage caused by misuse or negligence will be the responsibility of the customer. All damage will be paid for based on current repair costs. If the equipment is unable to be repaired, it will be replaced at the replacement cost of such replacement and will be borne by the customer. The customer also agrees to pay a reasonable cleaning charge for items returned dirty. ($40.00 Cleaning Fee)

3. Customer assumes all responsibility for injuries to people or damage to property while the equipment is outside the possession of Keepin You Movin, LLC. The customer agrees to hold Keepin You Movin, LLC harmless and indemnify for any and all claims, regardless of nature, arising out of the rental of the equipment.

4. Customer agrees to lessor’s (Keepin You Movin, LLC) right to enter premises of customer at any time to repossess said equipment. Customer hereby waives any rights of action against owner (Keepin You Movin, LLC by reason of such taking or entry and agrees to reimburse lessor’s cost of repossession if any.

 5. The Customer agrees to pay all collection fees, attorney’s fees, court costs, expenses incurred in the collection of charges and/or property and any other reasonable expenses incurred by the lessor to enforce the terms and conditions of this agreement.

6. Customer agrees not to loan, sublet or otherwise dispose of equipment or use it at any other location than listed on the face of the contract.

7. Customer agrees to pay replacement cost for any loss or disappearance of equipment for any reason including theft, conversion or other dishonest acts on part of any person or person to whom the issued property is entrusted or any person or persons in the service or employment of the lessee whether or not occurring during the hours of such service or employment. Customer will be charged and be responsible for the payment of regular rental fees until such time as the replacement price of the equipment has been paid.

8. However, if any loss or damage due to theft, burglary, misuse or abuse, theft by conversion, intentional damage, mysterious disappearance, damage occurred during any act that is not considered normal use of equipment, any loss due to customer failing to care for the rented item(s) as prudent people would their own property, such as proper lubrication, all loss or damage associated with the equipment’s rollover or upset while in use or being transported. Damage waiver does not cover damage to tents, canopies, and items under tents or canopies damaged during rain, wind, or storms.

9. Customer understands there are no warranties or merchantability or fitness for a particular purpose either express or implied.

10. Scheduled rental rates begin when equipment leaves lessor’s premises and continues until the equipment is returned to the premises. In cases where monthly statements or invoices are not paid by the due date, the lessor may, at its own discretion, revert all charges to the established daily rate. In the event the items are not returned during dealer’s regular business hours, customer agrees to pay for any damage to, or loss of the goods occurring between the time of return and start of KYM, LLC next business day.

11. That customer will immediately discontinue use of the personal property should it at any time, following the execution of this agreement or any subsequent agreement, become unsafe or in a state of disrepair. Furthermore, the renter will immediately notify Keepin You Movin, LLC that the equipment is unsafe and in disrepair and until such time as lessor has regained possession the renter agrees to take all steps reasonably necessary to prevent injuries to any person and all property from the rented equipment or product.

12. Customer is responsible for loading and unloading and installing into and on vehicles. If KYM, LLC assists in loading, unloading, and installing the items, customer agrees to assume the risk of, and to hold Keepin You Movin, LLC harmless for, any property damage or injuries attributable to the negligence of the KYM, LLC.

13. Customer agrees prior to renting to obtain, at customer’s expense, all necessary permits, licenses, and insurance.

14. Severability – The provisions of this rental contract are severable, if one is invalid, unenforceable, or waived the rest will not be effect.

15. INSPECTION OF TRAILER HITCH – Customer agrees to inspect the trailer coupling mechanism and safety chain before leaving Keepin You Movin, LLC premises. Customers also agree to inspect the equipment periodically (everyone hundred miles) and to maintain the coupling, lug nuts, and chain in safe and secure condition.
