Please carefully read the terms below. You must acknowledge and agree to all sections before participating in any activities at Fable Dance Company Pte Ltd (“FABLE”).
CAPACITY AND AUTHORITY
I, the individual listed above, have attained 18 years of age, and am accepting and agreeing to this Waiver and Consent on my own behalf, and/or on the behalf of the above listed participants under the age of 18 ("minors") as, or as duly authorised agent on behalf of, their parent or legal guardian.
In relation to the minors listed (if any) above, I represent that I have full authority as, or on behalf of, the parent or legal guardian of the minors to accept the terms of this Waiver and Consent on their behalf.
ASSUMPTION AND ACKNOWLEDGEMENT OF ALL RISKS
I understand, acknowledge and agree that due to the nature of the dance sport, including pole, aerial, dance and stretch classes, private parties, practices and related activities conducted by FABLE carries inherent dangers and risks, including risk of injury or death. I further agree that participating in any activity organized or conducted by FABLE is purely on my sole volition and risk. I acknowledge that while FABLE’s instructors will exercise reasonable care and provide appropriate safety guidance, they cannot eliminate all risks, and I am ultimately responsible for my own safety and decision to participate. I acknowledge that I am at liberty to at any time to cease or suspend my participation if I am in any way incapacitated, unable to continue or feel that any activity may result in bodily injury to myself or other participants. Should I decide to continue despite such conditions, any encouragement, recommendations or advice given by the instructors of FABLE does not negate the voluntary nature of my decision.
In view of the aforesaid, and by my voluntary participation in the activities of FABLE, I hereby, to the full extent permitted by law, WAIVE ALL LEGAL RIGHTS OF ACTION AGAINST AND FULLY RELEASE FABLE, its directors, instructors, employees, agents, landlords, leases or franchisees (Related Parties) for the loss, damages, or injury howsoever arising out of or in relation to the participation by myself in the activities conducted or organized by FABLE including without limitation, liability for any negligent or tortious act or omission, breach of duty, breach of contract or breach of statutory duty on the part of FABLE and/or Related Parties.
DECLARATION OF GOOD HEALTH
I certify that I and the listed minors are, as at the date of this Waiver and at each visit to the FABLE venue, in good health and physical condition and free from any medical conditions which may affect or preclude any of us from safely participating in any activities.
I acknowledge that I have been advised to consult with my physician with respect to any past or present injury, illness, pregnancy or any other health related condition or any kind whatsoever that may affect my participation and ability to participate in the program. I acknowledge that I have discussed the appropriateness of pole, aerial, chair and other dance programs in connection with any illness or condition that I have or have had with my physician, and that I knowingly execute this release from liability and negligence. Specifically, and without derogation to the foregoing, I acknowledge that FABLE has recommended that pregnant women DO NOT participate in pole and aerial dancing.
PERSONAL PROPERTY
I recognize and accept that I am solely responsible for my personal belongings and property. I waive and release any and all claims against FABLE for property loss or damage to my personal property arising from my participation.
AUTHORISATION TO USE IMAGES AND PERSONAL INFORMATION
I acknowledge that FABLE may operate closed circuit television or cameras on the FABLE Venue and I hereby consent to images and videos being taken for security purposes of me and/or the listed minors. Such images and videos will be the exclusive property of FABLE.
I understand that FABLE may collect, use and/or disclose of any personal information provided by me in accordance with its Privacy Policy (a copy of which I have read), and I hereby consent to such collection, use and disclosure of such personal information by FABLE.
SEVERABILITY
If any provision of these Terms and Conditions is held by any court or other competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected, but shall continue in full force and effect.
ENTIRE AGREEMENT
These Terms and Conditions sets out the entire agreement between myself and FABLE DANCE COMPANY, and any understanding, representation, statement or statement not specifically stated herein is excluded.
