LIABILITY WAIVER: Big Art Studios Miami

RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT

(For Properties in Miami, FL 33137)

This Release of Liability and Indemnification Agreement (“Agreement”) is entered into on {date} by {fullLegal} (“Participant”).

1. Properties Covered
This Agreement applies to activities and presence at the following addresses, all located in Miami, Florida 33137:

101 NE 20th Street
111 NE 20th Street
119 NE 20th Street
127 NE 20th Street
135 NE 20th Street
106 NE 20th Terrace
114 NE 20th Terrace
(Collectively referred to as the “Properties”)

2. Release of Liability
In consideration of being permitted on or around the Properties for any purpose, including but not limited to visitation, events, production, residence, volunteering, or business activities, the Participant does hereby voluntarily assume all risks associated with such access and use and releases and forever discharges the following parties:

More Music Publishing
Boho House
Daniel Lowry
ASAP Films
including their officers, agents, employees, affiliates, successors, and assigns (collectively the “Released Parties”), from any and all claims, demands, damages, actions, or causes of action of any kind, whether in law or equity, arising out of or in connection with the Participant’s presence at or use of the Properties.

3. Indemnification
The Participant further agrees to indemnify and hold harmless the Released Parties from any and all liability, loss, damage, or expense (including attorneys’ fees) arising from or in connection with:

Any injury (including death) to any person, or
Any loss of or damage to property,
whether caused by the negligence of the Participant or otherwise, in connection with their presence at or use of the Properties.

4. Assumption of Risk
The Participant understands that being present at or using the Properties may involve inherent risks including but not limited to physical activity, interaction with equipment, production-related activities, or third-party interactions. The Participant accepts and assumes all such risks voluntarily.

5. Miscellaneous
This Agreement shall be governed by the laws of the State of Florida.
If any portion of this Agreement is held to be invalid, the remaining provisions shall remain in full force and effect.
This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or representations.
