FABT Policies and Covid 19 Waiver 

. INJURIES AND COVID-19 RELEASE

I hereby irrevocably and unconditionally waive any and all claims against the French-American Ballet Theatre (FABT), its directors, officers, employees, agents, and affiliates, arising from or related to any injury, illness, accident, or damages incurred by me or my child during participation in the FABT Summer 2026 programs, including all scheduled and future dates, and while using the FABT Zoom Platform, FABT studios, FABT NYC’s rental studios, or any onsite equipment. I fully acknowledge that such participation is at my own risk, and I further agree not to initiate any legal action, claim, or suit against FABT, its staff, or representatives for any injuries or losses sustained during daily training, rehearsals, or related activities at FABT. This waiver extends to any events or occurrences arising from or related to the COVID-19 pandemic or its variants, and I understand that FABT will not be held liable for any illnesses or risks associated with COVID-19. By attending or participating in FABT's programs, I do so with full knowledge and acceptance of these risks and expressly agree to hold FABT harmless from any and all liability, claims, demands, or causes of action, whether known or unknown, arising out of or related to such participation.

 TERMS AND CONDITIONS

I hereby agree that I will not hold French American Ballet Theatre (FABT), its director, faculty members, employees, or volunteers liable for any injury or illness, or for the loss or destruction of any personal property that may occur during, or as a result of, my enrolment and/or participation in an official FABT course, workshop, class, or audition. Additionally, I agree to indemnify and defend FABT, along with their owners and officers, against any claims or demands made against them that arise from my conduct. Furthermore, I accept financial responsibility for any acts of vandalism or property destruction instigated or caused by me.

These conditions apply to the premises of the venue where the FABT session is held, FABT studios, any chaperone home, any performance theater or hall, any premises, and any vehicle used to transport me in conjunction with FABT. I hereby fully and forever release and discharge FABT Artistic Director and staff from all claims, demands, damages, rights of action, or causes of action, whether known or unknown, anticipated or unanticipated, resulting from or arising out of my use of said FABT premises, facilities, online programs, and equipment.

FABT reserves the right to take videos and pictures of all its students and clients (Year-round, seasonal, "Drop-in", Workshops, Special classes, Summer, Gift Card classes, competitors) at any time for educational and advertising purposes. By signing this release, I grant permission to FABT the rights to my image and/or my child's image in video or still form, and the likeness and sound of my voice and/or my child's voice as recorded on audio or video tape without payment or any other consideration. I understand that all images may be edited, copied, exhibited, published, or distributed, and I waive the right to inspect or approve the finished product wherein my likeness appears.

Additionally, I waive any right to royalties or other compensation arising from or related to the use of my image and/or my child's image or recording. I also understand that this material may be used in diverse settings within an unrestricted geographic area. Photographic, audio, or video recordings may be used for various purposes, including but not limited to:

·        Presentations

·        Social Media/Media

·        News/Marketing (Press)

·        Courses

·        Websites

·        Online/Internet Videos

By signing this release, I understand this permission signifies that photographic or video recordings of myself and/or my child may be electronically displayed via the Internet, press, social media, or in public educational and non-educational settings. There is no time limit on the validity of this release, nor is there any geographic limitation on where these materials may be distributed. This release applies to photographic, audio, or video recordings collected as part of all sessions I and/or my child attended, currently attend, and will attend. Clients who do not wish to be photographed and/or filmed must provide written notice to FABT. All material used prior to receiving such notice may be used by FABT without any possible dispute.

I understand and accept FABT's terms, conditions, policies, and waivers stated above. I acknowledge that a copy of this acknowledgment form will be held in my personal record as evidence of my receipt and knowledge of FABT policies.

By executing this agreement, in my capacity as Legal Guardian, expressly acknowledge and affirm my full and complete understanding of, and unconditional acceptance of, all terms and conditions set forth herein. Furthermore, by affixing my signature, I irrevocably agree to be bound by and liable for all obligations and responsibilities described herein, including, without limitation, the payment of training fees, damage assessments, repair costs, and any forfeiture of deposits as applicable.
