· LIABIITY RELEASE WAIVER
I ACKNOWLEDGE THAT BY SIGNING THIS DOCUMENT I AM AGREEING TO RELEASE THE HOST FROM LIABIITY.
I HAVE THEREFORE BEEN ADVISED TO READ THIS DOCUMENT CAREFULLY BEFORE SIGNING IT.
This Participation Agreement and Waiver and Release of Liability is entered into by the undersigned "Participant" in favor of K-9 Specialized Training and Consulting LLC (K-9STAC), International Dog Sports, partners, sponsors, vendors, directors, officers, employees, volunteers, members, agents, contractors, contracted entities and facilities and the owners and lessors thereof, (hereinafter referred to collectively as the "Host").
I understand that participation in the HOST's activities is a privilege but not a right. In consideration for the privilege of participation in such activities, I acknowledge and agree as follows:
1. Participation in the activities of the Host, including but not limited to warm-up, training, practice, games, and clinics, requires good health and fitness. I believe I am qualified to participate in the Activities, and if at any time I believe the conditions to be unsafe, I will immediately discontinue further participation in the Activities. I believe my dog(s) are qualified to participate in the Activities, and if at any time I believe the conditions to be unsafe, I will immediately discontinue further participation in the Activities.
2. By entering the competition, all entrants grant an irrevocable, unconditional, perpetual, worldwide, non-exclusive license to HOST and or Sponsor and its respective licensees to reproduce, store, copy, transmit, publish, post, broadcast, distribute, display and create derivative works of and/or otherwise use (without limitation as to the number of times used) each element of an entrants’ entry (including, but not limited to , the photos submitted) in connection with the Competition, the promotion of the Competition, and in any other manner at the discretion of the Sponsor in any media now and hereafter known. Entrant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude Sponsors’ use of any entry (including but not limited to, the photos submitted) on Sponsor’s website does not indicate the entrant will be selected as a winner. Sponsor will not require to pay and consideration or seek any additional approval in connection with use of an entry.
3. Assumption of the Risks. I CONSENT TO MYSELF, AND MY DOG(S) PARTICIPATION IN THE ACTIVITIES AND FULLY ACCEPT AND ASSUME ALL SUCH RISKS OF INJURY AND ALL RESPONSIBILITY FOR LOSSES, COSTS, EXPENSES, AND DAMAGES incurred as a result of such participation.
4. Waiver and Release of Liability. By participating in the Competition, entrants agree to release, Indemnify and hold harmless the HOST and or Sponsor, and each of their respective officers, directors, employees, representatives, and agents from any claims or cause of action arising out of participation in the competition or receipt or use of the prize.
5. Governing Law, Venue and Jurisdiction: Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of or connected with, the competition or any prize awarded shall be resolved under the laws of the state of California, or South Dakota.
6. Severability: If any provision of this document is determined to be invalid for any reason, such invalidity shall not affect the validity of any of the other provisions, which other provisions shall remain in full force and effect as if this document had been executed with the invalid provision eliminated.
ASSUMPTION OF COVID-19 RISK: I hereby choose to accept the risk of contracting COVID-19 for myself and/or for my children in order to utilize the service of K-9 STAC. These services are of such value to me that I voluntarily accept the risk of being exposed to, contracting, and/or spreading CoVID-19 in order to utilize such services and premises. If I feel unwell I will pull myself from the activities. WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suite against K-9 Specialized Training and Consulting LLC (K-9 STAC) and their owners, officers, directors, managers, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing said entities’ services and premises.
CANINE FLU ACKNOWLEDGEMENT
The Canine Influenza Virus (CIV) is a highly contagious infection to dogs caused by a novel influenza classified at H3N8, a subtype virus first discovered in 2004. This respiratory disease has affected thousands of dogs in the United States. Because CIV is a relatively new virus, most dogs have not been exposed to it before. Dogs of any age, breed and vaccine status are susceptible to this infection. The virus spreads readily and all dogs, regardless of breed or age, are susceptible to infection. Although most dogs get a milder form of influenza, some develop severe pneumonia.
Although the Host has not had any reported cases of the canine flu, we want to be proactive in protecting all our clients and event participants pets and keep our facility “flu free”. Therefore, we strongly recommend dogs be immunized prior to any event participation.
7. I have read the above information about the canine flu and understand the risks involved in not getting my dog vaccinated.
8. I will not hold anyone but myself liable should my dog(s) be subjected to the canine flu virus.
I HEREBY CERTIFY THAT I HAVE COMPLETELY READ AND UNDERSTAND THIS AGREEMENT AND ITS TERMS. I HAVE READ THIS ACKNOWLEDGMENT AND FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT. PRIOR TO SIGNING THIS AGREEMENT, I HAVE HAD THE OPPORTUNITY TO ASK ANY QUESTIONS ABOUT THIS AGREEMENT. I AM AWARE, BY SIGNING THIS AGREEMENT, THAT I ASSUME ALL RISKS AND WAIVE AND RELEASE CERTAIN RIGHTS THAT I AND EACH OF MY HEIRS, NEXT OF KIN, FAMILY, RELATIVES, GUARDIANS, CONSERVATORS, EXECUTORS, ADMINISTRATORS, TRUSTEES AND ASSIGNS MAY HAVE AGAINST RELEASED PARTIES. THIS RELEASE SHALL BE EFFECTIVE AND BINDING UPON ME. IN CONSIDERATION FOR THE PRIVILEGE OF PARTICIPATION IN THE HOST ACTIVITIES.
