CONTRACT, TERMS AND CONDITIONS FOR AQUA ADVENTURE RENTALS LLC
By completing a reservation and/or operating any rented equipment from Aqua Adventure Rentals LLC, the renter acknowledges and agrees to the following Terms and Conditions. RENTAL REQUIREMENTS To schedule and complete a reservation, renters must provide: A valid driver’s license A major credit card matching the name on the driver’s license Be at least 21 years of age to rent equipment Additionally, any person born on or after September 1, 1993, must possess a valid Texas Boater Education Certificate in accordance with Texas law. For more information, visit www.tpwd.texas.gov. The qualified renter must be present at check-in and complete all required rental agreements and waivers before operating any equipment. OPERATOR REQUIREMENTS Operators must be at least 18 years of age to operate a jet ski. Only authorized operators who have signed all required waivers may operate the equipment. Operating equipment under the influence of alcohol or drugs is strictly prohibited. Aqua Adventure Rentals LLC reserves the right to refuse service to anyone suspected of being under the influence of drugs or alcohol. EQUIPMENT DAMAGE & RESPONSIBILITY A refundable damage deposit of $250.00 will be collected for each rented watercraft. The renter is fully responsible for the jet ski and all equipment/accessories during the rental period, including but not limited to: Life jackets Safety equipment Tubes Keys and lanyards If any damage occurs, Aqua Adventure Rentals LLC will inspect the equipment and determine responsibility and repair costs. If damages exceed the $250.00 deposit amount, the renter agrees to pay all additional repair or replacement costs, including: Mechanical repairs Lost or stolen equipment Retrieval costs Loss of rental income due to downtime An itemized invoice will be provided and must be paid in full by the renter. The damage deposit does not accrue interest. SHALLOW WATER / ROCK DAMAGE Operating the jet ski in water less than 3 feet deep may cause severe damage to the propulsion system. Any damage caused by operating in shallow water, rocky areas, or debris-filled areas will result in additional repair fees and may terminate the rental without refund. JET SKI USE POLICY Renters agree NOT to: Use the equipment for hire or commercial purposes Exceed the maximum weight capacity Operate recklessly or beyond their ability Tow unauthorized objects or persons Jump wakes intentionally Operate in weeded or debris-filled areas Jet skis allow: Minimum riders: 1 person Maximum riders: 3 people Maximum weight capacity: 524 lbs total Jet skis may reach speeds of approximately 50–65 MPH depending on water conditions, weather, and passenger weight. FUEL POLICY Jet skis are provided with a full tank of fuel. Full-day rentals must be returned with a full tank. A refueling fee will apply if returned without a full tank. If additional fuel is needed during the rental, the renter is responsible for refueling costs. PREMIUM fuel only (91 octane or higher) must be used. All jet skis utilize 4-stroke engines. No oil and gas mixing is required. RENTAL PERIOD & RETURN POLICY A full-day rental is considered up to 8 hours. Standard operating hours: Start Time: 10:00 AM Return Time: 7:00 PM Rentals launched after 11:00 AM are still required to be returned no later than 7:00 PM. Late returns will result in additional rental charges. Equipment must be returned to the agreed location in the same condition received. REPAIRS & SERVICE CALLS Aqua Adventure Rentals LLC will make every reasonable effort to address mechanical failures promptly. However, if a service call or repair is determined to result from negligence, misuse, operator error, shallow water operation, or failure to follow safety instructions, associated costs may be deducted from the renter’s security deposit or billed separately. LOSS OF PERSONAL PROPERTY Aqua Adventure Rentals LLC is not responsible for lost, stolen, or damaged personal property left in or on the equipment during or after the rental period. BILLING AUTHORIZATION All rental charges and deposits will appear on billing statements as: “Aqua Adventure Rentals LLC” Charges are processed immediately upon booking confirmation. MEDICAL INSURANCE & LIABILITY Aqua Adventure Rentals LLC does not provide medical or liability insurance coverage for renters, passengers, operators, or third parties. Renters are solely responsible for obtaining any desired insurance coverage, including: Medical coverage Liability coverage Property damage coverage The renter assumes full responsibility for injuries or damages caused to themselves, passengers, third parties, or property during the rental period. ASSUMPTION OF RISK The renter and all participants acknowledge that operating personal watercraft involves inherent risks, including serious bodily injury, permanent disability, or death. By participating, the renter voluntarily assumes all risks associated with the use and operation of the equipment, whether caused by negligence or otherwise. THEFT, LOSS, INJURY OR DEATH In the event of theft, loss, abuse, or destruction of equipment, the renter agrees to pay the full replacement value of the equipment and accessories. Aqua Adventure Rentals LLC is not responsible for injury, death, accidents, or damages occurring during the rental period. CANCELLATION POLICY Reservations canceled more than 48 hours before the scheduled reservation time will receive a refund subject to a 10% processing fee. Reservations canceled within 24 hours of the scheduled reservation time will receive a 50% refund subject to a 10% processing fee. No-shows or cancellations made after the scheduled reservation start time are non-refundable and full rental charges will apply. If Aqua Adventure Rentals LLC determines that weather or lake conditions are unsafe before the rental begins, a refund will be issued. If renters are uncomfortable with forecasted weather conditions, they are encouraged to cancel at least 48 hours in advance. For cancellation inquiries, contact: (405) 977-8027 SAFETY RULES WEAR LIFE VESTS AT ALL TIMES ALWAYS WEAR THE LANYARD ATTACHED TO THE KILL SWITCH DO NOT OPERATE IN LESS THAN 2 FEET OF WATER IF BEACHING, SHUT OFF ENGINE AND PULL TO SHORE OR ANCHOR IN SHALLOW WATER BEFORE STARTING, ENSURE WATER DEPTH IS 2 FEET OR GREATER REMEMBER: YOU NEED THROTTLE TO STEER STAY AT LEAST 100 FEET AWAY FROM OTHER BOATS BE RESPECTFUL OF OTHER BOATERS AND FISHERMEN DO NOT OPERATE UNDER THE INFLUENCE OF DRUGS OR ALCOHOL DO NOT OPERATE IN WEED-FILLED AREAS DO NOT JUMP BOAT WAKES PAY ATTENTION TO WEATHER CONDITIONS STAY ALERT AND AWARE OF SURROUNDINGS DO NOT OPERATE BEYOND YOUR SKILL LEVEL IN CASE OF EMERGENCY, CALL 911 FIRST REPORT ALL ACCIDENTS, INJURIES, OR DAMAGES TO LOCAL AUTHORITIES Failure to follow safety rules may result in termination of the rental without refund and additional liability for damages.
