CONTRACT, TERMS AND CONDITIONS FOR AQUA ADVENTURE RENTALS LLC
1) Equipment damage: a damage deposit of $250.00 will be collected for each rented watercraft, in the event of any damage during the rental period, the deposit will be utilized to cover the repair costs, if the repair costs exceed the damage deposit, the user is held fully responsible for the remaining expenses to restore the watercraft to its original condition at the start of the rental agreement, additionally, the user is responsible for the retrieval or replacement of any lost, stolen, or misplaced watercraft, life jackets, tub or safety items during the rental period, any damages exceeding the $250.00 deposit will result in the user receiving an itemized repair bill, inclusive of any lost rental time, this bill must be settled in full by the user. Please note that the damage deposit does not accrue interest, and the is accountable for damages surpassing the $250.00 deposit. 2) ROCKS: operating the motor in water less than 3 feet deep and subsequently causing damage will result in additional fees and potentially curtail the rental period without a refund. 3) JET-SKI OPERATION: Renters must ensure that only qualified operators who have signed a waiver utilize the equipment. Operating equipment under the influence of alcohol or drugs is strictly prohibited, and renters are responsible for complying with all relevant laws. 4) JET-SKI USE: Renters agree not to use jet-ski for hire, exceed the maximum specified weight capacity, or transport person or property for hire. 5) REPAIRS-SERVICE CALLS: Owners will make every effort to promptly address mechanical failures. However, repair call costs may be deducted from the renter's security deposit if the issue is found to be due to neglect or misuse. 6) LOSS OF RENTERS(S) PROPERTY: Owners are not liable for any loss or damages to property left in or on the equipment after its return. 7) RETURN OF EQUIPMENT: Renters are required to return the equipment to the agreed location at the specified time. Failure to do so will result in additional rental fees. 8) BILLING: Any transactions related to rental will be displayed on bank statements as "Aqua Adventure Rentals LLC" and charges will be processed immediately upon booking. 9) MEDICAL INSURANCE: AQUA ADVENTURE RENTALS LLC is not responsible for the damages occurred or prejudices for the crew of the (jet ski, boat and tube). Will not be responsible at third party crew or vise versa, the renter must have prevention coverage for crew and damages to third party. 10) THEFT, LOSS, INJURY OR DEATH: in cases of theft or loss, the renter(s) are liable for the replacement value of the equipment, any abuse or damage will incur charges for repair or replacement. ASSUME THE RISK OF BODILY INJURY, DEATH, OR PERMANENT DAMAGE, whether due to the negligence of Releasees negligence, my negligence, or any other reason or factor, while upon the premises, while operating a jet ski rented from or owned by Aqua Adventures Rentals, LLC. AQUA ADVENTURE RENTALS LLC does not provide insurance coverage for equipment damage during the rental period, renters are advised to check their homeowner, auto, or credit card policies for potential endorsements. Cancellation Policy: -Host-initiated cancellations before the rental begins due to severe weather will receive a full refund. -Cancellations during the rental period will receive a prorated refund. -A 48-hour notice of cancellation is required for a full refund, failing which is a 50% charge applies. -No shows and cancellations made.afterthe start tirmewill incur charges of-100%. Additionally, specific requirements for the operation of jet skis, including age restrictions, waiver signatories, and compliance with Texas boating laws, are outlined. For further, inquiries regarding cancellations, please contact us at (405) 977-8027. TERMS AND CONDITIONS Must be 21 years of age or older to rent any of our equipment. Must have a valid drivers license. Qualified renter must be present to complete the rental contract. Intoxicants are strictly prohibited. Service will be refused to anyone under the influence of drugs and/or alcohol. SAFETY RULES WEAR LIFE VEST AT ALL TIMES ALWAYS WEAR THE BRACELET ATTACHED TO KILL SWITCH ALWAYS REMOVE THE KEY AND PLACE IN SAFE BOX AFTER TURNING ENGINE ON DO NOT OPERATE THE JET SKI/JET BOAT IN LESS THAN 2 FT OF WATER. IF BEACHING, SHUT ENGINE OFF AND PULL IT TO SHORE, OR ANCHOR IN SHALLOW WATER. BEFORE STARTING TO LEAVE, PUSH VESSEL TO 2 OR MORE FEET OF WATER. M DEBRIS NEAR BOAT BEFORE STARTING. REMEMBER, YOU NEED THROTTLE TO STEER! STAY AT LEAST 100FT APART FROM ALL OTHER BOATS AND EACH OTHER. BE RESPECTFULL OF OTHER BOATERS. GIVE THEM PLENTY OF DISTANCE. ESPECIALLY FISHERMAN!!! DO NOT OPERATE EQUIPMENT UNDER INFLUENCE OF DRUGS OR ALCOHOL. DO NOT GO IN WEEDED AREAS. DO NOT JUMP BOAT WAKE. PAY ATTENTION TO THE WEATHER ALWAYS WEAR THE LANYARD ATTACHED TO KILL SWITCH. STAY ALERT- ALWAYS BE WATCHING YOUR SURROUNDINGS. DO NOT OPERATE EQUIPMENT BEYOND YOUR ABILITY IN CASE OF ANY EMERGENCY, CONTACT 911. BEFORE CONTACTING AQUA ADVENTURE RENTALS. REPORT ALL INJURIES OR DAMAGES TO SHERIFF'S OFFICE. ***Rentals launched after 11 AM are still required to be returned no later than 7 PM.***
