Local Hearts Foundation Volunteer Agreement & Release of Liability

Thank you for offering your time and support to Local Hearts Foundation. As a volunteer, we ask you to read and agree to the terms below, which are required by California law to ensure transparency and mutual protection.

1. Volunteer Status

I understand and agree that:

I am offering my services voluntarily without expectation of compensation, employment, or benefits.
I am not an employee of Local Hearts Foundation.
This agreement does not create any employer-employee or contractor relationship.
I may be released from volunteering at any time, with or without cause.

2. Assumption of Risk

I understand that volunteering may involve physical activity, interacting with the public, working outdoors, lifting supplies, and other potential risks.
I freely and knowingly assume all risks associated with my participation, including illness, injury, or loss.

3. Waiver and Release of Liability

I agree to release, waive, and hold harmless Local Hearts Foundation, its directors, officers, employees, agents, and other volunteers from all liability, claims, or demands for damages, injuries, or losses to myself or my property that may arise during or as a result of my volunteer activities.

4. California Civil Code §1542 Waiver

I expressly waive any rights under California Civil Code Section 1542, which states:

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in their favor at the time of executing the release, and that if known by them would have materially affected their settlement with the released party.” I understand this means I am waiving unknown claims that may arise in connection with my volunteer service.

5. Confidentiality

I agree not to disclose any private or sensitive information I may learn about individuals served by the Foundation or internal operations during my volunteer service.

6. Media Consent
I consent to the use of my name, photo, or video image by Local Hearts Foundation for promotional purposes.
