I/We hereby understand and acknowledge that the training, programs and events held by Wollongong Mustangs Gridiron may expose me to many inherent risks, including accidents, injury, illness, or even death.
I/We assume all risks of injuries associated with participation including, but not limited to, falls, contact with other participants, the effects of the weather, including high heat and/or humidity, and all other such risks are known and appreciated by me.I/We hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity.
I/We acknowledge that I am physically fit and mentally capable of participating in the physical activity I choose to engage in. After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and Wollongong Mustangs Gridiron furnishing services to me, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVE AND RELEASE Wollongong Mustangs Gridiron, its officers, agents, employees, organisers, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in Wollongong Mustangs Gridiron training, programs and/or events.
FOR ANYONE UNDER THE AGE OF 18
PARENT/GUARDIAN AND CHILD on behalf of their heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releases from any liabilities incident to the Child’s involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law. Parents/Guardians and Child promise not to sue Gridiron nor its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct events; and
The Parent/Guardian asserts that I have explained to my Child the risks of the activity and his/her responsibilities for adhering to the rules and regulations and that my Child understands this agreement.
EQUIPMENT LIABILITY DISCLAIMER
1. The Equipment has been received by the Renter in good condition. It will be returned in comparable condition, accounting for reasonable levels of wear and tear that are to be expected with usage.
2. The Renter assumes all responsibility for any damage to the Equipment or any injury to persons as a result of using the Equipment during the rental period.
3. The Renter hereby agrees to pay any replacement or repair costs, including labour, incurred through damages to the Equipment during the rental period.
PHOTOGRAPHY/SOCIAL MEDIA:
PARENT/GUARDIAN, CHILD & ATHLETE will allow Wollongong Mustangs the exclusive right to utilise content such as photos, videos, interviews, sound recordings, etc, for pre-, post-, during, and future purposes. Including but not limited to: name, image, and likeness of athletes, coaches, and spectators.
By my signature, I/We acknowledge that I/We have read, understood, and agree to be bound by this Waiver of Liability. I am aware that this is a waiver and a release of liability and I voluntarily agree to its terms.
