I am a guest of HH Wellness Dispensary LLC, a North Carolina limited liability company doing business as Hemp Haven Wellness Dispensary (“Hemp Haven”), and its affiliates, parent companies, subsidiaries, present and former employees, owners, officers, members, managers, and partners (collectively, the “Released Parties”), and I acknowledge that I must follow certain rules and regulations and waive certain rights as a condition for admission into Hemp Haven establishments as provided in this Release of Liability Waiver (“Agreement”).
I acknowledge that Hemp Haven has the right to remove me from its premises for violating this Agreement. Furthermore, Hemp Haven may seek my immediate removal where my actions present a safety risk to employees or other guests.
Entirety of Agreement
This Agreement expresses the terms and conditions of my entrance to Hemp Haven in its entirety, and amendments to this Agreement shall be void unless in writing and signed by both Parties.
Severability
If any part of this Agreement is found to be unenforceable, such unenforceability shall not affect the enforceability of the remainder of this Agreement.
Medical Disclosure
I am in reasonable health and not otherwise limited by either minor or serious mental or physical injury, disability, or illness that could potentially render me particularly susceptible to sickness, injury, or disability. I am aware of the risks involved in consuming cannabis-infused/hemp-derived products. I fully understand and accept every one of the risks associated with cannabis sickness, unanticipated allergic reactions, injuries, or over consumption.
Assumption of Risk
My presence in a Hemp Haven store and consumption of its cannabis-infused/hemp-derived products are at my own risk. Accordingly, I agree to hold harmless Hemp Haven on behalf of myself, my heirs, and my personal representatives, to fully discharge and release Hemp Haven and the Released Parties, from all claims, actions, damages, liabilities, losses, costs, and expenses in any way arising out of, or resulting from, my presence in a Hemp Have store and consumption of cannabis-infused/hemp-derived products, including without limitation, all claims, actions, and liabilities for death, injury, loss or damage to me or anyone else, or to any negligence or willful conduct of Hemp Haven or any of the Released Parties.
Acknowledgement and Waiver of Liability
I acknowledge Hemp Haven is not responsible for any side effects from smoke inhalation, vapor inhalation, or consumption of cannabis-infused products, such as bodily injury, nausea, vomiting, or fainting. Furthermore, I acknowledge that Hemp Haven is not responsible for any interaction that may take place with law enforcement or employer after the consumption of Hemp Haven products. This includes but is not limited to motor vehicle accidents or the inability to pass a drug test. I agree to waive on behalf of myself, my heirs, and my personal representatives, to fully discharge and release Hemp Haven and the Released Parties from any and all claims involving my use of cannabis-infused/hemp-derived products purchased from Hemp Haven.
Indemnification
I agree to indemnify and hold harmless Hemp Haven and Released Parties from any third-party losses, damages, actions, suits, claims, judgments, settlements, awards, interest, penalties, expenses (including Attorney’s fees) and costs of any kind for any loss or damage arising out of my activity as a customer of Hemp Haven.
Choice of Law
This Agreement is entered into in Currituck County, North Carolina and any dispute arising out of this Agreement may only be brought in a court of competent jurisdiction in Currituck County, North Carolina. North Carolina law governs this Agreement.
Medical Treatment Release
In the unlikely event that I require medical attention, I give Hemp Haven and its staff permission to call for emergency medical services, and I consent to any medical treatment that may be given to me should Hemp Haven determine that I require medical assistance. I accept full responsibility for costs related to my medical treatment, including any transport costs, and I release Hemp Haven from any type of liability for anything that may happen during my treatment or transport.
Possession and Distribution of Cannabis
Hemp Haven requires guests to refrain from distribution of unlicensed cannabis products, as all non-medical cannabis consumed on-site must be purchased from the dispensary, and no open containers of cannabis can be removed from the premises.
Safety Requirements
As in bar services, operators at Hemp Haven are required to monitor guests, and anyone showing signs of intoxication cannot be served. If you are found to be intoxicated, you will be encouraged to use a rideshare service or public transportation or ride with sober drivers. A designated driver is always recommended and all self-identified designated drivers will receive complimentary non-intoxicating beverages of their choice (soda, water) while they are guests of the cabana. We demand optimum safety for you and others above all, including driving to and from our cabana.
Acknowledgement of Full Understanding
I acknowledge that I have read this Agreement and accept it in its entirety. I acknowledge and agree that I have fully read, understood, and voluntarily enter into this Agreement. No oral agreements have been made regarding this Agreement.
Signature
Without an electronically-signed copy of this Agreement, I may not be on the premises. My e-signature below represents my understanding of and acceptance of this Agreement. My signature is an Agreement to release Hemp Haven and the Released Parties from any and all claims that can be released as a matter of law. A copy of this Agreement is provided to me via email.
