Terms and Conditions
By submitting this application to participate in the Festival International de Musique Saint-Georges Chorus (the “Festival Chorus”), you (the “Applicant”) agree to the following terms and conditions:
1. Non-Employment Status
Submission of this application does not constitute an offer of employment, engagement, or contract for services by the Festival International de Musique Saint-Georges (the “FESTIVAL”), ArtistWorld, or any of their affiliated entities. Acceptance into the Festival Chorus is solely a participation opportunity and does not imply employment, compensation, or any entitlement to benefits.
2. Force Majeure and Cancellation
The FESTIVAL reserves the right to cancel or modify the Festival Chorus program or the FESTIVAL itself at any time due to force majeure or other unforeseen circumstances, including but not limited to natural disasters, public health emergencies, political unrest, travel restrictions, or funding shortfalls. In such cases, the FESTIVAL shall not be liable for any loss or expense incurred by the Applicant, including but not limited to travel, accommodation, insurance, or visa costs.
3. Application and Audition Fee
A non-refundable audition fee of €25 must be submitted along with this application. The application will not be processed without receipt of payment. This fee is non-refundable under any circumstance, including but not limited to withdrawal, non-acceptance, or cancellation of the FESTIVAL.
4. Program and Repertoire Changes
All repertoire, programming, schedules, and personnel related to the Festival Chorus and the FESTIVAL are subject to change at the sole discretion of the FESTIVAL. Participation does not entitle the Applicant to approval or notice of such changes.
5. Travel and Logistics
ARTISTS residing in Guadeloupe are responsible for arranging their own daily transportation to and from all scheduled FESTIVAL Chorus activities. They are expected to arrive on time and fully prepared for all rehearsals, performances, masterclasses, workshops, and any additional official FESTIVAL engagements to which they are assigned.
Failure to attend scheduled activities, or repeated lateness, may result in removal from the program, at the sole discretion of the FESTIVAL. Local ARTISTS are held to the same professional standards of conduct and participation as international ARTISTS, as outlined in this agreement and the Musician’s Handbook.
6. Audio-Visual Recording Consent
By participating in the FESTIVAL, the Applicant grants the FESTIVAL and its affiliates the irrevocable right to record, photograph, livestream, or otherwise capture their likeness, voice, image, and performance. Such recordings may be used, published, reproduced, and distributed in any media or format worldwide and in perpetuity for promotional, archival, educational, or commercial purposes without further compensation.
The Applicant acknowledges that a documentary film is being produced in connection with the 2025 FESTIVAL, focusing on the life and legacy of Joseph Bologne. As part of the documentary project, the film crew may capture behind-the-scenes footage, rehearsals, and performances at the FESTIVAL as an example of Bologne’s modern-day impact. As a participant in the FESTIVAL, the ARTIST may be invited to participate in a filmed interview. Participation in interviews is strictly voluntary and at the discretion of the ARTIST. No compensation will be provided for participating in interviews or for any use of the ARTIST’s image, likeness, voice, or performance captured during the FESTIVAL and used in the documentary.
By signing this AGREEMENT, the ARTIST grants the FESTIVAL, ArtistWorld, and the producers of the documentary an irrevocable, worldwide, perpetual, royalty-free right to record, reproduce, display, distribute, edit, and otherwise use the ARTIST’s appearance, performance and participation, in whole or in part, in connection with the documentary and any promotional or derivative works. The ARTIST waives any right to inspect or approve the final version of the documentary and releases the FESTIVAL and ArtistWorld from any liability in connection with such use.
The ARTIST further agrees that participation in the documentary does not constitute a joint venture, employment, or any contractual relationship with the producers and waives any claims to royalties, residuals, or any other compensation now or in the future related to the documentary’s distribution or public display.
7. Conduct Expectations
All participants are expected to behave professionally, respectfully, and in accordance with FESTIVAL policies. The FESTIVAL reserves the right to remove any participant from the program for conduct deemed inappropriate, disruptive, or in violation of local laws or FESTIVAL guidelines. No refunds or reimbursements will be provided in such cases.
8. Voluntary Participation and Assumption of Risk
Participation in the Festival Chorus is voluntary and may involve physical exertion and travel-related risk. The Applicant assumes all responsibility for their health, safety, and well-being during participation in the FESTIVAL. The FESTIVAL disclaims any liability for injury, illness, theft, loss, or damage sustained by the Applicant during their participation.
9. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the State of New York, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New York State, unless otherwise required by applicable French or EU law.
