In consideration of participating in Airsoft Games and Events hosted by Death Valley Airsoft Field, I the undersigned declare that I understand the nature of this activity and that I am qualified, in good health, and in proper physical condition to participate in such activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the activity and inform Death Valley Airsoft Field of my concern. I fully understand that this activity involves risks of serious bodily injury, including permanent disability, paralysis and even death, which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the “Releasees” named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost and damages I incur as a result of my participation in the activity. I hereby release, discharge, and undertake not to hold liable Death Valley Airsoft Field, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, and sponsors, advertisers, and, if applicable, owners and lessors of premises on which the activity takes place, (each considered one of the “Releasees” herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the releasees or otherwise, including negligent rescue operations and further agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the releasees, I will indemnify, save, and hold harmless each of the releasees from any loss, liability, damage, or cost, which any may incur as the result of such claim. I undertake and declare that I hereby bind myself fully to the attached rules, safety and operating procedures as laid down by Death Valley Airsoft Field and its representatives from time to time and agree to always abide with such rules, safety, and operating procedures. I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement of assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.

AIRSOFT EQUIPMENT RENTAL AGREEMENT

Dear Player, Kindly review the information provided and agree below. If you are under 18 years old, a parent or guardian must fill out this form and will be responsible for the rental. Before agreeing below, please note: I hereby agree to rent and operate the above-mentioned equipment in a safe and responsible manner. I understand that an airsoft gun is not a toy and should be treated accordingly. I agree not to use the gun against any animals or property. I agree to operate this equipment within designated airsoft fields only, allowing for safe play. I acknowledge that I am personally responsible for any legal actions taken against me if I violate safe playing practices, local laws, or cause personal injury to others. I agree to return the equipment in good working condition to the same location I picked it up or received it from. I agree to forfeit my deposit and/or pay any additional balance due to cover the full replacement cost for any lost, stolen, or damaged items while in my possession. Any damage or loss of equipment will be charged to the credit card used for this transaction and calculated at retail prices. Minor dirt and scratches are to be expected. Rental equipment replacement costs in case of damage, theft, or loss: Gun: R3250.00, Magazine: R600.00, Mask: R350.00 Battery: R550.00. Failure to return any equipment issued to me on the day of rental will be regarded as theft and will be reported to the police. I agree to check all equipment issued to me before use and will not use the equipment if any parts are damaged or missing.
