DISCOUNT LEGENDS AFFILIATE AGREEMENT

This Affiliate Agreement ("Agreement") is made between Discount Legends ("Company," "we," "us," or "our") and the individual or entity ("Affiliate," "you," or "your") who agrees to participate in the Discount Legends Affiliate Program ("Program"). By signing this Agreement and enrolling in the Program, you agree to be bound by the terms and conditions set forth in this Agreement.

1. PROGRAM DESCRIPTION

Discount Legends is a subscription-based platform offering members discounts from several retailers. Members pay a monthly subscription fee for access to these discounts.

As an Affiliate, you will promote Discount Legends and earn commissions for each active subscriber you refer. The subscriber must be a paying subscriber for you to receive a commission (you will not receive a commission for a subscriber's free trial period). 

Customers can only purchase subscriptions through Affiliate Links. You will receive a commission when someone purchases a subscription using your Affiliate Link and will continue receiving a commission every month the subscription remains active. 

You cannot purchase a subscription using your own Affiliate Link. If you do, your subscription will be cancelled and you will not be given access to the Members Area. You may also be terminated from the Affiliate Program.

2. COMMISSIONS & PAYMENT STRUCTURE

A. Standard Commission Rate 

• $5/month per active subscriber for as long as the subscription remains active.

B. Customer Appreciation Bonus Rate

If you are also an active Discount Legends subscriber, you qualify for an increased commission rate:

• $15/month per active subscriber for as long as the subscription remains active.
• You will receive the Customer Appreciation Bonus during your free trial as well. 
• If your subscription lapses or becomes inactive, your commission rate reverts to the Standard Commission Rate for all of your active subscribers.
• To recieve the Customer Appreciation Bonus, enter your 4-digit customer order number into this Affiliate Sign-Up Form during sign up. Your customer order number can be found in the reciept that is emailed to you when you start your free 7-day trial. 

C. Bonuses

1.      Century Mark Bonuses:

• $1000 for every 100 active subscribers (e.g., $1,000 at 100, another $1,000 at 200, etc.). These are one-time payments.

2.      Partner Bonus:

• Once you reach 1,000 active subscribers, you will receive the Partner Bonus Commission rate of $17/month per active subscriber for each additional active subscriber beyond 1000 active subscribers (e.g., at 1,150 active subscribers, you will earn $17/month for each of the 150 active subscribers above 1,000 active subscribers).

D. Payment Schedule & Payment Methods

• Payments to Affiliates are sent out twice per month: The 10th and 25th via 1 of 3 payment methods below.
• Payment methods:  

1. ACH Direct Deposit ($0.90 processing fee).
2. PayPal ($1.90 processing fee).
3. Paper Check via standard mail (Domestic or International) ($6.75 processing fee for domestic; international fees vary).

• Processing fees are deducted from the total payment.

3. TERMINATION

• Either party may terminate this Agreement at any time, without cause or notice (written or otherwise).
• Upon termination, all pending and future commission payments cease immediately. No partial/prorated payments will be issued upon termination.
• Discount Legends reserves the right to withhold final payments if fraudulent activity is suspected.

4. INTELLECTUAL PROPERTY

• Discount Legends owns all trademarks, logos, and promotional materials.
• You are granted a non-exclusive, revocable license to use these materials solely for promotional purposes under this Agreement.
• Unauthorized use, modification, or distribution of intellectual property is prohibited.

5. FTC COMPLIANCE & ADVERTISING DISCLOSURES

• You must comply with all Federal Trade Commission (FTC) regulations, including clear and conspicuous disclosure of your affiliate relationship with Discount Legends.
• Example disclosure: "I earn a commission if you sign up through my Affiliate ID, link, etc."
• Misleading claims, false advertising, or spam is strictly prohibited.

6. NON-DISPARAGEMENT

• You agree not to make false, misleading, or defamatory statements about Discount Legends, its products, or its services.

7. MODIFICATION OF TERMS

• Discount Legends reserves the right to modify this Agreement at any time without notice (including but not limited to commission rates, bonuses, payment schedules, etc.).
• While we may choose to provide notice (via email, website updates, etc.), notice is not required.

8. INDEPENDENT CONTRACTOR STATUS

• You are an independent contractor, not an employee.
• You are responsible for your own taxes, insurance, and compliance with applicable laws.

9. DISPUTE RESOLUTION & GOVERNING LAW

• Any disputes shall be resolved through binding arbitration in accordance with the laws of [Your State/Country].
• Class action waivers apply.

10. GENERAL PROVISIONS

• No exclusivity - You may promote other businesses unless restricted by a separate agreement.
• No warranty - Discount Legends does not guarantee earnings.
• Limitation of liability - Discount Legends is not liable for indirect or consequential damages.
