Non-refundable deposit due to reserve space. Calculated by using LOA (length overall all boats will be measured at time of haul out)

Monthly Winter Storage Fees

$11/ft up to 40' (minimum 25')

$12/ft 41' to 49'

When your deposit is received, we will send you an invoice that will indicate the DATE of your haul out. At that time payment equaling 3 months winter storage will be due before your haul out date. You will be invoiced for any remaining storage when you receive your spring launch date.

Owner agrees to remove his boat from dry storage at the termination of this rental agreement.

Boats not removed by this shall be charged rent of $20 per day up to 40', $21 per day 41' to 49', $22 per day 50' and up.

In the event of non-removal of the boat and it presents a hazard to other persons or property, or interferes with normal marina operations, Smith’s Marina shall reserve the right to move the boat to another location at a cost of $9 per foot to the owner for re-blocking.

GENERAL YARD RULES

Prohibited:

1. No outside contractors are allowed in the yard without prior authorization from the marina office and must have a certificate of insurance on file in the marina office before any work can begin. No outside contractors allowed to perform work that Smith's Marina offers. 
2. No moving of jack stands or blocks and/or tying lines to jack stands while boat is in land storage area.
3. No oils, gas, holding tanks, paints, thinners, or anti-freeze being drained or leaking on grounds or in the water.  If found violating this regulation, you will be responsible for all clean up, fines and legal fees.
4. No trash or debris is to be left around the boat or in the yard.  Removal by Smith’s Marina will be at the rate of $125.00 per hour.
5. No spray painting or power washing is allowed in the yard.
6. No disposal of shrink wrap in marina trash dumpster. We recycle, please contact office for proper recycling procedures.
7. No parking in areas that will block or hinder yard work.  Smith’s Marina reserves the right to have vehicles or trailers towed at the owner’s expense.
8. All power cords will be unplugged daily by 4pm, per the AACO fire department.
9. Owners boat left on land after rental period charged $20+ per day storage.

 Permitted:

1. Owners may work on their boats while in land storage.
2. Owners must use dustless vacuum sanders.
3. Owners supplying paint for the yard to use will be charged $50/gallon

TERMS AND CONDITIONS

1. No refunds on deposits.
2. Owner agrees to deliver boat on date agreed upon in contract, at owner’s risk, for Smith’s Marina to place in dry storage.
3. All space rental fees are paid in advance. It is understood and agreed that no boat is to be removed from its space unless and until all charges for space rental, service and/or materials have been paid in full.
4. If owner becomes delinquent in rental payments, Smith’s Marina shall notify the owner of delinquency as required by law and shall have the right to take over the property and to dispose of or remove it as determined by Smith’s Marina.
5. Holding tanks must be emptied prior to being hauled out for land storage.
6. All personal property should be removed from boat prior to storage.  It is understood and agreed that Smith’s Marina will not be responsible for any items or personal property left in the boat.
7. It is agreed that Smith’s Marina will not be held liable for any personal injury to the owner(s) or the owners’ property arising from any cause whatsoever, including, but not limited to fire, storm, theft, vandalism, mildew, collision, ice or act of God.
8. Owners assume all responsibility for covering to protect the boat prior to storage.  It is understood and agreed that Smith’s Marina will not be responsible for maintenance of such covering while the boat is on or in the premises of Smith’s Marina.
9. Owner shall not transfer this agreement to anyone without the agreement of Smith’s Marina.
10. Owner shall remove boat within 12 hours of boat launching or will be charged transient storage at the rate of $3 per foot per night.
11. Boats left on land will be charged $20 per day and will be accessed with a re blocking fee of $9/foot.
12. Any infraction of the rules or terms and conditions contained herein shall, at the option of Smith’s Marina, cancel this storage contract upon proper notice to the owner at which time his boat is to be removed from the premises.
13. Due to many boats being hauled and delays due to the weather, owners should not plan to be present during hauling.  We will make every attempt to haul your boat on schedule.  No hauling is done on Saturday or Sunday.

SPRING LAUNCH PUNCH LIST

1. If we are removing your shrink wrap, please let us know what day you would like it removed.
2. If you are removing your own shrink wrap, please see the office for a recycling bag and sticker.
3. Please schedule your mechanic to do any de-winterization necessary prior to launch.
4. Batteries are charged and operating.
5. Drain plug is in.
6. Seacock valves are all closed.
7. If we are tying your boat up in a slip for pick up, you must provide FIVE lines attached to the cleats on your boat. We also sell lines for purchase for Spring Launch in our marina store.
8. Make sure the cockpit door is open and accessible to check for leaks.
9. Please make sure all open invoices are paid in full prior to launch.

 

I have read and understand this rental agreement and the yard rules. I also acknowledge my responsibilities before and at the expiration of this agreement. All winter services that I wish Smith’s Marina to do on my boat while in your yard have been checked off or discussed with the office.
