We would like to thank you for joining our gym and look forward to seeing you working hard on the floor. Here at Phoenix Physique we are all about creating a better version of you.

Phoenix Physique was created around the ancient mythology of the Phoenix Firebird. The firebird symbolises rebirth and youthfulness. Phoenix Physique represents the nest the firebird builds before being ignited and consumed in flames.

We believe that by being physically stronger, you will be mentally stronger and will have the ability to achieve great things. Strength training not only gives you greater muscular strength, improved muscle tone and appearance, increased endurance and enhanced bone density. It makes you feel more confident, powerful, gives you focus and the ability to achieve what you thought was impossible.

At Phoenix Physique we can provide you with the guidance you need, putting you on the road toachieve your goals. We train beginners to advanced lifters, with all programmes tailored to individual needs. If you would like to train with one of our great trainers, ask us how. We believe that once you are comfortable with being uncomfortable, great things will happen.

Membership Induction

Phoenix Physique Pty Ltd ABN 17 161 530 409 (‘Phoenix Physique’) offers you access to its training facilities at 20 Lyons Terrace, Windsor (‘Studio’) between the hours of 4am and 10pm 7 days a week for the purpose of your own personal strength and cardio training on the terms as set out in this Membership Induction agreement and the automatic billing agreement (‘Membership’).

You are aware there is NO SUPERVISION OR ASSISTANCE offered as part of the access. Any training assistance or supervision must be arranged and booked with the trainer of your choice. We recommend you train with a partner if the studio is unmanned.

Please read and complete the form below and by signing below you acknowlege that you have watched and understood our induction video.

Our induction video will show you:

• how to use the access fob
• how to use the duress alarm and intercom (You are aware a fee is payable for the accidental use of the duress alarm)
• how to use the music system
• location of the the fire escape
• location of the first aid kit location
• around the Studio
• specified areas that are closed outside manned hours
• there will be NO SUPERVISION OR ASSISTANCE when training

Payment occurrence: fortnightly

Regular debit fee: $13.95 per week - ($27.90 per fortnight)

Admin fee: $2.30 per fortnight

Set up fee: $15 (this is a one off payment)

Fob fee: $20 (this is a one off payment - unless you lose your fob and there is a $35 replacement fee)

First week is FREE. First direct debit to come out one week from sign up.

By completing the PaySmart sign-up form and signing below, I authorise PaySmart to use my bank details herein for the purpose of processing recurring payments for my Phoenix Physique membership.

• You must swipe your fob or present your fob to a trainer every time you enter the Studio.
• At no stage are you permitted to allow another person to use your fob to access the Studio.
• Memberships are not transferrable or refundable.
• If a non-member would like to train with you, they must gain access when a trainer is present and must pay the casual membership rate as set by Phoenix Physique from time to time.
• If you are under the age of 16 years you must train with a parent/guardian at all times.
• No responsibility is taken for personal items, and lockers are available.
• You must advise Phoenix Physique in writing of any changes to your personal information (including emergency contact, health matters, address).
• The Studio is available to other persons and is not exclusively for members.
• Your access to the Studio will be revoked if any payments are not made by the due date and you do not bring these up to date within 5 days of a request to do so.
• Video surveillance will occur 24/7, except in the change room and bathroom facilities, and you accept you will be subject to video and audio surveillance.
• If a fob is lost or damaged and requires replacement, a replacement fee is payable by you.

Phoenix Physique makes every reasonable attempt to provide safe recreational services however there are significant and inherent risks involved and you agree you are participating voluntarily and thereby exposing you to certain risks.

You acknowledge and accept while participating in activities or attending the Studio:

• the Studio will be unmanned for periods of time between the hours of 4am and 10pm;
• there is no supervision or assistance offered as part of the Membership;
• Phoenix Physique is providing a service only and does not manufacture equipment and cannot be liable for defective products or equipment.
• you may be injured physically or mentally including broken bones, soft tissue injuries, joint injuries, permanent disability, or may die;
• your personal property may be lost or damaged;
• other persons participating in activities in the Studio and their actions or omissions may cause you injury or may damage your property.

You represent and warrant that:

• you understand the risks associated with undertaking activities in an unmanned and unsupervised recreational facility;
• you have the necessary skills and knowledge to train at the Studio unsupervised;
• you are physically and mentally capable of undertaking training and other activities at the Studio;
• you have not made known any expectation of certain results or outcomes from your training;
• you will not use any equipment that may adversely affect any medical condition or physical or mental limitation you're may suffer from; and
• if you suffer or are suffering from a condition that would impair your ability to participate in physical exercise you have obtained all necessary clearances from a doctor to allow you to participate.

Having regard to the above you release, indemnify and hold harmless Phoenix Physique, its officers, servants, agents, contractors and employees from and against all and any actions or claims which may be made by you or on your behalf by other parties for or in respect of or arising out of any injury, loss, damage or death caused to you or your property whether by negligence, breach of contract, breach of consumer guarantees or in any way what so ever from your access to the Studio or use of facilities at the Studio.

Further, you agree that this release whether it arises from the negligence of Phoenix Physique its officers, servants, agents, contractors or employees or otherwise shall be as broad and inclusive as the laws of Queensland allow.

You will indemnify Phoenix Physique for any damage or loss caused by you to its equipment or the Studio.

You acknowledge and agree you are not to admit guests at any time to the Studio without the consent of Phoenix Physique and payment of the casual fee. If this obligation is breached, then:

• your access to the Studio will be immediately suspended for a period of 14-days without any notification to you;
• the second breach constitutes an automatic acceptance by you of a new membership for the nonmember and a fee of $143.40 will be charged to your account; and
• Any subsequent breach gives Phoenix Physique the right to immediately cancel your membership and charge you a cancellation fee of $200.

• Towels are to be used on equipment at all times.
• If you sweat on equipment, please use disinfectant provided to wipe down equipment.
• Appropriate workout clothing to be worn at all times.
• Weights are to be returned and equipment unloaded after use.
• Collars and clips must be used for free bar lifting.
• Swearing and derogatory remarks involving other members or staff will not be tolerated.
• Respect other Studio users and behave in a courteous manner at all times. • Allow others to work in during rest periods/sets.
• Do not attempt to repair or adjust equipment that has malfunctioned. Please advise Phoenix Physique immediately if you identify a problem.
• Always use a spotter when attempting maximum weight.
• Abide by the Studio’s etiquette requested and displayed by Phoenix Physique from time to time.

• Membership is charge by automatic deduction from a debit or credit account through Paysmart billing service with the associated costs and fees.
• Membership is a minimum of 3 months then on going.
• You may end your membership at any time after the 3 months with two weeks written notice to Phoenix Physique.
• Phoenix Physique may end your membership by notice in writing to you, if you breach:
  • a term or condition of this Membership Induction;
  • the Studio’s etiquette & rules as displayed;
  • or the terms of the automatic billing system.

I acknowledge that the activity I am to undertake has significant risk of physical harm and that in understanding this, I willingly and voluntarily participate and take full responsibility for any physical or mental injury I may incur or my death.

I indemnify and hold harmless the training activities facilitator, Phoenix Physique Pty Ltd ACN 161 530 409, their officers, servants, agents, contractors and employees from and against all and any actions or claims which may be made by me or on my behalf by other parties for or in respect of or arising out of any injury, loss, damage or death caused to me or my property whether by negligence, breach of contract, breach of consumer guarantees or in any way what so ever from the training activities or use of their facilities.

I further acknowledge that I am not required to engage in any activity against my will. I have read and fully understood that this document affects my legal rights.
