RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, MEDIA RELEASE & INDEMNITY AGREEMENT

5th Avenue between Market Street and K Street, and Island Avenue between 4th Avenue and 6th Avenue, Gaslamp Quarter, San Diego, California.

ACKNOWLEDGMENT OF RISK & ASSUMPTION

I, the undersigned participant, hereby acknowledge and agree that:

• I am voluntarily participating in the Gaslamp Urban Pickleball event (“Event”), hosted and produced by the Gaslamp Quarter Association, McFarlane Promotions, Inc. Nado PKL Pro, Ken Irvine, The Shift Studio, and the City of San Diego (collectively the “Released Parties”).
• I understand that pickleball is an inherently dangerous sport, involving physical exertion, slips, falls, collisions with other players, dehydration, heat-related illness, and other known or unknown hazards that may result in serious injury, permanent disability, or death.
• I acknowledge that the Event will take place on temporary outdoor courts installed on public city streets closed for the event. These courts will be on asphalt, which may contain cracks, uneven surfaces, and other imperfections that may cause the ball to bounce unpredictably and may present tripping or falling hazards.
• I understand that participation may expose me to communicable diseases, including COVID-19, and I assume all such risks.
  I fully and expressly assume all risks, both known and unknown, including risks caused by the ordinary negligence of any Released Party, to the maximum extent permitted by law.

 

INSURANCE & MEDICAL COSTS

I understand that no medical or accident insurance is provided by the Released Parties and that I am solely responsible for obtaining my own health and accident insurance coverage. I certify that I am physically fit and capable of safely participating in this event. I consent to receive emergency medical care at my own expense if necessary and acknowledge that an onsite nurse will be present in compliance with City of San Diego Special Events requirements.

PROPER ATTIRE & FOOTWEAR

I acknowledge and agree that it is my sole responsibility to wear proper clothing, including appropriate athletic footwear with adequate grip and support, to reduce the risk of slips, trips, or falls on asphalt surfaces. I understand that wearing improper shoes (e.g., sandals, open-toe shoes, shoes lacking traction) significantly increases my risk of injury and is strongly discouraged. I further understand that protective gear, such as knee or elbow pads, is recommended to minimize injury risk. The event organizers may deny participation to any player who is not properly attired, without a refund.

 

COURT CONDITIONS & FAIR PLAY RULES

I acknowledge that:

• There will be eight (8) regulation-size temporary courts with professional temporary nets.
• These courts are not officially sanctioned professional courts per USA Pickleball standards but meet regulation size and net height.
• The asphalt playing surface may cause unpredictable ball bounces or tripping hazards. To ensure fairness, I agree to switch sides according to official rotation guidelines set by the USA Pickleball Association or equivalent, so all players experience court conditions equally.

 

WAIVER, RELEASE & DISCHARGE

In consideration of being permitted to participate, I hereby:

• WAIVE, RELEASE, AND FOREVER DISCHARGE the Released Parties, including all officers, directors, elected officials, employees, contractors, volunteers, sponsors, agents, and affiliates, from any and all claims, demands, losses, damages, causes of action, costs, or expenses (including reasonable attorneys’ fees) arising out of or connected with my participation—including claims resulting from ordinary negligence—to the maximum extent permitted by law.
• I understand that this waiver does not apply to acts of gross negligence, recklessness, or intentional misconduct by any Released Party.

 

INDEMNITY

I agree to indemnify, defend, and hold harmless all Released Parties from all liability, claims, demands, losses, or expenses (including reasonable attorneys’ fees) resulting from my actions or omissions during the Event, including any claims brought by other participants, spectators, or third parties arising from my participation.

 

STATUTE OF LIMITATIONS

I agree that any claim or cause of action arising out of my participation must be filed within one (1) year of the incident.

 

MEDIA RELEASE

I grant permission for the Released Parties to photograph, videotape, or record my participation and to use my likeness in all media for promotional, advertising, or commercial purposes worldwide, in perpetuity, without compensation. I waive any right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears.

 

GOVERNING LAW, VENUE & SEVERABILITY

This Agreement shall be governed by the laws of the State of California, and any legal action must be brought in the courts located in San Diego County, California. If any provision of this Agreement is deemed unenforceable, the remainder shall remain in full force and effect.

 

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supersedes all prior understandings or representations. It may not be amended except in a writing signed by both parties. Electronic signatures shall be deemed equivalent to original signatures for purposes of this Agreement.

 

CITY OF SAN DIEGO SPECIAL EVENT COMPLIANCE

I acknowledge that the Host Organization has secured all required City of San Diego Special Event Permits, including proper insurance coverage naming the City of San Diego as an additional insured with waiver of subrogation and compliance with all city-imposed conditions such as traffic control, venue cleanup, cost recovery, and the presence of an onsite nurse to address medical needs.

 

REFUNDS/WEATHER/CONDUCT

No Refunds: All registrations are final. No refunds will be issued for any reason, including inability to attend.

Rain or Shine: The event will take place regardless of weather conditions. In the case of unsafe weather, event organizers reserve the right to delay, adjust, or modify the schedule.

Conduct: Participants are expected to respect staff, fellow players, and event property. Failure to do so may result in removal without refund.

 

UNDERSTANDING & VOLUNTARY SIGNATURE

I HAVE READ THIS AGREEMENT CAREFULLY, UNDERSTAND ITS CONTENTS, AND SIGN THIS RELEASE FREELY AND VOLUNTARILY WITH FULL KNOWLEDGE OF ITS LEGAL SIGNIFICANCE. I AM AT LEAST 18 YEARS OF AGE, OR MY PARENT/LEGAL GUARDIAN HAS SIGNED BELOW ON MY BEHALF.

If Under 18 – Parent/Guardian Acknowledgment

I, as parent/legal guardian of the above-named minor, have read and understand this agreement, consent to its terms on behalf of the minor, and agree to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of the minor.
