I, the undersigned player, performer, and/or competitor (collectively "participant"), acknowledge, agree, and understand that:

1. I am age 16 or over, and I am voluntarily participating in Nerf War(s) / Battle Tag / Open Play(s) / Event(s) / Gathering(s) / Game(s) (“the Activities”) organized by the Central Arkansas Nerf Club and its affiliates ("the Association") during the 2025 calendar year (“the Season”). I have read and I agree to all of the rules of the Association and the particular Activities in which I am participating.

2. That if I am under the age of 18, that a legal parental or guardian figure will be a required to undersign this agreement in order for me to participate in the Activities during the Season.

3. I understand that the Activities are physically and mentally intense and may require extreme exertion to play. And that I affirm that I am fit physically and mentally to participate in the Activities.

4. I understand that there are certain risks and hazards involved in participating in the Activities that may result in bodily injury, death to me or other participants, personal property loss or damage, or other harm including, but not limited to, those associated with or caused by playing conditions, weather conditions, equipment, and other participants, including the danger of trips, slips, falling over, collision with stationary objects and/or with other participants, and other common injuries and hazards.

5. I understand that the very nature of the sport I am participating in is a hazardous and risky activity, including, but not limited to, (a) the acts of running, jumping, stretching, sliding, and diving; and (b) collisions with other players and/or with stationary objects. (c) collisions with projectiles, including foam, rubber, and plastic toy projectiles and foam, rubber, plastic, and cardboard equipment used for physical tags on participants (d) the acts of shooting, being shot at, reloading, and operating equipment and toy blasters.

6. I understand that impact rated eye protection has been made available to me by the Association for use during the entire duration of the Activities.

7. I understand that I am required to wear impact rated eye protection for the entire duration of the Activities. And I understand that not wearing impact rated eye protection for the entire duration of the Activities may increase the risk of bodily injury and/or death during the Activities. Specifically, I acknowledge that the Association has notified me of this increased risk.

8. I understand that I am required to only use safe and inspected ammunition in any equipment that I utilize in the Activities, including that I am required to not use any hard-tipped ammunition or darts modified with any unsafe purpose. And I understand that by using any unsafe ammunition in the Activities may increase the risk of bodily injury and/or death to myself and other participants during the Activities. Specifically, I acknowledge that the Association has notified me of this increased risk.

9. I understand that I am required to follow the instructions, including all written and verbal rules, of the Activities operators and that failing to follow the instructions of the Activities operators may increase the risk of bodily injury and/or death to myself and other participants during the Activities. And I understand that failing to follow the instructions of the Association during the Activities may result in expulsion from the Activities with no refund(s) offered and may restrict my ability to play in any and all future Activities and Seasons hosted by the Association.

10. I elect to accept full responsibility and assume all risks of injury, illness, and infectious diseases, including but not limited to MRSA, influenza, and COVID-19, incurred or suffered by me (a) while playing and/or performing during the Activities; (b) while serving or performing in a non-playing capacity related to the Association during the Activities of my own accord or organized by other participants; and (c) while on or upon the premises of any field or establishment arranged by the Association or its sponsors. I understand and agree that the Association is not responsible for damage, theft, or other loss with respect to my property in any of these circumstances. 

11. I release, waive, discharge, and agree not to sue any and all participants, the Association, the Association's leadership, the Association's official sponsors, participating or hosting organizations, or any and all persons or entities associated with the Association from liability for any injury, illness, death, loss or damage to personal property, or any other claim that I may have in connection with the Association. This release applies to me, my personal representative, assigns, heirs, and next of kin. Costs, claims, or causes of action which I may have in the future as a result of injuries or damages sustained or incurred by me from whatever cause related to the Association, including, but not limited to, the negligence, breach of contract, or wrongful conduct of the parties are hereby released.

12. I release, waive, discharge, and agree not to sue any and all participants, the Association, the Association's leadership, the Association's official sponsors, participating or hosting organizations, or any and all persons or entities associated with the Association from liability for any injury, illness, death, loss or damage to personal property, or any other claim that I may have in connection with the Association. This release applies to me, my personal representative, assigns, heirs, and next of kin. Costs, claims, or causes of action which I may have in the future as a result of injuries or damages sustained or incurred by me from whatever cause related to the Association, including, but not limited to, the negligence, breach of contract, or wrongful conduct of the parties are hereby released.

13. I fully understand all of the terms and conditions both in documentation and in all verbal agreements and am of age to take part in the Activities during the Season.

In consideration of being allowed to participate in recreational activities (Nerf wars, battle tag, combat sports, LARPing, etc.) or other sports or programs, the below signed participant, agrees as follows:

1. I am aware that infectious diseases, including but not limited to, coronavirus ("COVID-19"), MRSA, and influenza (collectively "Infectious Diseases"), are extremely contagious viruses spread through person-to-person contact.

2. I am familiar with the Center for Disease Control and Prevention ("CDC") guidelines regarding COVID-19 and guidelines regarding Infectious Diseases. I accept full responsibility for familiarizing myself with the most recent updates and guidelines, and for making informed choices to take precautionary measures to protect myself and others.

3. In addition to the CDC guidelines, I agree to abide by any and all policies or postings put forth by Central Arkansas Nerf Club and any of its affiliates.

4. By signing this agreement, I acknowledge that I am aware of the contagious nature of COVID-19 and Infectious Diseases and voluntarily assume the risk that I may be exposed to or infected by COVID-19 and Infectious Diseases while participating in Central Arkansas Nerf Club programs, sports, and events that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 and Infectious Diseases at the Facility may result from the actions, omissions, or negligence of myself and others.

5. I agree that, if I suspect I became exposed to or infected by Infectious Diseases at the Activity and I elect to seek testing and/or treatment as a result therefrom, I will be responsible for payment of any and all medical services and testing services.

6. I voluntarily choose to assume all of the foregoing risks and accept sole responsibility for any injury, illness, permanent disability, or death related to COVID-19 and Infectious Diseases arising from or in connection with my presence at the Activity.

7. I agree that, if I suspect I have been exposed to or infected by COVID-19 or Infectious Diseases, I will refrain from attending events put on by the Association until I have waited at least five days since suspected exposure or tested negative for COVID-19 after those five days.

8. I agree that, if I determine that I have been infected by COVID-19 or Infectious Diseases or exposed to COVID-19 or Infectious Diseases within 5 days of attending an event held by the Association, I will notify the Association of my COVID-19 and Infectious Diseases status or exposure so that they may inform other participants that they may have been exposed as well.

I hereby release and hold harmless the Association, their volunteers, agents, directors, representatives, and other participants from and against all liabilities (statutory or otherwise) for claims, suits, demands, judgments, costs, interest, and expenses (including but not limited to attorney's fees and disbursements) for injury, illness, permanent disability, or death related to COVID-19 arising from or in connection with mine or my child(ren)'s participation with the Association, EVEN IF ARISING FROM THE NEGLIGENCE, ACTS OR OMISSIONS OF THE RELEASED PARTIES.

I HAVE READ AND UNDERSTAND THIS PARTICIPANT'S ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY AND I HAVE READ AND UNDERSTAND THIS PARTICIPANT'S ASSUMPTION OF RISK OF INFECTIOUS DISEASES, WAIVER, AND RELEASE OF LIABILITY. I AM AWARE THAT BY SIGNING BELOW, I MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND I AGREE TO ABIDE BY ITS TERMS AND PROVISIONS. I ACKNOWLEDGE THAT I HAVE SIGNED THIS AGREEMENT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE.
