    The Grayson Baptist Association (hereinafter referred to as the "GBA"), pursuant to the terms, conditions, and limitations contained in this document, agree to grant permission to {printedName} (hereinafter referred to as "Tenant") to enter and use the GBA Lake Property located at 29023 Preston Bend Rd., Pottsboro, TX 75076, (hereinafter referred to as "Lake Property" or "Campground") to enter and use the GBA Lake Property beginning on__________  (date of reservation)

  • The terms of this agreement shall remain in effect throughout the duration of the approved reservation and shall continue to be enforceable for a period of one (1) year from the date of completion.

    As a precondition of the Tenant's entry and use of the Lake Property, Tenant agrees to abide by the following requirements: (Please Initial each section)

    • This reservation is for the undersigned Tenant and Tenant will be on the premises during the term of this lease.
    • Any guest of Tenant that is not included in this lease agreement is subject to a day-use fee. Tenant is responsible for paying this fee to the GBA.
    • Tenant agrees to release, indemnify, and hold harmless the GBA from any injuries or damages that Tenant or Tenant's guests may incur while on the GBA Lake Property. Tenant agrees to release, indemnify, and hold harmless the GBA, its officers, agents, staff, representatives, and volunteers from any and all claims, demands, actions, or causes of action arising out of or related to any loss, damage, accident, illness, injury (including serious bodily injury), or death that may occur to the Tenant or the Tenant's guests while on or in connection with the use of the GBA Lake Property, whether caused by negligence or otherwise.
    • Tenant understands and agrees that if minors are present during the reservation, the Tenant is solely responsible for supervising all adults under their authority who interact with those minors. Tenant affirms that any adult (age 18 and older) working with minors has undergone a criminal background check within the past two (2) years and meets all applicable safety and legal requirements. The GBA, its officers, agents, staff, representatives, and volunteers shall not be held liable for any actual or alleged misconduct, abuse, or molestation involving minors during the Tenant’s use of the Lake Property.

     

    • Camping, including transient trailers or recreational vehicles at one or more campsites for a period of longer than thirty (30) days is prohibited, unless an authorized GBA representative and the Tenant signs a separate written agreement setting out the specific dates of the lease/rental term.
    • Tenant agrees to have at least one authorized representative of Tenant on the Lake Property at all times during the term of this lease agreement.
    • Tenant agrees that the Lake Property will not be used, nor will Tenant allow the Lake Property to be used for any overnight stay by unwed couples, same sex unions, or same sex marriages, nor for any promiscuity or action that falls outside of the parameters for marriage as set forth in the Bible. The GBA affirms, as a closely held religious belief, that marriage can only occur between one man and one woman via a covenant marriage as set forth in Scripture.
    • Tenant agrees that smoking is not allowed in any of the buildings or the pavilion.
    • Tenant understands that no pets are allowed inside the dorm or cabins at any time. Tenant also understands that all pets must be on a leash at all times they are outside on the Lake Property.

     

    • Tenant understands and agrees that there are no lifeguards present at any time at the Lake Property. The “Beach access” refers solely to the land and shoreline that fall within the leased property of the GBA Lake Property. The water beyond the shoreline is not owned, operated, or controlled by the GBA and is under the jurisdiction of the U.S. Army Corps of Engineers and other appropriate authorities. As such, Tenant agrees that all persons under Tenant’s authority and control that enter the water for swimming, water activities or watersport enter at their own risk.  The Tenant is solely responsible for ensuring the safety of those individuals, including providing appropriate and Coast Guard-approved flotation devices for any person participating in water-related activities. The GBA, its staff, representatives and or volunteers are not responsible for any injuries or damages that may occur to any individual who participates in such activities.
    • Tenant agrees that any persons under its control and authority may use the playground at the Lake Property at their own risk. The GBA is not responsible for any injuries or damages resulting from the use of the playground.
    • Tenant agrees that the use of off-road vehicles of any kind is not allowed on the Lake Property except on designated roadways. This includes unlicensed and licensed vehicles and drivers, including, but not limited to, golf carts, ATVs, motorcycles, or side-by-sides. Tenant is responsible for taking all reasonable steps to ensure that this rule is followed. The Army Corps of Engineers has requested that local and state authorities assist in seeing that these rules are followed on public roads within the Lake Property.
    • Tenant understands that the speed limit inside the Lake Property is 5 MPH.
    • Tenant agrees that cutting any trees on the Lake Property is prohibited.
    • Tenant agrees that campfires may only be built and used inside the fire rings established/designated by the GBA. No one may move or reset the fire rings without the express written permission of the GBA.
    • Tenant understands and agrees that no fireworks are allowed on the Lake Property.
    • Tenant understands and agrees that while no signage is posted, firearms, explosives, or weapons of any kind are not permitted on the Lake Property. The property falls under federal regulations, specifically the U.S. Army Corps of Engineers policy outlined in Title 36, Code of Federal Regulations (CFR), Section 327.13, which prohibits the possession of firearms, ammunition, explosives, or other weapons unless written permission is granted by the District Commander. Tenant agrees to comply with all applicable local, state, and federal laws regarding the possession and use of firearms, explosives, or weapons while on the premises.
    • Tenant agrees that no alcoholic beverages, drugs or intoxicants are allowed on the Lake Property. Should any person under Tenant's authority violate this provision, Tenant agrees to notify the GBA immediately by calling the GBA representative identified below. Tenant agrees that they are solely responsible for any injuries or damages to persons under their authority and control who consume alcohol on the premises, or who enter and occupy the Lake Property while under the influence of alcohol, drugs, or other intoxicants. Tenant agrees to hold harmless and indemnify the GBA from any claims brought by any person under Tenant's authority who participates in any of the conduct prohibited in this paragraph.

  •  By my signature below, I acknowledge that I have read, understood, and agree to the terms and conditions set forth in this document. I affirm that I have the authority to sign on behalf of the church or organization identified above.
     
    I understand that the GBA Lake Property is primarily reserved for the use of churches that are members of the Grayson Baptist Association and their guests. It is not available for individual or private use. Use by other nonprofit religious organizations is subject to GBA approval. All reservations must comply with the terms of our lease agreement with the U.S. Army Corps of Engineers. Reservation fees for nonprofit groups not affiliated with the GBA may differ from those charged to GBA member churches.
     
    I further understand that failure to comply with any part of this agreement may result in immediate removal from the GBA Lake Property, termination of current and future use privileges, and, if necessary, notification of local authorities to enforce property policies and ensure the safety and integrity of the premises.
