No refunds. No self-removal or tampering of boots. No credit card chargebacks. Payment is understood to be for the removal of vehicle immobilization devices (also known as wheel clamps or boots) from a vehicles tires. By submitting your payment you consent to Citywide Parking Services debiting your account in the amount listed below and hereby agree to all of the terms and conditions downloadable at: https://cwp.services/terms. Any appeals must be done within 3 days (72 hours) of the date of payment online at https://dispute.cwp.services in order to qualify for any potential rebate or refund request. Any refund requests beyond this date will not be approved unless approved by special written request from Citywide Parking Services Management.
[ Waiver of right to file Merchant Dispute with card company ] By proceeding to pay for your boot removal online or in person you agree to waive your rights to do any type of credit card dispute, for any reason, with your merchant processor (Visa, Mastercard, Discover, Cashapp, etc). If you disagree with this condition then you understand that you have the alternative option, which is to pay the boot removal technician with cash. You hereby agree that any disputed charges with your credit/debit card merchant will be considered credit card fraud and will result in significant legal action to the fullest extent of the law and will be grounds for the re-booting or towing of your vehicle if found parked anywhere in Georgia that utilizes parking enforcement or security services in connection with Citywide Parking Services LLC. You also understand and agree that, if you do file a credit card dispute with your bank or merchant account processor that results in you receiving any refund (that wasn't preapproved by Citywide Parking Services LLC), that in a court of law, that this payment form serves as a guilty plea and that Citywide Parking Company LLC reserves the right to immediatly issue a police report filed in your name as a misdemeanor or felony for credit card fraud. The crime of theft of services, bank fraud and criminal trespass will all be listed in any report involving credit card fraud. The amount owed may also be turned over to a collections agency and may be subject to additional fines or fees. You understand that your credit rating will be subject to being negatively impacted and additional legal fees may be assessed.
[ Class Action Waiver ] Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. You and Citywide Parking Services LLC agree that any proceeding, whether in arbitration or in court, will be conducted only on an individual basis and not in a class, consolidated or representative action. Neither you, nor any other customer, client or vendor, can be a class representative, class member, or otherwise participate in a class, consolidated or representative proceeding. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER.
