This Waiver and Release of Liability is entered into by the undersigned participant ("Hiker"), ("Imiloa Hiking Club"), its organizers, volunteers, employees, agents, and affiliates (collectively referred to as "Released Parties").
1. Acknowledgment of Risks
The undersigned acknowledges and understands that hiking, walking, and participating in outdoor activities involve inherent risks, including, but not limited to, physical injury, property damage, or death due to factors such as environmental hazards, natural disasters, weather conditions, and encounters with wildlife. The undersigned voluntarily assumes all risks associated with participation in hiking activities organized by the Group.
2. Medical Conditions
The undersigned represents that they are physically capable of participating in the hiking activities. The undersigned agrees to consult with a physician prior to participation if they have any pre-existing medical conditions or concerns regarding their ability to participate safely. The undersigned further agrees to inform the Group organizers of any medical conditions, allergies, or limitations prior to the hike.
3. Release of Liability
In consideration of being allowed to participate in any hiking activities organized by the Group, the undersigned agrees to release, hold harmless, and indemnify the Released Parties from any and all claims, actions, damages, losses, or injuries (including death) that may result from the undersigned's participation in hiking activities, whether caused by the negligence of the Released Parties or otherwise.
4. Indemnity
The undersigned agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, or actions that may arise from the undersigned's participation in hiking activities, including but not limited to claims arising out of personal injury, property damage, or any other losses incurred by the undersigned or any third parties.
5. Emergency Medical Treatment
In the event of an emergency, the undersigned consents to emergency medical treatment, including but not limited to first aid, transportation to a medical facility, and any necessary medical procedures. The undersigned acknowledges that they are responsible for any medical costs incurred in the event of an injury or emergency.
6. Consent to Photography and Media
The undersigned agrees that photographs, videos, or other media captured during the hiking activity may be used by the Group for promotional or marketing purposes. The undersigned consents to the use of their image or likeness in such media, without compensation.
7. Governing Law
This Agreement will be governed by the laws of [State/Country]. Any legal action arising out of or relating to this Agreement will be filed in the appropriate court in [jurisdiction].
8. Entire Agreement
This Agreement constitutes the entire understanding between the undersigned and the Group. No verbal or written statements outside of this Agreement will be considered binding.
By signing below, the undersigned acknowledges that they have read and fully understand the terms of this Waiver and Release of Liability, and that they voluntarily agree to be bound by its provisions.
