This Agreement between {name} (hereinafter referred to as “Client”) and Dawn M. Sims of Happy Hound Pet Services (hereinafter known as “Trainer”)
For good and valuable consideration, the parties agree as follows:
Fees: A consultation fee as agreed on by both parties may be charged to cover the cost of transportation. This fee will be applied to your training package.
Enrollment Process: Submission of this form does not guarantee acceptance into one of our programs. Both Client and Trainer reserve the right to decline proceeding with training after this consultation if the program is determined not to be a good fit. No payment will be collected until after mutual agreement to move forward.
Services: Trainer agrees to meet with Client and Dog to discuss goals and lay out a plan for training Client how to train and work with Dog. No training will take place during this consultation; it is strictly for information gathering purposes. Some management strategies may be suggested and should be followed for any client interested in pursuing training or behavior modification with their dog.
Cancellation Policy: By signing below, Client agrees to provide 24 hours notice of cancelation.
Liability: If Dog causes property damage, or bites or injures any dog, animal or person (including but not limited to Trainer and Trainer’s agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Trainer and Trainer’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If Dog is injured in any manner during or after the term of the Agreement, Client assumes the risk and agrees that Trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses.
This Agreement is binding upon Client, spouse of Client, children of Client, and any other member of Dog's household. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Trainer regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to Dog or anything else. Without limiting the generality of the foregoing, Client acknowledges that Trainer has not represented, promised, guaranteed or warranted that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time. This Agreement may be amended only by a written instrument signed by both Client and Trainer.
Every provision herein is intended to be severable. If any one or more of the provisions herein is found to be unenforceable or invalid, that shall not affect the other terms and provisions hereof, which shall remain binding and enforceable.
