For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged,
I, "the Dancer" or the Legal Guardian of the "the dancer" hereby confirm the following grant of rights and agreement:
Liability Waiver
The dance classes, production rehearsals and other activities throughout the Toowoomba Ballet Theatre performance program as a dancer including, without limitation, conventions, competitions, rehearsals, shows and performances (collectively, the “Activities”) will involve strenuous activity and the Dancer’s participation in the Activities may result in his or her injury including, without limitation, muscle strains, pulls or tears, broken bones, shin splints, spinal/hip/knee/foot injuries, heart attacks, death, disability and disfigurement. Knowing these risks, I voluntarily assume, on behalf of the Dancer, all risk of such injuries, whether known or unknown, occurring before, during or after the Dancer's participation in the Activities (including injuries caused by equipment problems and human error). Moreover, I, on behalf of the dancer, hereby irrevocably, knowingly, voluntarily and unconditionally waive, release and agree to hold Mia Huston and/or the Toowoomba Ballet Theatre harmless from any and all claims, damages or liability whatsoever resulting from any of the Dancer’s participation in the Activities, travelling to and from any Activities, and while on location for any Activities, whether such damages are caused by negligence carelessness or otherwise (including without limitation, negligent rescue operations).
Medical Release
In case of an emergency, I authorise Mia Huston and/or The Toowoomba Ballet Theatre, including any of it directors, principals, employees, contractors, volunteers, and representatives to arrange for or provide such medical assistance to the students as they deem to be necessary. I also authorise any licensed physician, healthcare personnel and/or medical facility to provide any medical care and/or hospitalisation of the dancer, including anaesthetics, which such licensed physician, healthcare personnel and/or medical facility determines necessary or advisable. I authorise any reasonably necessary care by paramedics. On behalf of the Dancer, I hereby irrevocably, knowingly, voluntarily and unconditionally waive, release and agree to hold Mia Huston and/or the Toowoomba Ballet Theatre harmless from any and all claims damages for liability whatsoever resulting from any treatment or service provided by a licensed physician, health care professional, medical facility, paramedic or otherwise pursuant to this medical advice.
Photo Release
I unconditionally grant full rights to Mia Huston and/or the Toowoomba Ballet Theatre to take, record and use motion (video) and still pictures (photographs) of me or my child to use for any purposes, without any compensation to me or to my child whatsoever. I agree that said photos and video can be used in any advertising and promotional material, with or without names and press releases and other print and online advertising, including social media.
I hereby represent that I am the dancer, or am the parent and/or legal guardian of the dancer and, as such, have the full rights, power and authority to enter into this consent and release. I hereby confirm that I have carefully read and fully understood everything contained in this consent and release and affirm all of the foregoing on the Dancer’s and my own behalf. Moreover neither I nor the student will attempt at any time for any reason to revoke or disaffirm any of the foregoing consents, waivers, releases or agreements. I hear by expressly agreed to indemnify Mia Huston and/or the Toowoomba Ballet Theatre from any and all costs incurred and any loss of any nature or kind whatsoever, including reasonable attorneys’ fees, arising from or relating to any claims made by or on behalf of the Dancer relating to the subject matter of the Consent and Release all relating to any breach of the Consent and Release or any attempt by the Dancer or on the Dancer’s behalf to void this consent and release.
