"Are you currently, and will you be, living at the property as your Principal Place of Residence?", is crucial for determining eligibility for certain duty exemptions or concessions. Under the Duties Act 2000 (Vic), specifically sections 57K and 57S, the principal place of residence (PPR) concession requires that the transferee occupies the property as their principal residence for a continuous period of at least 12 months, commencing within 12 months after becoming entitled to possession of the land. Accurate information about your residency status ensures compliance with these provisions and helps us apply the correct duty treatment to your property transfer.

"Will you be, living at the property as your Principal Place of Residence?", is crucial for determining eligibility for certain duty exemptions or concessions.

You can choose any arrangement that suits your circumstances. Some common options include: Only one person (100% ownership in a single name) Joint tenants Tenants in common - Equal shares (e.g. 50/50 between two people, or 33/33/34 between three) Tenants in common - Unequal shares (e.g. 60/40, 70/30, or another fixed split) Specific portions to different parties (e.g. 10% to one person, 20% to another, and 70% jointly between both) Not sure yet (select this if you need help or further discussion before deciding) What’s the difference between Joint Tenants and Tenants in Common? If you register as joint tenants, all owners hold the property together as a whole. If one owner dies, their share automatically passes to the surviving owner(s), regardless of what’s in their Will. If you register as tenants in common, each person holds a defined share (equal or unequal), and can leave their share to anyone in their Will. There is no automatic transfer on death. The more information you provide here, the quicker and easier it will be for us to get it right the first time. If anything is unclear, we’ll contact you to confirm.

Please describe how you would like the new share ownership to be registered. For example: 50/50, 60/40, or another percentage split (e.g. 10% to one party, 20% to the other, with the remaining 70% jointly held). It's entirely up to you how the shares are divided. The more detail you give us here, the faster and more accurately we can prepare the documents. If anything is unclear, we’ll check with you before proceeding.

"Please upload a copy of the council rates notice," is to confirm ownership details and the property's current status. This document provides essential information for verifying property records and will also be submitted to the State Revenue Office as part of the transfer process. If you do not have a copy of the rates notice, we can obtain a Land Information Certificate from the council on your behalf; however, this will attract an additional disbursement fee of approximately $65.
