Terms and conditions of the contract
The object of the contract is the service of photographing the foreseen event on the mentioned date and time.
- All reservations are made with the upfront payment of 100E within a maximum of 24 hours from the date of acceptance, for which a tax invoice is issued.
 The difference is paid at the end of the event. If the amount has not been paid within 24 hours, the provider reserves the right to cancel the contract to accept another possible client, or to change the prices due to inflation.
- At the moment of payment of reservation, the order becomes firm and the photographer undertakes to reserve the day and time communicated and will not make any other reservations that interfere with the day or time of the event.
 For this reason the advance is NON-REFUNDABLE.
- If, for various reasons, the beneficiary changes the date/time of the event, the provider is entitled not to honor the order if he has another contract on that date or if for personal reasons he cannot honor the order.
 - The photos are edited for light, color and shadow correction at the level of those in the portfolio and are delivered within approximately 20 working days from the final payment. The number of photos = +/- 50 photos/hour, depending on the number of people and the atmosphere.
- Photos are submitted in an online gallery, in Jpeg format at a print resolution (3800px on the long side).
- Unedited photos or in a format other than Jpeg are not submitted.
- For a fee, the photos can be delivered on a personalized USB stick with a name and a box for the stick, personalized with a photo.
- For albums, they can be made (not in the price), they can be with vinyl, leather, acrylic covers... with matte, glossy, luster, fine art paper... and the price varies from model to model between 180E - 350E (in the case in which we collaborate, I can show you different models, on the day of the event, they can be seen at the address of the studio.)
- Except for the case where the photos are submitted online, all materials can be picked up from the studio address or sent by courier for a fee (10E).
- The deadline for picking up the materials is a maximum of 30 days from the date of the completion deadline.
- The provider undertakes to offer the following services:
- Photographing the event for the entire mentioned period, exceeding this assuming additional costs according to the price/hour ratio established at the time of reservation.
- To deliver the materials in the mentioned time and to keep backup copies for a minimum of 3 months, considering that in 3 months the client has enough time to make his own backup copies.
- Photo editing will be done to achieve maximum quality. The edited photos will be handed over in terms of brightness, contrast, color balance, clarity, all these edits will be done in the specific style of the photographer, on a dedicated and calibrated monitor, therefore viewing the photos on a monitor that is not specifically dedicated the photo, on the phone or tablet, may have small differences in color, light, contrast because they do not reproduce the real colors.
- The necessary approvals for photography in the established locations, as well as the consent of all the people who will appear in the images, will be obtained by the beneficiary.
- The provider cannot be responsible for situations in which certain people or objects present at the event do not appear in the photos taken. In the event that the Beneficiary wishes to ensure that the respective persons or objects will be photographed, the Beneficiary is asked to request their photography directly from the provider.
- If, in the Provider's opinion, a person (or persons) affects/interferes with the Provider's duties, the Beneficiary must request the respective person/persons to stop taking pictures/carrying out other activities. The provider cannot be blamed in the situation where certain moments cannot be captured for this reason.
- The beneficiary undertakes to take into account the technical indications given by the provider, otherwise the provider does not assume responsibility for the quality of the materials.
- The photographer reserves the right not to take photos without affecting the final amount, if/while laser lights are used, because laser beams destroy the photographer's equipment.
- In the event of the Provider's unexpected illness, or various reasons beyond his control, he will make reasonable efforts to find a replacement (professional photographer) to photograph the event at the set date and time. If the Provider cannot send a replacement, it will fully refund the advance paid by the Beneficiary and will no longer have any contractual obligation towards the Beneficiary.
- The provider reserves the right to refuse outdoor photography if the atmospheric conditions are unfavorable. The Beneficiary is responsible for providing an alternative location in the event of inclement weather.
- Force majeure agreed to be that absolutely unforeseeable and irremovable event (war, earthquake, floods, riots, fires, death in the family of first degree relatives, extreme weather conditions, laws or governmental restrictions) that prevents the party or parties from- and fulfill the assumed obligations exonerates the party it invokes from liability.
In this case, for example, the advance can be reimbursed.
- The provider/photographer reserves the right to use the photographs for the purpose of promoting its activity on its website and social media. If the beneficiary does not want the photographer to use his image, he will have to indicate it in writing' an email is enough, BEFORE the upfront payment.
- Disagreements regarding the validity of this contract or results from its interpretation, execution or termination will be settled amicably, otherwise they will be subject to settlement through mediation or the courts.

Termes et conditions du contrat
L'objet du contrat est le service de photographie de l'événement prévu à la date et à l'heure mentionnées.
-Toute réservation s’effectue avec le paiement anticipé de 100 € dans un délai maximum de 24 heures à compter de l’acceptation du contrat, pour lequel une facture fiscale est émise.
- Le solde est à régler à la fin de l’événement. Si le montant n’a pas été payé dans les 24 heures, le prestataire se réserve le droit d’annuler le contrat pour accepter un autre client potentiel, ou de modifier les tarifs en raison de l’inflation.
- Dès le paiement de la réservation, la commande devient ferme et le photographe s’engage à réserver le jour et l’heure communiqués, sans accepter d'autres réservations qui interféreraient avec cette date ou heure.
Pour cette raison, l'acompte est NON REMBOURSABLE.
- Si, pour diverses raisons, le bénéficiaire modifie la date/l’heure de l’événement, le prestataire est en droit de ne pas honorer la commande s’il a déjà un autre contrat à cette date ou s’il ne peut pas honorer la commande pour des raisons personnelles.
- Les photos sont retouchées pour correction de la lumière, des couleurs et des ombres, au niveau de qualité de celles présentées dans le portfolio, et sont livrées dans un délai d’environ 20 jours ouvrables après le paiement final. Le nombre de photos = +/- 50 photos/heure, en fonction du nombre de personnes et de l’ambiance.
- Les photos sont remises dans une galerie en ligne, en format JPEG, en résolution d’impression (3800 px sur le côté le plus long).
- Les photos non retouchées ou dans un format autre que JPEG ne sont pas remises.
- Moyennant des frais supplémentaires, les photos peuvent être livrées sur une clé USB personnalisée avec nom et boîte personnalisée avec photo.
- Des albums peuvent être réalisés (non inclus dans le tarif). Ils peuvent avoir des couvertures en vinyle, cuir, acrylique… avec papier mat, brillant, lustré, fine art… et le prix varie selon le modèle entre 180 € et 350 €. En cas de collaboration, différents modèles peuvent être présentés le jour de l’événement ou à l’adresse du studio.
- Sauf dans le cas d'une remise en ligne, tous les supports peuvent être récupérés à l'adresse du studio ou envoyés par coursier avec un coût supplémentaire de 10 €.
Le délai maximum pour récupérer les supports est de 30 jours après la date de finalisation.

- Le prestataire s'engage à fournir les services suivants :
- Photographier l’événement pendant toute la durée convenue. Tout dépassement entraînera des coûts supplémentaires selon le tarif horaire établi lors de la réservation.
- Livrer les supports dans les délais mentionnés et conserver une copie de sauvegarde pendant un minimum de 3 mois, en considérant que ce délai permet au client de faire ses propres copies.
- La retouche photo sera effectuée afin d’obtenir une qualité maximale. Les photos retouchées seront remises avec des ajustements de luminosité, contraste, balance des couleurs, netteté, dans le style spécifique du photographe, sur un écran dédié et calibré. Il peut donc y avoir de légères différences de rendu si les photos sont visionnées sur un écran non dédié, un téléphone ou une tablette.

 Le bénéficiaire est responsable d’obtenir :
- Les autorisations nécessaires pour photographier dans les lieux convenus, ainsi que le consentement de toutes les personnes figurant sur les images.
- Le prestataire ne peut être tenu responsable si certaines personnes ou objets présents à l’événement ne figurent pas sur les photos. 
- Si le bénéficiaire souhaite qu’une personne ou un objet soit photographié, il doit en faire la demande explicite au prestataire.
- Si, selon le prestataire, une personne gêne l’exécution de ses tâches, le bénéficiaire devra demander à cette personne de cesser ses actions. 
- Le prestataire ne pourra être tenu responsable si certains moments ne peuvent être capturés pour cette raison.
- Le bénéficiaire s’engage à suivre les indications techniques données par le prestataire, sans quoi ce dernier ne pourra garantir la qualité du rendu final.
- Le photographe se réserve le droit de ne pas prendre de photos (sans que cela n'affecte le montant final) si des lumières laser sont utilisées, car les faisceaux peuvent endommager son équipement.
- En cas de maladie soudaine ou d’imprévus échappant à son contrôle,
le prestataire fera des efforts raisonnables pour trouver un remplaçant (photographe professionnel) pour photographier l’événement à la date et à l’heure prévues. 
- Si aucun remplaçant ne peut être trouvé, l’acompte sera intégralement remboursé et le prestataire sera libéré de toute obligation contractuelle envers le bénéficiaire.
- Le prestataire se réserve le droit de refuser une séance photo en extérieur si les conditions météorologiques sont défavorables. Le bénéficiaire devra prévoir un lieu de repli en cas d’intempéries.
- La force majeure – événement imprévisible et irrésistible (guerre, tremblements de terre, inondations, émeutes, incendies, décès d’un proche au premier degré, conditions climatiques extrêmes, lois ou restrictions gouvernementales) – exonère la partie qui l’invoque de toute responsabilité contractuelle.
Dans ce cas, par exemple, l’acompte pourra être remboursé.
-Le prestataire/photographe se réserve le droit d'utiliser les photographies à des fins promotionnelles sur son site web et ses réseaux sociaux. Si le bénéficiaire ne souhaite pas que le photographe utilise son image, il devra le signaler par écrit (un e-mail suffit) AVANT le paiement de l'acompte de la réservation.
 - Tout désaccord concernant la validité du contrat ou découlant de son interprétation, exécution ou résiliation sera résolu à l’amiable ; à défaut, il sera soumis à une médiation ou tranché par les tribunaux compétents.

Termeni si conditiile contractului
Obiectul contractului este serviciul de fotografiere a evenimentului prevăzut la data și ora menționate.

- Toate rezervările se fac cu plata în avans a sumei de 100€ în termen de maximum 24 de ore de la data acceptării, pentru care se emite factură fiscală.
Diferența se achită la finalul evenimentului. 
- Dacă suma nu a fost achitată în termen de 24 de ore, furnizorul își rezervă dreptul de a anula contractul pentru a accepta un alt client posibil sau de a modifica prețurile din cauza inflației.
- În momentul plății rezervării, comanda devine fermă, iar fotograful se obligă să rezerve ziua și ora comunicate și nu va mai accepta alte rezervări care să interfereze cu ziua sau ora evenimentului.
Din acest motiv, avansul este NERAMBURSABIL.
- Dacă, din diverse motive, beneficiarul modifică data/ora evenimentului, furnizorul are dreptul să nu onoreze comanda în cazul în care are deja un alt contract în acea zi sau dacă, din motive personale, nu poate onora comanda.
- Fotografiile sunt editate pentru corectarea luminii, culorii și umbrelor la nivelul celor din portofoliu și sunt livrate în aproximativ 20 de zile lucrătoare de la plata finală.
Numărul de fotografii = +/- 50 fotografii/oră, în funcție de numărul de persoane și de atmosferă.
- Fotografiile sunt livrate într-o galerie online, în format Jpeg, la rezoluție de print (3800px pe latura lungă).
- Nu se livrează fotografii needitate sau în alt format decât Jpeg.
- Contra cost, fotografiile pot fi livrate pe un stick USB personalizat cu nume și cutie pentru stick, personalizată cu fotografie.
- Albumele pot fi realizate (nu sunt incluse în preț), pot avea copertă din vinil, piele, acril... cu hârtie mată, lucioasă, luster, fine art... iar prețul variază în funcție de model între 180€ – 350€. (În cazul în care colaborăm, pot fi prezentate mai multe modele, în ziua evenimentului sau la adresa studioului.)
- Cu excepția cazului în care fotografiile sunt livrate online, toate materialele pot fi ridicate de la adresa studioului sau trimise prin curier, contra cost (10€).
- Termenul maxim pentru ridicarea materialelor este de 30 de zile de la data termenului de finalizare.

Furnizorul se obligă să ofere următoarele servicii:
- Fotografierea evenimentului pe toată perioada menționată, depășirea acesteia implicând costuri suplimentare conform raportului preț/oră stabilit la momentul rezervării.
- Livrarea materialelor în termenul menționat și păstrarea copiilor de siguranță timp de minimum 3 luni, considerând că beneficiarul are suficient timp pentru a-și face propriile copii de rezervă.
- Editarea fotografiilor va fi realizată pentru obținerea unei calități maxime. 
- Fotografiile editate vor fi livrate cu ajustări de luminozitate, contrast, echilibru de culoare, claritate – toate aceste editări fiind realizate în stilul specific al fotografului, pe un monitor dedicat și calibrat. 
- Vizualizarea fotografiilor pe monitoare nededicate (telefon, tabletă etc.) poate duce la mici diferențe de culoare, lumină și contrast.
- Aprobările necesare pentru fotografierea în locațiile stabilite, precum și acordul persoanelor care vor apărea în imagini, vor fi obținute de către beneficiar.
- Furnizorul nu poate fi făcut responsabil pentru situații în care anumite persoane sau obiecte prezente la eveniment nu apar în fotografii. Dacă beneficiarul dorește în mod expres ca acestea să fie fotografiate, trebuie să solicite direct acest lucru furnizorului.
- Dacă, în opinia furnizorului, o persoană (sau mai multe) afectează/interferează cu activitatea sa, beneficiarul trebuie să solicite respectivei persoane/persoane să înceteze activitățile care perturbă. Furnizorul nu poate fi învinuit dacă anumite momente nu pot fi surprinse din această cauză.
- Beneficiarul se obligă să țină cont de indicațiile tehnice oferite de furnizor, în caz contrar furnizorul nu își asumă responsabilitatea pentru calitatea materialelor.
- Fotograful își rezervă dreptul de a nu realiza fotografii, fără a afecta suma finală, în cazul în care se folosesc lumini laser, deoarece acestea pot deteriora echipamentul fotografului.
- În cazul unei îmbolnăviri neașteptate a furnizorului sau din alte motive independente de voința sa, acesta va face eforturi rezonabile pentru a găsi un înlocuitor (fotograf profesionist) care să acopere evenimentul la data și ora stabilite. Dacă nu poate trimite un înlocuitor, va rambursa integral avansul plătit de beneficiar și nu va mai avea nicio obligație contractuală față de acesta.
- Furnizorul își rezervă dreptul de a refuza fotografierea în aer liber dacă condițiile meteorologice sunt nefavorabile. Beneficiarul este responsabil să ofere o locație alternativă în caz de vreme nefavorabilă.
- Forța majoră – înțeleasă ca un eveniment absolut imprevizibil și de neînlăturat (război, cutremure, inundații, revolte, incendii, deces în familie de gradul I, condiții meteo extreme, legi sau restricții guvernamentale) – care împiedică îndeplinirea obligațiilor contractuale, exonerează de răspundere partea care o invocă.
În acest caz, avansul poate fi, de exemplu, rambursat.
- Furnizorul/fotograful își rezervă dreptul de a utiliza fotografiile în scopul promovării activității sale pe site-ul său web și pe rețelele de socializare. Dacă beneficiarul nu dorește ca fotograful să utilizeze imaginea sa, va trebui să indice acest lucru în scris, un e-mail fiind suficient, ÎNAINTE de efectuarea plății în avans a rezervării.
- Neînțelegerile privind validitatea acestui contract sau rezultate din interpretarea, executarea sau încetarea lui vor fi soluționate pe cale amiabilă, în caz contrar fiind supuse medierii sau instanțelor de judecată.
