The Taste of Suffolk reserves the right to decline the application for food vending by non-eligible businesses.
Vendors, themselves and their heirs, personal representative or assigns, do hereby release, waive and forever discharge the City of Suffolk, its Council members, officers, employees, and agents for liability from any and all claims, demands, rights and causes of action of whatever kind resulting in, but not limited to, bodily injury, personal injury, accident or illness (including death), and property damages sustained by us and our agents, representatives, employees or family.
Vendors shall, during the term of the contract, indemnify and hold harmless the City of Suffolk, its Council members, officers, employees, and agents from any and all losses, damages, claims, fines, penalties, suits and costs, including injury or death of any persons, or damage to or loss of property, as well as fines, assessments and penalties imposed by any authority which arise out of all violation of law by, and all acts and omission of the vendor, employees, customers, or representatives occurring in connection with the products and services of said vendor.
Exhibitor will comply with and produce evidence of the following, included but not limited to as relates to the specific operation:
- Completed and signed application.
- Business license issued from the City of Suffolk.
- Certificate of Insurance with $1,000,000 coverage Commercial Liability with City of Suffolk Parks and Recreation, 134 S. Sixth Street, Suffolk VA 23434 listed as the Certificate Holder.
- Copy of the Health Department permit for the business.
- Photo of the booth set-up.
- Dimemensions of truck if applicable (include any planned additions such as awnings, tables, signs).
- List of menu items with pricing.
Vendors will adhere to all City of Suffolk Fire Department and Health Department regulations. If these regulations are not met, either entity has the authority to close the operation of the booth and all fees paid under this agreement will be forfeited. Vendors are responsible for acquiring and submitting a copy of their Health Department permit prior to the event. This includes responsibility for any fees associated with said permit.
Vendors are responsible for applicable sales tax and business licenses. Any food vendor who does not have a City of Suffolk Business License must contact the Suffolk Commissioner of Revenue’s office at (757) 514-7182 for information.
Signage directly correlated to the applying business is the only signage permitted by the event. All other signage must have the approval of the event coordinator prior to the event.
Subletting and/or splitting/ sharing of booth space is prohibited.
No tobacco products are permitted for sale or distribution. No alcohol is permitted for sale or distribution without the accompanying ABC license and approval by the special event coordinator.
No amplified sound is permitted without express approval and guidance from the special event coordinator.
