    SEASONAL CONTRACT between Khulani and {name} {surname}

    This contract is valid from {date150} until {endDate} approximately.

    The following conditions apply:

    The employment of the worker is for the duration of the contract only and will be terminated when the employer do not have further work available. NO CONTRACT BETWEEN KHULANI AND THE WORKER IMPLIES PERMANENT EMPLOYMENT BY EITHER KHULANI OR THE FARM.

    Should work be finished prior to {endDate} , the contract will be terminated and workers will be paid until the last day of work and NOT until the end of {endDate}.

     Work is provided on a no-work-no-pay basis. If the worker was not requested to report for work on a specific day, no payment will be made to the worker.  

    PROBATION:  A probation period of {typeA131} applies/apply. If applicable, any hourly tariff increases above minimum wage applies after the probation period has been succesfully completed. Should the worker not meet the required work and ethical standards of Khulani, the worker, after consultation and warning, will be dismissed.


    Conditions of employment is according to the Basic Conditions of Employment Act with Sectorial determination 13.

    Workers are employed as general farm workers and will mainly work on the farm {farm}.  The work entails General farm work, mostly relating to {typesOf} of {productionUnit}.

    Working Hours:  A maximum of 9 hours will be worked from Monday to Friday.  Maximum hours are NOT guaranteed. When the worker is requested to report for work and works less than 4 hours on a given day, 4 hours will be paid.  

    Annual Leave:  One day paid leave is accrued for every 17 days worked. Accrued leave days are paid out at the end of the contract. Accrued leave does not get paid out with resignations as employment was voluntarily left.

    Sick Leave:  One day paid sick leave is allowed for every 26 days worked. A doctor or clinic sick note is required should the worker be sick for longer than 2 consecutive working days.  Should the worker need paid sick leave for the second time in any 8 week period, a doctor's sick note is required in order to qualify for payment of these days.

    Family Responsbility Leave:  After 4 months of employment three paid days are allowed per year upon the death of a close family member only. The worker must submit proof for the reason for the application.  Khulani’s application procedure applies.

    Maternity/Adoption Leave:  Four months unpaid maternity/adoption leave applies.

    Paternity/Adoption Leave:  Three paid days per year is allowed upon the birth of a child. The 3 paid days may be forfeited for 10 unpaid paternity/adoption leave days upon the birth of a child. One month’s notice is required. Khulani’s application procedure applies.

    Remuneration:  

    Hourly: {hourlyRate} per hour. {extraEarnings}

    Overtime: Overtime will be paid at a rate of not less than one and a half (1.5) times the employee’s normal hourly wage of {typeA130} per hour and applies only to hours actually worked in excess of nine (9) hours per day or forty-five (45) hours per week. Paid public holidays on which no work is performed do not count as hours worked for overtime purposes. Work performed on a Saturday will be paid at the normal rate until the employee has worked forty-five (45) hours in the week, after which overtime shall apply.

    Public Holidays:  Double pay is paid should the worker, after consultation, be asked to work on a public holiday. The worker will be paid for public holidays should the day fall on a normal working day, even if the worker did not work on the public holiday.

    Payment: The worker is paid weekly or bi-weekly on Friday by bank transfer into the bank account provided by the worker. Three days “back pay” applies.  The worker is therefore paid from Wednesday to Tuesday weekly or bi-weekly, depending on the pay rules of the farm. 

    Deductions: 1% Unemployment Insurance is deducted as required by law. {rent}

    Loans:   The worker gives permission that any money in the form of doctor’s accounts, mattress loans, advances to buy food, may be deducted from his/her wages. The worker gives permission that all outstanding loans may be deducted from the final pay due to the worker upon termination of the contract.

    Electricity/Gas: The farm has the right to deduct gas and/or electricity used by workers

    Damages and Lost Property:  Workers will be required to pay for any damaged or lost property that belongs to the farm.

    Termination of service:  The worker must give one week’s notice should he/she no longer wishes to work for Khulani. Should the worker be dismissed after the correct procedures have been followed, the worker is responsible for his/her own transport back to his/her hometown.

    Terms and Conditions: 

    By signing this contract, the worker accepts the terms, conditions of employment, rules and code of conduct of both the farm and Khulani.
