    By using the services provided by Anita’s Medical Courier and Delivery Service (“we,” “us,” “our,” or “Courier”), you (“Client,” “you,” or “your”) acknowledge and agree to the following Terms of Use and Liability Disclaimer. Please read them carefully.

    1. Nature of Services
    Anita’s Medical Courier and Delivery Service is an independent, private medical courier that provides the pickup and delivery of medical-related materials, including but not limited to:

    • Medical specimens
    • Laboratory samples
    • Prescription medications (non-narcotic only)
    • Medical records
    • Medical supplies and equipment
      We are not a medical provider, pharmacy, or diagnostic service and make no clinical interpretations or determinations.

    2. Certifications and Standards
    Anita’s Medical Courier and Delivery Service is trained and certified in:

    • Bloodborne Pathogens Handling
    • OSHA Compliance
    • HIPAA Awareness and Confidentiality
    • All deliveries are handled with care, discretion, and in accordance with applicable industry standards for safety and privacy.
    • TWIC card. TWIC cards are issued by the Transportation Security Administration (TSA) and the U.S. Coast Guard. They serve as a tamper-resistant biometric credential that provides access to secure areas of maritime facilities and vessels. While originally designed for maritime workers, the application of TWIC cards has expanded to other sectors requiring high security, including medical supply transportation. These credentials verify the identity of transportation workers through rigorous background checks and biometric data such as fingerprints and facial recognition. This ensures that only individuals with verified credentials and a clean security background can access and handle sensitive materials. Thus, TWIC cards significantly enhance the security protocols in the transportation of medical supplies.

    3. Client Responsibilities
    The Client is responsible for:

    Ensuring all items for transport are properly sealed, labeled, and compliant with applicable federal and state regulations.

    Informing the Courier of any time-sensitive or temperature-sensitive requirements in writing.

    Confirming that items do not include illegal substances, hazardous materials (outside scope of training), or improperly packaged biohazards.

    We reserve the right to refuse any transport if it appears unsafe, unlawful, or outside our area of certification.

    4. Limitation of Liability
    By using our services, you acknowledge and accept the following limitations:

    No Guarantee of Delivery Time: While every effort is made to deliver items promptly, we are not liable for delays due to traffic, weather, accidents, law enforcement stops, or other unforeseeable events.

    No Responsibility for Improper Packaging: We are not liable for leaks, breakage, or contamination of any item not properly sealed, packaged, or prepared by the sender.

    Not Liable for Indirect or Consequential Loss: We are not responsible for any indirect, incidental, or consequential damages, including but not limited to, loss of business, lab test delays, or harm resulting from delayed deliveries.
    Maximum Liability: Our liability for any loss or damage related to a delivery shall not exceed the amount paid for that specific courier service.

    5. Confidentiality and HIPAA Compliance
    We take your privacy seriously. To the extent applicable, we adhere to HIPAA confidentiality protocols. All medical records and protected health information (PHI) are handled with care and discretion.

    6. Indemnification
    You agree to indemnify, defend, and hold harmless Anita’s Medical Courier and Delivery Service, its owner, and any agents from and against any claims, losses, damages, or liabilities (including attorney's fees) arising from:

    Improper packaging or labeling of materials
    Non-disclosure of hazardous or sensitive contents
    Use of the courier service for unlawful purposes
    Violation of any applicable law or regulation, uninsured contents by client medical facility.

    7. Service Refusal and Termination
    We reserve the right to refuse or discontinue services at our sole discretion if:

    Items are non-compliant with safety or regulatory standards
    The client fails to provide accurate information
    Delivery conditions are deemed unsafe or inappropriate

    8. Governing Law
    These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of laws principles. Any legal action or proceeding shall be filed in the appropriate court in Bexar, Texas.

    10. Anita’s Medical Courier Service includes a Chain of Custody form for every delivery to ensure accuracy, accountability, and compliance. This form requires each step of the transfer to be documented with handwritten signatures, printed names, and time stamps.

    Once completed, the form is promptly scanned and emailed to all involved parties for their records.

    CANCELLATION & LATE CHARGE DISCLAIMER
    To maintain timely service and fairness to all clients, Anita’s Medical Courier and Delivery Service has the following cancellation and late fee policies in effect:

    CANCELLATION POLICY
    We understand that plans may change. In the event of a cancellation, the following terms apply:

    Advance Cancellations:
    If you need to cancel a scheduled pick-up, please notify us as soon as possible via both:

    Cancellation Before Courier Is En Route:
    No fee will be charged if cancellation is made before the courier is en route to the pickup location.

    Cancellation While Courier Is En Route:
    If the courier is already in transit to the pickup location at the time of cancellation, a 15% cancellation fee based on the total agreed service price will be charged.

    Cancellation After Item Has Been Picked Up:
    If the courier is already in possession of the item/package, a turnaround fee of 50% of the total service price will be charged to return the item promptly to the sender.

    All cancellations must be submitted in writing by both email and text message.

    Verbal cancellations are not accepted.

    LATE CHARGE POLICY
    To ensure reliable scheduling for all clients, the following late charge policy applies:

    Grace Period:
    The courier will allow a 15-minute grace period at the pickup location if the package or item is not immediately ready.

    Late Charges:
    After the 15-minute grace period:

    A $25 late charge will be applied for every 15-minute block the courier waits up to 30 minutes after the grace period for a total wait time maximum of 45 minutes and late charge maximum of $50. After 30 total minutes outside the grace period the courier may leave to avoid disruption of other scheduled deliveries.

    A new pickup time will need to be scheduled, and additional service charges may apply.
