I agree to WAIVER, RELEASE, & INDEMNIFICATION I understand and acknowledge the YMCA’s activities have inherent risks including, but in no way limited to, the risks of moderate and severe personal injury, property damage, death, and disability, and I hereby assume, the undersigned, on behalf of myself and any dependent(s) and guests, including any minors, acknowledge and agree that the YMCA of Delaware, its officers, directors, employees, volunteers, agents and representatives (“Releasees”) will not be liable for any personal injury, property damage, disability, or death incurred by myself, my family members, dependents, or guests, including minors, however occurring including, but in no way limited to, the negligence of Releasees. I understand that I will be solely responsible for any loss or damage, including personal injury, property damage, disability, or death sustained from the use of YMCA facilities an participation in YMCA activities and programs. I further agree, on behalf of myself and any and all legal successors, assigns and proxies to release and HEREBY DO RELEASE, WAIVER AND COVENANT NOT TO SUE Releasees from any causes of action, claims, suits, liabilities or demands of any nature whatsoever including, but in no way limited to, claims of negligence, which I and any and all legal successors, assigns and proxies may have, now or in the future, against Releasees on account of personal injury, property damage, disability, death or accident of any kind, arising out of or in any way related to the use of YMCA facilities or participation in YMCA activities and programs, whether that participation is supervised or unsupervised, however the injury or damage occurs including, but in no way limited to, the negligence of Releasees. I further agree to INDEMNIFY AND HOLD HARMLESS Releasees from any and all causes of action, claims, including claims of negligence, demands, losses, suits, liabilities or costs of any nature whatsoever arising out of or in any way related to the use of YMCA facilities or participation in YMCA programs or activities by myself, my family members, dependents or guests, including any minors any claims or injury sustained during the use of any YMCA property or participation in YMCA programs or activities, however such claims or injuries arise, whether due to the negligence of the YMCA, its officers, directors, employees, volunteers, agents and representatives or otherwise. COVID-19 Assumption of Risk Exposure to COVID-19 is an inherent risk in any public location where people are present; we cannot guarantee you will not be exposed during your visit to our facilities or participation in our programs. The CDC advises that older adults, people who are unvaccinated for COVID-19, and people of any age who have serious underlying medical conditions might be at higher risk for severe illness from Coronavirus. All attendees should evaluate their own risk in determining whether to participate in YMCA programming or events. People who show no symptoms can spread Coronavirus if they are infected, and any interaction with the general public poses an elevated risk of being exposed to Coronavirus. By attending or participating in a YMCA program or event, you acknowledge and agree that you assume these inherent risks for yourself and your child(ren).By participating in the YMCA Nationwide Membership Program, I agree to release the National Council of Young Men's Christian Associations of the United States of America, and its independent and autonomous member associations in the United States and Puerto Rico, from claims of negligence for bodily injury or death in connection with the use of YMCA facilities, and from any liability for other claims, including loss of property, to the fullest extent of the law. The YMCA conducts regular sex offender screenings on all members, participants, and guests. If a sex offender match occurs, the YMCA reserves the right to cancel membership, end program participation, and remove visitation access. For my participation in activities to be conducted by YMCA of Delaware, I hereby give my permission and&#13;&#10;consent, now and for all time, to YMCA of Delaware, the National Council of Young Men’s Christian&#13;&#10;Associations of the United States of America (YMCA of the USA) and third parties collaborating with YMCA of Delaware and/or YMCA of the USA to make, reproduce, edit, broadcast or rebroadcast any video film, footage, sound track recordings and photo reproductions of me and/or my narrative account of my experience at YMCA of the USA, for publication, display, sale or exhibition thereof in promotions, advertising and legitimate business uses without any compensation to, and/or claim, by me.
