Assumption of Risk
I attest for myself and any minor children for whom I am parent, legal guardian, or otherwise responsible for, hereby acknowledge and understand that participation in activities involving horses, including but not limited to riding, grooming, feeding, handling, leading, observing, and participating in sessions carries inherent risks.
These risks include, but are not limited to:
- Falling, being kicked, bitten, stepped on, or thrown by a horse
- Equipment failure, such as saddle or tack malfunction
- Unpredictable horse behavior, regardless of training or experience
- Environmental hazards, including uneven terrain, weather conditions, and interaction with other animals
I voluntarily assume all risks, known or unknown, associated with participating in these activities and accept full responsibility for any personal injury, emotional distress, property damage or loss which may occur to me and any minor children for whom I am parent, legal guardian, or otherwise responsible for.
Release of Liability
I attest for myself and any minor children for whom I am parent, legal guardian, or otherwise responsible for, that I understand sessions at Ten of Cups Family Farm, LLC, provided by Landrie Ward, involve interactive activities with horses and understand that there is a risk in riding and being near live animals. I further acknowledge that my/our participation in this activity is purely voluntary. I assume full responsibility for myself and any minor children for whom I am parent, guardian or otherwise responsible for, for any bodily injury, accident, illness, paralysis, death, loss of personal property and expenses thereof as a result of any accident which may occur while I/we participate in the horse horse lessons today and hereafter at future lessons.
By signing this document, I/we further agree to abide all safety instructions that are provided verbally or in writing, while I/we are participating in the horseback riding activity.
Acknowledgement of Rules
I/We agree to abide by all rules listed below and instructions provided by Ten of Cups Family Farm, LLC and Landrie Ward and understand that failure to follow safety guidelines may result in dismissal from activities without a refund.
I/We agree to:
- Wear appropriate safety gear, including a helmet, when riding horses
- Listen to and follow instructions from staff and volunteers
- Treat all horses and animals with respect and care
- Notify staff immediately if I feel uncomfortable or unsafe at any time
Release and Waiver of Rights
I hereby release Landrie Ward, Ten of Cups Family Farm, LLC, its officers, directors, employees, agents, landlords, lessees, and affiliates (collectively referred to as "Released Parties") from all liability, claims, demands, causes of action, and legal actions, whether known or unknown, anticipated or unanticipated, that arise out of or are in any way connected with the participation of animals at Ten of Cups Family Farm, LLC.
Miscellaneous
This waiver and release are intended to be as broad and inclusive as permitted by the laws of the state in which Ten of Cups Family Farm, LLC operates, and if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Acknowledgment
This document waives important legal rights. Read it carefully. By signing below, I acknowledge having read and understood this Liability Waiver and agrees to be bound by its terms.
