    Injury from Welding Process: The Customer understands that the welding process may result in burns, infections, or other heat-related injuries. Allergic Reactions: The Customer acknowledges the possibility of allergic reactions to the materials used in the jewelry. Loss or Damage to Jewelry: The Customer accepts the risk of potential loss or damage to the jewelry during or after the welding process. Skin Irritation: The Customer is aware that wearing the jewelry may cause skin irritation or other dermatological issues. Cutting Circulation: The Customer understands that if a bracelet is welded on too tightly, it could cause swelling, circulation problems, or nerve damage.

    3. Assumption of Risk The Customer voluntarily assumes all risks associated with the welding process and the wearing of permanent jewelry. The Customer agrees that the Provider shall not be liable for any injuries, allergic reactions, loss, damage, or skin irritation that may occur.

    4. Release of Liability The Customer releases and discharges the Provider, its employees, agents, and representatives from any and all claims, demands, or causes of action arising out of or related to the welding process and the wearing of permanent jewelry, to the extent permitted by law.

    The Customer agrees to indemnify and hold harmless the Provider from any claims, damages, or expenses, including attorney's fees, arising from the Customer's use of the Provider's services.

    6. No Refund Policy The Customer acknowledges that there is no refund for services rendered, unless the Provider decides otherwise, even in the event of injury or damage.

    7. Customer Responsibilities The Customer is responsible for maintaining hygiene, keeping the area on the body clean, and cleaning and maintaining the jewelry.

    8. Limitation of Liability The Provider is not liable for damage to jewelry provided by either the Provider or the Customer. The Provider is not liable for defective or misrepresented products, including claims regarding descriptions such as "hypoallergenic", "gold", or "won't tarnish". The Provider is not liable for sparks from welding that may damage a customer's clothing, purse, or accessories. The Provider is not liable for unlicensed or improper business practices, including not having proper sanitation or using unclean tools.

  • 9. Governing Law This Waiver shall be governed by and construed in accordance with the laws of the state in which the Provider

    10. Severability If any provision of this Waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

    11. Entire Agreement This Waiver constitutes the entire agreement between the parties and supersedes any prior agreements or understandings, whether written or oral.

    12. Signature By signing below, the Customer acknowledges that they have read and understood this Waiver and agree to be bound by its terms.

  • Parent/Guardian Consent for Permanent Jewelry Services to a Minor

    This Consent and Release Form ("Agreement") is made between the service provider ("Provider") and the legal parent or guardian ("Guardian") ("Minor") Minor to receive permanent jewelry services from the Provider.

    Acknowledgment of Procedure and Risks The Guardian acknowledges and understands that the process of welding jewelry involves specific procedures and risks, including but not limited to: Use of Welding Equipment: A small electrical weld is used to close a jump ring, creating permanent jewelry that is not easily removed. Burns or Minor Injuries: Although rare, the welding process could result in minor burns or skin irritation. Allergic Reactions: The materials used may cause allergic reactions depending on individual sensitivities. Swelling or Circulation Issues: Jewelry that is too tight may cause discomfort, swelling, or circulation problems. Need for Removal by Cutting: In the event the jewelry needs to be removed, it must be cut using snips or similar tools.

    Assumption of Risk The Guardian voluntarily assumes all risks on behalf of the Minor associated with the welding process and the ongoing wearing of permanent jewelry. The Guardian acknowledges that the Minor is participating in this service voluntarily.

    Release of Liability The Guardian hereby releases and discharges the Provider, its employees, agents, and affiliates from any and all claims, damages, or liabilities that may arise from the Minor's participation in the permanent jewelry service, to the fullest extent permitted by law.

    The Guardian agrees to indemnify and hold harmless the Provider from any legal claims, costs, or liabilities resulting from the Minor's participation in the procedure.

    No Refund Policy The Guardian acknowledges that services rendered are non-refundable, including in cases of discomfort, allergic reaction, or if the jewelry must later be removed.

    Responsibility for Care The Guardian agrees to help the Minor maintain proper hygiene and care for the jewelry and the surrounding skin area to prevent irritation or other issues.

    Governing Law This Agreement shall be governed and interpreted in accordance with the laws of the state in which the Provider

    Severability If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

  • Entire Agreement This document represents the entire understanding between the Guardian and the Provider with respect to the Minor's permanent jewelry services.

    Consent and Signature By signing below, the Guardian affirms that they are the legal parent or guardian of the Minor, have read and understood this Agreement, and grant full permission for the Provider to perform the permanent jewelry service.
