AND RETURNED TO THE ITA

In exchange for my participation in the 2025 ITA Cup being held at the Rome Tennsi Center, October 16-19,2025 (the “Event”), I acknowledge the risks associated with participating in the Event and/or any event staged in connection therewith. I accept those risks voluntarily and hereby for myself, and on behalf of my heirs and legal representatives, release and discharge the Intercollegiate Tennis Association, Inc., (“ITA”), its employees, agents, contractors, sponsors, and assignees, of and from any and all claims and demands of every kind, nature and character for any loss, injury, damage, which I may suffer or sustain, by negligence or otherwise, to the fullest extent permitted by law in connection with any aspect of the Event, including but not limited to any action and/or decision taken regarding the conduct of any matches.

In consideration of being allowed to participate in the Event, I acknowledge, appreciate, and agree that: (1) I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE AND HOLD HARMLESS the ITA; its officers, officials, agents, and/or employees; other participants; sponsoring entities; sponsors; advertisers; and if applicable, the owners and lessors of any premises used to conduct the event (collectively, the “RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law; (2) Participation in the Event includes possible exposure to and illness from infectious diseases, including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and (3) I willingly agree to comply with the stated and customary terms and conditions for participation regarding protection against infectious diseases. If, however, I observe any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest ITA representative immediately.

In consideration of the acceptance of my entry, I hereby agree to abide by all applicable rules, regulations and codes of the ITA and the Event, including but not limited to the Tournament Referee, or his/her designee, who will have the authority to take any action he/she deems necessary in the interests of the Event, including but not limited to defaulting a player, without any resulting liability for any of the RELEASEES.

I acknowledge and understand that players are strictly prohibited from taking motion pictures, still pictures, sound recordings and any other reproductions of any description in the locker rooms. I am aware of and accept that: (1) I am strictly prohibited, directly or indirectly through others, from wagering anything of value in connection with the Event; (2) I am strictly prohibited, directly or indirectly through others, from offering or receiving anything of value to or from any person with the intent to influence any Player’s efforts in the Event; and (3) any violation of these regulations will subject me to severe penalties including but not limited to suspension from play in all ITA events.

I am aware of and accept that: (1) the Event is subject to extension and/or cancellation, in whole or in part, due to a force majeure or other events as determined by the ITA in its sole discretion; and (2) the ITA reserves the right, in its sole discretion, to cancel in whole or in part, for whatever reason the Event.

I hereby grant and license to the ITA and its successors and assigns and its and their employees, contractors and agents (ITA and all such persons and entities referred to as “Licensees”), without further consideration and in perpetuity, the right to display, publicly perform, exhibit, transmit, broadcast, reproduce, record, photograph, digitize, modify, alter, edit, adapt, create derivative works, exploit, sell, rent, license, otherwise use, and permit others to so use, throughout the universe in any medium or format whatsoever now existing or hereafter created, my name, voice, likeness, appearance, signature, and biographical material, sports/playing and other statistics that may or may not be identifiable to me, my participation in the Event or any other events, and all materials created by or on behalf of ITA that incorporate any of the foregoing (“Materials”) for the purpose of publicizing, packaging, promoting, reporting on, and advertising the ITA and its successors and assigns, and its and their related parties and/or affiliates, including but not limited to as relates to the Event and/or other events that may relate to the Event (including but not limited to such use of such licensed rights in connection with televising, broadcasting, videoing, recording, and/or filming of the Event) (all the rights licensed above and hereby, the “Licensed Rights”).
I understand that ITA shall be the exclusive owner of all Licensed Rights, including copyright, in the Materials. I hereby irrevocably transfer, assign, and otherwise convey to ITA my entire present and future right, title, and interest, if any, in and to the Materials and all copyrights and other intellectual property rights in the Materials arising in any jurisdiction throughout the universe in perpetuity, including all registration, renewal, and reversion rights, and the right to sue to enforce such copyrights against infringers. I acknowledge and agree that I have no right to review or approve Materials before they are used by ITA, and that ITA has no liability to me for any editing or alteration of the Materials or for any distortion or other effects resulting from ITA's editing, alteration, or use of the Materials, or ITA's presentation of me. Any credit or other acknowledgment of me, if any, shall be determined by ITA in ITA's sole discretion. ITA has no obligation to create or use the Materials or to exercise any rights given by this Agreement.
I hereby waive any and all rights to receive payment or compensation of any kind for granting to Licensees the Licensed Rights and/or for their use and exercise of the Licensed Rights.
To the fullest extent permitted by applicable law, I hereby irrevocably waive all legal and equitable rights relating to all liabilities, claims, demands, actions, suits, damages, and expenses, including but not limited to claims for copyright or trademark infringement, infringement of moral rights, libel, defamation, invasion of any rights of privacy (including intrusion, false light, public disclosure of private facts, and misappropriation of name or likeness), violation of rights of publicity, physical or emotional injury or distress, or any similar claim or cause of action in tort, contract, or any other legal theory, now or hereafter known in any jurisdiction throughout the world (collectively, "Claims"), arising directly or indirectly from Licensees exercise of their rights under this Agreement, and whether resulting in whole or in part from the negligence of ITA or any other person, and I hereby covenant not to make or bring any such Claim against any Licensee and forever release and discharge Licensee from liability under such Claims. I understand that ITA is relying on this Agreement and will incur significant expense in reliance on this Agreement, and I agree that this Agreement cannot be terminated, rescinded, or modified in whole or in part

I understand that (1) entry by my parent, legal guardian, coach, or agent in no way diminishes the application of the above rules, and (2) I will not be allowed to participate in any competition at the Event until the entry form and this waiver have been duly signed by me. This agreement shall be construed in accordance with the laws of the State of Arizona, USA, without regard to its principles of conflicts of laws. Any dispute arising under this agreement shall be litigated in a federal or state court of competent jurisdiction located within the state of Arizona, USA.

I do hereby, for and on behalf of myself, my heirs, and my legal representatives, release and forever discharge the RELEASEES from any and all claims and demands of every kind, nature and character which I may have or may hereby acquire for any and all damages, losses or injuries which may be suffered or sustained by me in connection with my activities during the period for which such permission is granted and any period traveling to or from the Event described, and all such claims are waived and released and I covenant not to sue therefore.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK, AND I FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME. I INTEND MY ELECTRONIC AND/OR ACTUAL SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
