  • This Photography Services Agreement (“Agreement”) is entered into between:

    1. Scope of Work
    The Photographer agrees to provide photography services (“Services”) for the Client for a Senior Portrait Session

    Studio G. Photography's Yorkville Studio.


    The Services will include:

     

    One 60 minute senior portrait session (upgradable to 90 minutes and add ons available upon request)

    10 high resolution digital downloads (upgradable if increased to 90 minutes or add ons included)

    Copyright print/social media release.

    Option to purchase additional photos for $10 each or full album for discounted rate. 

     

    DATE IS TBD - Signing of this agreement and payment of retainer gives client the first choice of dates/times over future clients. 


    2. Retainer and Payment
    To secure the event/session date, the Client shall pay a non-refundable retainer of $50 upon signing this Agreement. 

    The retainer fee is applied toward the total balance and serves as consideration for the Photographer reserving the specified date and declining other work as well as all prep work and necessary related purchase. Retainers are nonrefundable under any circumstance.

    Remainder of the session fee is due 24 hour prior to session date. 

    Payments can be made via credit/debit (with a 4% service fee for credit) or via Cashapp, Venmo, or Paypal "Goods and Services".


    3. Rescheduling and Cancellation
    Two (2) reschedule due to illness, or emergency is permitted without penalty, provided that notice is given as soon as reasonably possible.  Any subsequent reschedules will require a new retainer to secure a new date. We are aware that spring weather is unpredictable, reschedules due to inclimate weather will be honored until session is complete.
    If the Client cancels the session/event entirely, all payments made are nonrefundable and liquidated assets.

    4. Cooperation and Conduct
    The Client agrees to cooperate and ensure the cooperation of all participants during the session/event to achieve the best possible results. Photographer reserves the right to end a session due to intoxication of a client, refusal to cooperate, and/or behavior that results in damage to property owned by the venue or photographer.  Photographer is not responsible for compromised coverage due to lateness, uncooperative behavior, restrictions imposed by the venue, or other circumstances beyond their control.


    5. Copyright and Usage
    All photographs and digital files created by the Photographer are protected by U.S. Copyright Law (Title 17, U.S. Code) and remain the exclusive property of the Photographer.

    The Photographer retains full copyright and ownership of all images and reserves the right to use images for portfolio, marketing, and promotional purposes (including website, social media, and printed materials), unless otherwise agreed in writing.

    The Client is granted a non-exclusive, non-transferable license for personal use of the final images. The Client may print, post, and share images for personal purposes but may not sell, edit, or distribute them for commercial use without written consent from the Photographer.


    6. Image Delivery
    The Photographer will deliver the final edited images within 7 days following the session/event. Delivery will be made via an online gallery, digital download, or other agreed-upon method.

    The Photographer retains discretion regarding the artistic style, selection, and editing of images. All editing will fall in line with the Photographer's current portfoio style. If client wants a specific editing style, this must be discussed and agreed to prior to signing this contract. Raw or unedited files will not be released.


    7. Liability
    In the unlikely event of injury, equipment failure, or other circumstances beyond the Photographer’s control that prevent fulfillment of this Agreement, the Photographer’s liability is limited to the return of all payments received. The Photographer is not liable for incidental, consequential, or punitive damages.


    8. Model Release
    A model release will be sent as a separate document, client is not obligated to agree to sharing of images, however it is highly encouraged and appreciated.


    10. Entire Agreement
    This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions and agreements. Any modifications must be made in writing and signed by both parties.


    11. Governing Law
    This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois.
