VOLUNTEER RELEASE AND WAIVER OF LIABILITY:
This Release and Waiver of Liability (the “release”) executed on the date signed below, by the Volunteer releases the West End Community Center (“WECC”) and each of its directors, officers, employees, board members, and Agents (“the releasees”). The Volunteer desires to provide volunteer services for the WECC and engage in activities related to serving as a volunteer. Volunteer understands that the scope of Volunteer’s relationship with the releasees is limited to a volunteer position and that no compensation is expected in return for services provided by Volunteer.
1. Waiver and Release: I, the Volunteer, release and forever discharge and hold harmless the releasees and its successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, known or unknown, which arise or may hereafter arise from the services I provide to the releasees. I understand and acknowledge that this Release discharges the releasees from any liability or claim that I may have against the releasees with respect to bodily injury, personal injury, illness, death, or property damage that may result from the services I provide to the releasees or occurring while I am providing volunteer services.
2. Insurance: I understand that the Releasees do not provide insurance coverage for volunteer participants and do not assume responsibility for any medical expenses or other losses that I may incur. I further acknowledge that liability protections may vary depending on my role, professional responsibilities, and volunteer placement, and that claims arising from gross negligence or intentional misconduct are not covered.
3. Medical Treatment: I hereby Release and forever discharge the releasees from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my tenure as a volunteer with the releasees.
4. Assumption of Risk: I understand that the services I provide to the releasees may include activities that may be hazardous to me. As a volunteer, I hereby expressly assume risk of injury or harm from these activities and release the releasees from all liability.
6. Photographic Release:I grant and convey to the West End Community Center (“WECC”) and its representatives, agents, successors, and assigns all rights, title, and interest in any and all photographs, video or audio recordings, or other media containing my image, likeness, or voice, taken in connection with my participation in volunteer activities. I understand and agree that these materials may be used for any lawful purpose, including but not limited to promotional, publicity, educational, or fundraising materials, such as websites, social media, brochures, newsletters, or other publications, without further notice or compensation to me.
7. Other: As a volunteer, I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Massachusetts and that this Release shall be governed by and interpreted in accordance with the laws of the Commonwealth.
I HAVE CAREFULLY READ THIS RELEASE AND WAIVER OF LIABILITY, FULLY UNDERSTAND ITS TERMS, AND SIGN IT VOLUNTARILY AND OF MY OWN FREE WILL. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING MY RIGHT TO SUE.
I agree that if any clause or provision of this Release is found to be invalid or unenforceable under the law, the remaining provisions shall remain in full force and effect. By signing below, I affirm my understanding and express my intent to be legally bound by this Release. This waiver shall be effective as of the date signed and shall apply to all volunteer activities I undertake for the West End Community Center from that date forward, until the completion of my volunteer service.
