SECTION 1 - HEALTH CERTIFICATE
- The Breeder ensures that the puppy is in good health at the time of pickup or delivery. All puppies have been dewormed and have received age-appropriate vaccinations administered by our SBE-licensed veterinarian. The Breeder will provide the Buyer with a health record detailing all vaccinations and deworming completed. Upon arrival, the Buyer may examine the puppy to confirm its current good health. Once the puppy is released, the Buyer agrees to accept the puppy in its present condition. If the puppy is found to have a serious life-threatening condition, the Breeder will provide the Buyer with a replacement puppy of equal quality from another litter when available.
SECTION 2 - VET CHECKUP
- The buyer must arrange a check-up by a licensed veterinarian within 2 business days of receiving the puppy. During this initial exam, if the veterinarian detects a genetic defect threatening the puppy's life, the buyer must contact the seller immediately, and a replacement puppy will be provided. Refunds are not offered. The breeder is obligated to provide a replacement only if all protocols were followed and the check-up occurred within the 2-business-day timeframe. If the puppy is found to have been mishandled, this health guarantee is voided, as the breeder cannot control the puppy's care after leaving their possession.
If the licensed vet diagnoses a life-threatening genetic defect during the initial exam, the buyer must return the puppy within 7 days of the exam, along with the veterinary report. The buyer is responsible for returning the puppy and all related belongings (registration paperwork, health record, puppy package) to the seller. Any missing items must be replaced at the breeder’s cost. If the puppy passes away before the initial exam or return, the buyer must provide a necropsy report from a veterinary pathologist to confirm the cause of death, which must be solely due to a congenital defect. The buyer is responsible for all medical fees, including necropsies and any care required while the puppy is in their possession.
The buyer must notify the breeder immediately if the puppy shows signs of illness or poor eating habits before the initial vet exam, within 12-24 hours. Failure to complete the initial vet check within 2 business days or to notify the breeder of any health concerns—such as illness, poor eating, lack of playfulness, or sudden changes in the puppy’s health or appearance—before the initial exam will void the health guarantee.
SECTION 3 - HEALTH GUARANTEE EXCLUSIONS
- Not covered: Minor congenital defects, internal or external parasites, hernias, cryptorchidism (undescended testicles), low-grade heart murmurs, underbite or overbite, injuries, allergies, heat exhaustion, conditions related to environment or care, behavioral issues, dietary changes, or hypoglycemia, as these are common in young puppies with immature immune systems. We do NOT cover luxating patellas or collapsing trachea. Luxating patellas, which are NOT covered, may result from overworking the joint in the first year and can lead to patella injuries. Collapsing trachea, also NOT covered, may occur due to collar use or mishandling near the neck or collar area. Legg-Calvé-Perthes disease, minor moleras, hip dysplasia, and cleft palate are NOT covered. Although the cause of cleft palate is unknown, it may have a genetic component influenced by trauma or certain hormones. The Buyer waives all liability related to the conditions listed in Section 3. Under no circumstances will the Buyer receive a refund for these conditions. Additionally, Coccidia, Giardia, hookworm, whipworm, or any parasites, as well as mites, fleas, ticks, or other external parasites, are NOT COVERED. The Buyer acknowledges and agrees to the NOT Covered agreement.
SECTION 4 - QUALITY
- All dogs or puppies sold with breeding rights are not guaranteed to be of "breeding quality." Features such as hernias, low-density coats, and other potential undesired physical traits depend on breeding decisions and personal opinions. Buyers will not receive refunds or replacements under any circumstances. All of our puppies are primarily sold for love and companionship; if breeding rights are granted, it is the new owner's choice to proceed with breeding. We provide breeding rights to only a select few of our puppies, as not all dogs are suitable for breeding due to size or other physical factors. Size, color, or any other desired traits are not guaranteed. Pricked ears and eye colors are also not guaranteed.
SECTION 5 - HEALTH GUARANTEE INCLUSIONS
- HEREDITARY DEFECTS: If a puppy is diagnosed with a life-threatening hereditary defect, it will be replaced with one of equal value as soon as one becomes available, with the value determined by the Breeder/Seller. All registration papers provided to the Buyer must be signed into the Breeder's name and returned to the Breeder to maintain the validity of the health guarantee. The Buyer is responsible for all transportation related to the puppy. Euthanasia of the puppy without prior written approval from the Breeder will void this guarantee; approval may be provided via text or email, accompanied by a reply from the Breeder. The following conditions are not considered life-threatening hereditary defects and are not covered: hernia, parasites, undescended testicle, and under/over bites (as per Section 3 of the health guarantee under exclusions). The Buyer acknowledges that the replacement option applies only to health issues solely attributed to a hereditary defect, not to congenital defects (present at birth), accidents, or injuries. In the event of sudden death, a necropsy must confirm that the death resulted from a hereditary genetic issue to qualify for a replacement puppy. If the necropsy is inconclusive, further blood testing may be necessary to determine the cause of death, with all related testing costs borne by the Buyer. Failure to follow the veterinarian's recommended medical advice or treatment while the puppy is in the Buyer's care will render this health guarantee void.
SECTION 6 - HEALTH GUARANTEE ON CONGENITAL DEFECTS
- The Buyer acknowledges the distinction between hereditary and congenital defects. Hereditary defects are inherited from a parent's genetic profile, while congenital defects are present at birth and may arise during cellular division, sometimes resulting in structural issues. These defects are not inherited traits. Breeders provide proper nutrition and environment to reduce the risk of congenital defects, though complete prevention is impossible. Structural defects can cause major organ malfunction. The Buyer accepts responsibility for veterinary costs to determine the presence of hereditary or congenital defects. The Seller guarantees the puppy against life-threatening congenital defects, offering a replacement puppy of equivalent value, determined by the Seller, as soon as available. For non-life-threatening congenital defects, no replacement or financial assistance for medications will be provided. The Buyer releases the Seller and its owners from liability for care related to non-life-threatening hereditary or congenital defects. The Seller's obligation is limited to providing a replacement puppy of the same value as outlined in this agreement.
SECTION 7 - VETERINARY DIAGNOSIS
- Veterinarians may have differing medical opinions. Therefore, the Breeder reserves the right to select a veterinarian to examine the dog and confirm the diagnosis provided by the Buyer’s veterinarian. If the Breeder requests the dog to be seen by a specific veterinarian, the Breeder will cover the cost of the examination and any approved tests or procedures.
SECTION 8 - SHIPPING
- If the Breeder approves shipping, arrangements will be coordinated between the Breeder and the Buyer. Once the Breeder transfers the puppy to the transport personnel, the Buyer assumes full responsibility for the puppy, both physically and financially. At this point, the Breeder’s obligation to deliver the puppy to the designated transport personnel is fulfilled.
SECTION 9 - FULFILLMENT OF HEALTH GUARANTEE
- This health guarantee applies only to the original owner listed as the Buyer in this contract and is non-transferable. To invoke the guarantee, the puppy or dog must be returned to the Breeder along with any registration papers. Refunds are not provided under any circumstances; instead, a replacement puppy of equal value will be offered as soon as possible. The Breeder will determine the value of the replacement puppy. Shipping costs for both the replacement puppy and the return of the original puppy are the Buyer’s responsibility. The Breeder may choose to reimburse the return shipping costs if the defect is confirmed to be entirely hereditary and life-threatening, provided the Buyer is fully transparent with all health records. This decision, however, remains at the sole discretion of the Breeder.
SECTION 10 - CARE OF PUPPY
- The buyer agrees that the puppy is not being purchased for resale and will remain under their personal care and supervision. The puppy will be provided with appropriate housing, food, and veterinary care, and will not be mistreated, neglected, or allowed to roam freely. If the buyer is unable to keep the puppy, they agree not to surrender it to a shelter, humane society, or rescue group and will make every effort to find a suitable new home. If a suitable home cannot be secured, the puppy must be returned to the breeder.
SECTION 11 - BREEDING RIGHTS
- Registration papers will only be provided if the buyer purchases breeding rights. If breeding is not intended, papers will not be issued until proof of spay or neuter is supplied. The breeder may provide copies of the parents' registration papers to confirm the puppy's purebred lineage. The guarantee becomes void if the dog, sold as a pet, is bred intentionally or accidentally with any dog, including those owned by the buyer. The buyer must prevent accidental breeding of the puppy under this contract unless a $10,000 breeding fee is paid. In the event of intentional or accidental breeding, a $10,000 fine must be paid to the breeder, and no registration papers will be issued after the fine is resolved. This fine must be paid within 30 days of notice from the breeder via text, email, or written communication. Failure to pay within 30 days will result in legal action in the buyer's county, and the buyer agrees to cover filing fees, service fees, and attorney fees related to the lawsuit filed at the county courthouse.
SECTION 12 - FINANCIAL RESPONSIBILITY FOR CARE
- The buyer assumes all veterinary costs and any other expenses related to the puppy and waives any claims or costs against the breeder. The buyer acknowledges that the full payment is due at the time of picking up the puppy or before delivery to the transport personnel.
SECTION 13 - NO SIZE GUARANTEE
- While we use all available predictors to estimate the adult weight of the puppy, we do not accept returns or offer refunds if the puppy becomes too large or too small. The buyer agrees not to seek any form of compensation regarding the puppy's adult weight.
SECTION 14 - FAILURE TO PICK UP
- The buyer agrees to pick up their puppy by 12 weeks of age unless otherwise arranged. If the puppy is not picked up by 12 weeks or the agreed-upon date, a $25 per day boarding fee will be charged. The breeder reserves the right to sell the puppy to another person at any time after the first missed pick-up date. The breeder may place the buyer on the waiting list or suggest working with another breeder. The waiting list payment will not be refunded. The breeder also reserves the right to deduct the $25 per day boarding fee from any amounts already paid, starting from the first calendar day following the missed pick-up.
SECTION 15 - MUTUAL NON-DISPARAGEMENT
- The Buyer agrees not to publicly make negative statements or communications about The Breeder, including its agents, products, members, directors, or officers. Public communications encompass electronic platforms. Similarly, the Seller (including its agents, members, directors, and officers) agrees not to publicly make negative or disparaging statements or communications about the Buyer. This clause does not apply when statements and evidence are required as part of legal proceedings, where both parties have agreed to resolve a dispute beyond the scope of this contract, including but not limited to court filings, depositions, and hearings.
SECTION 16 - FINANCIAL RESPONSIBILITY FOR HEALTH CARE
- The Breeder strongly recommends that the Buyer obtain health insurance for their puppy. Veterinary costs can be significant, particularly when diagnosing or treating an illness. This recommendation is made because puppies' immune systems are still developing and beginning to function independently at 7-8 weeks old, making them vulnerable to various viruses, parasites, and illnesses at this stage. Health insurance may help cover some costs if a diagnosis is needed to fulfill the health guarantee and obtain a replacement puppy. The Buyer acknowledges this recommendation.
