E-Growth – Learner Terms and Conditions

This document outlines the Learner Terms and Conditions ("Terms") govern your access to and use of E-Growth’s services, including our website, mobile applications, courses, training materials, content, and related features (collectively, the "Services"). By registering as a learner, accessing our courses, or using our Services, you agree to be bound by these Terms, which form a binding legal agreement between you, the learner, and E-Growth.

Acceptance of Terms

·        Acceptance: By using our Services, you acknowledge that you have read, understood, and agreed to these Terms.

·        Eligibility: You must be at least 18 years of age or have legal parental or guardian consent to agree to these Terms and use our Services.

·        Amendments: E-Growth reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Services after any such changes indicates your acceptance of the new Terms.

 

Learner Registration and Account Creation

·        Account Creation (E-learning): To access certain features of our Services, you must register and create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

·        Account Responsibility: You are responsible for safeguarding your account, including maintaining the confidentiality of your account credentials and for all activities that occur under your account.

 

Course Enrollment and Access 

·        Enrollment: Enrollment in a course is subject to acceptance by E-Growth after a detailed Learner Application Form has been filled by the learner and may require payment of a fee. As a prerequisite, the learner is also required to fill a  Learner Evaluation Questionnaire Form that would gauge the learning capacity and prior knowledge skillset of the learner.

·        Access Upon enrollment and payment (if applicable), E-Growth grants you a limited, non-exclusive, non-transferable license to access and view the courses and associated content for your personal, non-commercial use only. This is only applicable if the learner opts for e-learning mode of study.

·        Course Availability: E-Growth reserves the right to modify, update, or discontinue any course or content at any time.

 

Payments, Refunds, and Cancellations

·        Fees: Some of our Services, including course enrollment, may require payment of fees. All fees are payable in the currency specified by E-Growth and are non-refundable, except as specifically provided in these Terms.

·        Refunds: If you are dissatisfied with a course and wish to request a refund, you must submit a request within 14 days of the course purchase. Eligibility for refunds may be subject to certain conditions. The refunds will be processed in line with the principles set out by the accreditation provider and based on local laws applicable.

·        Cancellations: E-Growth reserves the right to cancel any course at any time. In the event of cancellation by E-Growth, registered learners may be offered a refund or alternative arrangements.

 

Intellectual Property Rights

·        Ownership: All Services, including course content, are the property of E-Growth or its licensors and are protected by copyright and other intellectual property laws.

·        License to Learners: E-Growth grants you a personal, non-exclusive, non-transferable license to access and use the Services and course content for your personal, non-commercial purposes only.

·        Restrictions: You may not reproduce, distribute, publicly display, or perform the Services or any content therein without the express permission of E-Growth.

 

User Conduct

·        Prohibited Activities: You agree not to engage in any activity that would disrupt the Services or the learning experience of other users, including but not limited to cheating, harassment, or the dissemination of spam.

·        Compliance with Laws: You agree to comply with all applicable laws, regulations, and codes of conduct in your use of the Services and interaction with other users.

Disclaimers and Limitation of Liability

·        No Warranties: The Services are provided "as is" without warranties of any kind, either express or implied. E-Growth does not guarantee that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis.

·        Limitation of Liability: E-Growth shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your access to or use of the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory.

 

Dispute Resolution

·        Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of Kingdom of Saudi Arabia in which E-Growth operates, without regard to its conflict of law principles.

·        Arbitration: Any disputes arising out of or in connection with these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of an agreed-upon arbitration body.

 

General Provisions

·        Entire Agreement: These Terms constitute the entire agreement between you and E-Growth regarding your use of the Services.

·        Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.

·        Waiver: The failure of E-Growth to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

E-Growth – Learner Agreement

This Learner Agreement is made between E-Growth (Economy Growth Company Est), hereafter referred to as "the Provider," and the undersigned learner, hereafter referred to as "the Learner." The purpose of this agreement is to outline the terms and conditions for enrollment and participation in the Health, Safety, and Environment (HSE) training courses and other qualifications provided by E-Growth.

 

Responsibilities of the Provider

E-Growth agrees to:

-        Provide high-quality training and educational materials necessary for the completion of the course.

-        Ensure that instructors are qualified and experienced in the relevant field.

-        Provide a safe and conducive learning environment.

-        Offer guidance and support throughout the course duration.

-        Assess learner performance fairly and impartially.

-        Ensure that the learner is registered for the final assessment with the awarding body and issue a certificate of completion upon successful fulfillment of course requirements.

Responsibilities of the Learner

The Learner agrees to:

-        Attend all scheduled classes and training sessions punctually.

-        Complete all assignments, assessments, and examinations as required by the course.

-        Maintain a high level of participation and engagement during the course.

-        Abide by all policies and regulations set forth by E-Growth.

-        Respect the rights and property of fellow learners and the Provider.

-        Pay all course fees in full and on time as per the agreed payment schedule.

Attendance and Punctuality

-        The Learner must attend a minimum of 90% of the course sessions to be eligible for registration of final assessment and certification.

-        Absences must be communicated in advance and justified with appropriate documentation.

-        Repeated tardiness or unexcused absences may result in dismissal from the course.

Code of Conduct

-        The Learner shall conduct themselves professionally and respectfully at all times.

-        Any form of harassment, discrimination, or disruptive behavior will not be tolerated.

-        The Learner must adhere to the health and safety policies of E-Growth (ref: EG-HSEP-MP-001)

Assessment and Certification

-        The Learner will be assessed through a combination of assignments, tests, practical exercises, and/or examinations.

-        The criteria for passing the course will be clearly communicated at the beginning of the course. Learner would also be provided with necessary references from the awarding body as and when required.

Fees and Payment

-        The total course fee is [Amount needs to be mentioned at the end of this agrrement] and must be paid by [Payment Due Date Need to select according to the selected batch].

-        Payment plans may be available upon request and must be agreed upon in writing.

-        Failure to pay the course fees may result in suspension or termination of enrollment.

 

Termination and Refund

-        The Learner may withdraw from the course by providing written notice to the Provider.

-        Refunds will be processed according to the Provider’s refund policy, which will be provided upon request. Note: The refund policy would also be aligned with the policies outlined as pe the awarding body.

-        The Provider reserves the right to terminate the Learner’s enrollment for failure to comply with this agreement or for misconduct.

 

Intellectual Property (Ref: EG/CIPP/MP092024-005.1)

-        All course materials provided are the intellectual property of E-Growth and are for the Learner’s personal use only.

-        Unauthorized distribution or reproduction of course materials is prohibited.

 

Data Protection (Ref: EG/DISP/MP092024-004.1

-        E-Growth will collect and process personal data in accordance with applicable data protection laws.

-        The Learner’s personal information will be used solely for the purposes of administering the course and certification.

Limitation of Liability

-        E-Growth will not be liable for any indirect, incidental, or consequential damages arising from participation in the course.

-        The total liability of E-Growth for any claim arising out of or in connection with this agreement shall not exceed the total fees paid by the Learner.

Governing Law

-        This agreement shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.

-        Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Saudi Arabia.

Refund policy

-       If a learner wishes to withdraw from the course prior to registration with NEBOSH, the refund will be processed after deducting SAR 250/- as administration charges + additional cost depending on the no. of sessions (SAR 100/- per session) attended that also covers cost of learning material license.

-      Once the learner has been registered on the NEBOSH portal (CPI) for an examination date and if they choose to withdraw from the course, NO

Acceptance

 

By signing this agreement, the Learner acknowledges that they have read, understood, and agree to abide by the terms and conditions outlined above.

REFUND is applicable.
