LIABILITY WAIVER AND RELEASE AGREEMENT SIGNED WAIVER IS REQUIRED

FOR ENTRY. FAILURE TO COMPLETE THIS DOCUMENT WILL RESULT IN DENIAL OF PARTICIPATION.

PLEASE READ CAREFULLY - BY SIGNING THIS DOCUMENT, YOU ACKNOWLEDGE AND ACCEPT CERTAIN LEGAL RISKS, INCLUDING WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

I hereby certify that I am the legal owner or the duly authorized agent/handler of the following dog(s):

In consideration of the acceptance of this entry and the opportunity to participate in the Chase Ability (CAP) event hosted by the Manitoba Gazehound Association (MGA) on September 13 and or 14, 2025, I, the undersigned, agree to the following terms and conditions:

1. Waiver of Liability: I hereby release, waive, and forever discharge the MGA, including its directors, officers, members, volunteers, event officials, employees, agents, and the owner and/or lessor of the premises on which the event is held (collectively, the "Released Parties") from any and all liability, claims, demands, actions or causes of action, whether in law or equity, arising from any injury, illness, loss, damage, or death to any person or animal, including myself and my dog(s), or any property damage sustained in connection with or arising out of my participation in this event, whether caused by the negligence of the Released Parties or

2. Assumption of Risk: I acknowledge and fully understand that participation in canine sporting events involves inherent risks, including but not limited to: tripping, falls, animal bites, collisions, and other unforeseen events, and I voluntarily assume full responsibility for any such risks, including injury or damage resulting from such risks.

3. Indemnity Agreement: I agree to indemnify, hold harmless, and defend the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from my actions or the actions of my dog(s), including any third-party claims for injury, death, or property damage resulting from our participation in the event.

4. Loss or Injury to Dog(s): I agree that the MGA and the Released Parties shall not be held responsible for any loss, disappearance, theft, injury, or death of my dog(s), regardless of how such incidents may occur, including negligence.

5. Binding Arbitration: I agree that any dispute or claim arising out of or in connection with this waiver, participation in the event, or any related matter shall be resolved by binding arbitration in accordance with the laws of the Province of Manitoba and conducted in Manitoba, Canada. The decision of the arbitrator(s) shall be final and binding on all parties.

6. Right to Refuse Entry: I acknowledge that the MGA reserves the right to refuse any entry for any reason it deems sufficient, in its sole discretion.

I HAVE READ AND UNDERSTOOD THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT. I AM AWARE THAT BY SIGNING THIS DOCUMENT I MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

I VOLUNTARILY AGREE TO THESE TERMS.
