This website is provided by Phoenix Rising Retreats Inc. and Get Your Sexy Back (a sole proprietorship operated by Kimberly Coffin) operating in association and not as a partnership or joint venture, (collectively referred to as “PRR”, “we”, “us”, or “our”), conditional on your acceptance of the terms and conditions set out below. These Terms and Conditions (“Agreement”) apply to all users of the websites operated by PRR, including those who purchase and/or access free or paid programs, events, retreats, or services through our website(s) (individually or collectively “the Site”). By accessing, reading and making use of the Site, you agree, on your own behalf and on behalf of any entity on whose behalf you may be acting, to be bound by the Agreement. If you do not wish to be bound by the Agreement, you should not use this website.

 
1. ACCEPTANCE OF TERMS

The Site and our programs are strictly for individuals aged 18 years or older. By accessing this website and/or purchasing any product, course, or program, you confirm that you are at least 18 years of age and agree to comply with and be bound by this Agreement. If you are under 18, you are not permitted to access or use the Site or the programs.

2. PROGRAM DESCRIPTIONS

Our programs, workshops, sessions, lectures, webinars, and recordings, focus on personal development, sacred sexuality, nervous system healing, intimacy, and embodiment. They may include coaching, courses, downloadable content, webinars, workshops, and retreat access. This website and all programs/webinars are provided for educational and informational purposes only, and no guarantees or representations are made regarding future outcomes. 

3. NO GUARANTEES

We do not guarantee specific results or outcomes. Your outcome can depend on such factors as your personal commitment, energy, life circumstances, and capacity to integrate the material. We make no representations or warranties that the Site, programs, workshops, podcasts, videos, and/or recordings of same are medical or psychological treatments. If you think you may have a medical and/or psychological illness, need, condition, etc. please seek qualified care from a licensed professional in your jurisdiction.

4. PAYMENT & REFUNDS

All prices are listed in Canadian dollars unless otherwise stated. Payments are processed securely through our third-party providers. Refunds for digital programs or services are not issued unless explicitly stated at checkout. All deposits are non-refundable. Retreat and live event cancellation policies are outlined separately.

5. INTELLECTUAL PROPERTY

All content, including videos, written materials, audio recordings, methods, and branding are the intellectual property of Phoenix Rising Retreats and/or Get Your Sexy Back. You may not copy, reproduce, distribute, modify, or use our content in any way without express written permission.

6. USER CONDUCT

You agree to use our platform respectfully and in alignment with our values. We are committed to creating a safe environment for our customers, the public and ourselves. Harassment, unauthorized use of content, or disruptive behaviour in live sessions may result in access being revoked at our sole and absolute discretion without entitlement to a refund.

We are committed to creating a safe, inclusive space that honours people of all genders, identities, orientations, cultures, and backgrounds. Discriminatory language, harassment, or unsafe conduct will not be tolerated and may result in removal from our programs or community without refund. If you are unwilling to accept these consequences for your actions, deliberate or otherwise, do not use the Site.

7. MEDICAL DISCLAIMER

We are not licensed medical professionals, therapists, psychologists, counselors, psychotherapists, etc. Our programs do not substitute medical, therapeutic, or psychological advice. Please consult your licensed healthcare provider regarding your lifestyle, health, or relationships.

 By using the Site and our programming you agree that participation in any of our programs does not establish a therapist-client or healthcare professional relationship. Our programs are not a substitute for medical, psychological, or therapeutic care and are offered for educational and personal development purposes only.

8. PRIVACY POLICY

Your personal data is protected in accordance with Canadian privacy laws. We do not sell or share your information without consent. For more details, refer to our full Privacy Policy.

9. TERMINATION

We reserve the right to terminate access to any of our services or programs without refund if you violate the terms of this Agreement or other contracts you have with PRR.. 

10. LIABILITY LIMITATION

We are not liable for any direct or indirect damages resulting from your use of the Site, programs, or content. Your use is at your own risk, and you assume full responsibility for how you apply the material. By using the Site and/or programs, you agree that the maximum liability of us to you is any amount paid by you to PRR.

11. MODIFICATION OF TERMS

We may add to or remove, modify or otherwise change any part of the Agreement at any time. Changes will be effective when the changed Agreement is posted on the Site. You should check the Terms and Conditions frequently for changes by checking the date of “Last Update” at the top of this document. If any change to this Agreement is not acceptable to you, you should discontinue your use of the Site immediately. Your continued use of the Site after changes to the Agreement are posted thereon will constitute acceptance of the changes notwithstanding there may or may not be substantive consideration in exchange for changes to the Agreement. .

12. GOVERNING LAW

The Agreement shall be governed by the laws of the Province of Ontario, Canada. Any legal action or proceeding relating to the Site, this Agreement, and/or PRR must be brought exclusively in the Township of North Kawartha, County of Peterborough, Ontario. By using the Site to irrevocably attorn to this jurisdiction for any legal, quasi-legal, or administrative proceeding.

By using this website, purchasing, or enrolling in any program through the Site, you acknowledge that you have read, understood, and agreed to this Agreement. For any questions or concerns, please contact us at support@phoenixrisingretreats.com.

13. DISPUTE RESOLUTION

In the event of any dispute arising out of or relating to your use of our services, products, or website, both parties agree to first attempt to resolve the matter through good faith negotiation or third-party mediation before pursuing legal action, and that this clause can be relied on when seeking an order for specific performance.

14. TESTIMONIAL & MEDIA RELEASE

By submitting a testimonial or review, you grant us permission to use your name, likeness, and comments provided as part of the testimonial or review in our promotional materials unless you notify us otherwise in writing. You acknowledge that after withdrawing consent there will be some delay before we can modify the Site, and that PRR cannot guarantee a third party that hosts testimonials and reviews will comply with any instructions to remove or modify a testimonial or review.

15. TECHNOLOGY & ACCESS DISCLAIMER

We are not responsible for technical difficulties, connectivity issues, or platform outages that may affect your ability to access content. We reserve the right to perform maintenance or modify access without prior notice. Interruptions or degradations in quality of the Site or programs accessed electronically are an accepted risk of use the Site and/or accessing the programs electronically.  Any such interruption or degradation of quality will not be a breach or repudiation of contract by us.

16. FORCE MAJEURE

We are not liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to natural disasters, pandemics, travel restrictions, power outages, governmental orders, etc.

Phoenix Rising Retreats – Retreat Consent, Waiver & Release Agreement

IMPORTANT: This document outlines the terms and conditions for consenting to and accepting the risks of attending and participating in a Phoenix Rising Retreat (the “Retreat”) held by Phoenix Rising Retreats Inc.. It is a precondition of attending the Retreat to understand, consent to, and execute this document. Please read it carefully. 

1. LOCATION AND NATURE OF RETREAT

This retreat takes place in North Kawartha, Ontario, Canada. The experience may involve deep emotional, spiritual, sensual, and physical practices, including, but not limited to, breathwork, conscious sexuality, somatic embodiment, sacred rituals, nature immersion, nudity, and connection in community. I acknowledge that the Retreat is located on a rural property with water access, and that by going onto the property and/or into the water, I am accepting the risks involved, including but not limited to those listed herein.

2. CONSENT-BASED PARTICIPATION

Participation in all activities is entirely optional. I may opt out or change my mind at any time. Consent is the foundation of this retreat, and my ‘no’ is honoured equally to my ‘yes’.

3. TOUCH, SEXUALITY, AND NUDITY

Practices may include non-sexual touch, sacred sexuality, and clothing-optional experiences. At no time will I be required to touch or be touched, express nudity, or engage in any sexual or sensual activity. I agree not to engage in uninvited touch or behaviour and to respect others' boundaries. I understand penetrative sexual touch is never permitted in shared retreat spaces.

4. EMOTIONAL & PSYCHOLOGICAL WELL-BEING

This retreat includes transformative practices which may trigger emotional release. The facilitators are not therapists, medical professionals, or psychologists. I am responsible for seeking professional support if needed. I confirm I am mentally and emotionally able to participate.

5. CONFIDENTIALITY & SAFE SPACE AGREEMENT

I agree to hold all information gained while participating in the Retreat, including but not limited to all identities, in strict confidentiality. I will not record audio/video of others without their consent. I will create and uphold a space of respect, inclusivity, and non-judgment.

6. CONSENT TO RISK 

I freely consent to engaging in the Retreat as described to me herein and at such other times by Phoenix Rising Retreats.

I am aware that there are certain risks associated with the Retreat, including but not limited to those enumerated herein such as:

fire elements, such as fire pits, candles;
water-based activities such as hot tubs, paddleboards;
heat, such as a sauna, or hot weather;
physical activities, such as yoga or movement exercises;
physical risks that exist when outdoors
These risks have been explained to me by Phoenix Rising Retreats, and I assume them freely with the potential consequences in mind.

7. ASSUMPTION OF RISK & WAIVER OF LIABILITY

Having consented to the risks that may be associated with the Retreat, I release Phoenix Rising Retreats, its principals, agents, employees, successors, and assigns from any and all liability, including personal injury, illness, trauma, or property loss. I assume all risk, foreseeable or not, from my participation in the Retreat.

8. INDEMNITY

I agree to indemnify and hold harmless Phoenix Rising Retreats, its principals, agents, employees, successors, and assigns from any legal claims, costs, or damages resulting from my actions during the Retreat.

9. EMERGENCY & MEDICAL CARE

You are encouraged to carry personal health/travel insurance.

10. DRUG & ALCOHOL POLICY

I agree not to use drugs or alcohol during the Retreat. This is to maintain a safe, grounded, and trauma-informed consent-based container for all participants.

11. SMOKING POLICY

Phoenix Rising Retreats is a smoke-free property. Smoking of any kind; including tobacco, cannabis, vaping, or other substances, is not permitted anywhere on the retreat grounds, including indoor and outdoor spaces. This policy is in place to honour the sacred nature of the land, respect the well-being of all guests, and maintain a clean, healthy, and energetically aligned environment. I acknowledge and agree to uphold this policy. 

12. PARTICIPANT CONDUCT & REMOVAL POLICY

Phoenix Rising Retreats reserve the right to remove any participant from the retreat who breaches consent, causes harm, or violates group safety. I acknowledge that if removed from the Retreat for these reasons, I will not be entitled to a refund. I acknowledge that forfeiting my deposit does limit my liability to Phoenix Rising Retreats or other participants of the Retreat. 

13. LEGAL AGE AND BINDING AGREEMENT

I confirm you are 18 years of age or older and legally competent to enter into this agreement. I acknowledge this waiver is binding on my heirs, agents, and assigns.

14. GOVERNING LAW

This Agreement shall be governed by the laws of Ontario, Canada. Any disputes shall be handled exclusively in courts located in the County of Peterborough, Ontario.

By signing below, I affirm that I have read and understood this Consent, Waiver & Release Agreement. I accept all stated terms and enter into this agreement voluntarily and without coercion.
